HOUSE BILL No. 1099 A BILL FOR AN ACT to amend the Indiana Code concerning the general assembly. Be it enacted by the General Assembly of the State of Indiana: 1 SECTION 1. IC 2-3-1-0.5 IS ADDED TO THE INDIANA CODE 2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE 3 UPON PASSAGE]: Sec. 0.5. As used in this chapter, "state average 4 wage" refers to the state average wage determined by the Indiana 5 economic development corporation for purposes of administering 6 the economic development for a growing economy tax credit under 7 IC 6-3.1-13. 8 SECTION 2. IC 2-3-1-1, AS AMENDED BY P.L.229-2011, 9 SECTION 38, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE 10 UPON PASSAGE]: Sec. 1. (a) Except as provided in subsection (c), 11 For a calendar year beginning after December 31, 2023, the annual 12 salary of the members of the general assembly shall be is an amount 13 equal to the lesser of the following: 14 (1) An amount equal to eighteen percent (18%) of the annual 15 salary of a judge under IC 33-38-5-6, as adjusted under 16 IC 33-38-5-8.1. 17 (2) The amount determined before July 1 under STEP 2023 IN 1099—LS 6823/DI 92 2 1 THREE of the following formula: 2 STEP ONE: Determine the amount of the annual salary 3 paid under subsection (b) to each member of the general 4 assembly that year. 5 STEP TWO: Determine the quotient of: 6 (i) the state average wage for the previous calendar year; 7 divided by 8 (ii) the state average wage for the calendar year 9 immediately proceeding the previous calendar year. 10 STEP THREE: Determine the product of: 11 (i) the STEP ONE result; multiplied by 12 (ii) the STEP TWO result. 13 (b) One-half (1/2) the annual salary shall be is paid on the fifteenth 14 day of January, and one-half (1/2) the annual salary shall be is paid on 15 the fifteenth day of February. 16 (c) Notwithstanding any other law, the annual salary of the members 17 of the general assembly shall not be increased during the state fiscal 18 year beginning July 1, 2011, or during the state fiscal year beginning 19 July 1, 2012, regardless of any increase in the annual salary of a judge 20 under IC 33-38-5-6, as adjusted under IC 33-38-5-8.1. 21 (c) Before June 1, the Indiana economic development 22 corporation shall certify the state average wage information 23 required for the calculation made under subsection (a) to the: 24 (1) budget agency; and 25 (2) legislative council in an electronic format under IC 5-14-6. 26 SECTION 3.
