3030 A BILL FOR AN ACT to amend the Indiana Code concerning
3131 education.
3232 Be it enacted by the General Assembly of the State of Indiana:
3333 1 SECTION 1. IC 5-2-10.1-6, AS AMENDED BY P.L.40-2014,
3434 2 SECTION 1, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
3535 3 JULY 1, 2023]: Sec. 6. (a) A school corporation, school corporation
3636 4 career and technical education school described in IC 20-37-1-1,
3737 5 educational service center (as defined in IC 20-20-1-2), or charter
3838 6 school (as defined in IC 20-24-1-4) may receive a grant from the fund
3939 7 for programs, equipment, services, or activities included in a safety
4040 8 plan submitted with the application for funds to the institute.
4141 9 (b) A safety plan submitted under this section must include
4242 10 provisions for zero (0) tolerance for alcohol, tobacco, drugs, and
4343 11 weapons on school property. If the institute approves the safety plan
4444 12 and application, the treasurer of state shall disburse from the fund to
4545 13 the applicant the amount of the grant certified to the treasurer of state
4646 14 by the institute.
4747 15 SECTION 2. IC 5-2-10.1-7, AS AMENDED BY P.L.40-2014,
4848 16 SECTION 2, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
4949 17 JULY 1, 2023]: Sec. 7. (a) As used in this section, "program" refers to

5151 1 a school safe haven program.
5252 2 (b) A school corporation, school corporation career and technical
5353 3 education school described in IC 20-37-1-1, educational service
5454 4 center (as defined in IC 20-20-1-2), or charter school (as defined in
5555 5 IC 20-24-1-4) may apply to the institute for a grant for matching funds
5656 6 under this chapter to establish and operate a school safe haven
5757 7 program.
5858 8 (c) A program must include at least the following components:
5959 9 (1) The school must be open to students of the school before and
6060 10 after normal operating hours, preferably from 7 a.m. to 9 p.m., on
6161 11 days determined by the school corporation.
6262 12 (2) The program must operate according to a plan to do the
6363 13 following in the school:
6464 14 (A) Reduce alcohol, tobacco, and drug abuse.
6565 15 (B) Reduce violent behavior.
6666 16 (C) Promote educational progress.
6767 17 (d) The institute shall adopt rules to administer the program,
6868 18 including rules concerning evaluations by school corporations, and
6969 19 school corporation career and technical education schools described in
7070 20 IC 20-37-1-1, and educational service centers (as defined in
7171 21 IC 20-20-1-2) on the use and impact of grant money received through
7272 22 the program.
7373 23 SECTION 3. IC 5-2-10.1-10, AS AMENDED BY P.L.40-2014,
7474 24 SECTION 3, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
7575 25 JULY 1, 2023]: Sec. 10. (a) A county may establish a county school
7676 26 safety commission.
7777 27 (b) The members of the commission are as follows:
7878 28 (1) The school safety specialist for each school corporation
7979 29 located in whole or in part in the county.
8080 30 (2) The judge of the court having juvenile jurisdiction in the
8181 31 county or the judge's designee.
8282 32 (3) The sheriff of the county or the sheriff's designee.
8383 33 (4) The chief officer of every other law enforcement agency in the
8484 34 county, or the chief officer's designee.
8585 35 (5) A representative of the juvenile probation system, appointed
8686 36 by the judge described under subdivision (2).
8787 37 (6) Representatives of community agencies that work with
8888 38 children within the county.
8989 39 (7) A representative of the Indiana state police district that serves
9090 40 the county.
9191 41 (8) A representative of the prosecuting attorneys council of
9292 42 Indiana who specializes in the prosecution of juveniles.

9494 1 (9) Other appropriate individuals selected by the commission.
9595 2 (c) If a commission is established, the school safety specialist of the
9696 3 school corporation having the largest ADM (as defined in
9797 4 IC 20-18-2-2), as determined in the fall count of ADM in the school
9898 5 year ending in the current calendar year, in the county shall convene
9999 6 the initial meeting of the commission.
100100 7 (d) The members shall annually elect a chairperson.
101101 8 (e) A commission shall perform the following duties:
102102 9 (1) Perform a cumulative analysis of school safety needs within
103103 10 the county.
104104 11 (2) Coordinate and make recommendations for the following:
105105 12 (A) Prevention of juvenile offenses and improving the
106106 13 reporting of juvenile offenses within the schools.
107107 14 (B) Proposals for identifying and assessing children who are
108108 15 at high risk of becoming juvenile offenders.
109109 16 (C) Methods to meet the educational needs of children who
110110 17 have been detained as juvenile offenders.
111111 18 (D) Methods to improve communications among agencies that
112112 19 work with children.
113113 20 (E) Methods to improve security and emergency preparedness.
114114 21 (F) Additional equipment or personnel that are necessary to
115115 22 carry out safety plans.
116116 23 (G) Any other topic the commission considers necessary to
117117 24 improve school safety within the school corporations within
118118 25 the commission's jurisdiction.
119119 26 (3) Provide assistance to the school safety specialists on the
120120 27 commission in developing and requesting grants for safety plans.
121121 28 (4) Provide assistance to the school safety specialists on the
122122 29 commission and the participating school corporations and school
123123 30 corporation career and technical education schools described in
124124 31 IC 20-37-1-1 in developing and requesting grants for school safe
125125 32 haven programs under section 7 of this chapter.
126126 33 (5) Assist each participating school corporation and each school
127127 34 corporation career and technical education schools described in
128128 35 IC 20-37-1-1 or educational service center (as defined in
129129 36 IC 20-20-1-2) in carrying out the school corporation's, or career
130130 37 and technical education school's, or educational service center's
131131 38 safety plans.
132132 39 (f) The affirmative votes of a majority of the voting members of the
133133 40 commission are required for the commission to take action on a
134134 41 measure.
135135 42 (g) A commission shall receive the school safety plans described in
136136 2023 IN 1542—LS 7004/DI 143 4
137137 1 IC 20-26-18.2-2 for the schools and school corporations located in the
138138 2 county. The commission may share the school safety plans with law
139139 3 enforcement agencies.
140140 4 SECTION 4. IC 10-21-1-4, AS AMENDED BY P.L.139-2022,
141141 5 SECTION 2, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
142142 6 JULY 1, 2023]: Sec. 4. (a) The board may award a matching grant to
143143 7 enable a school corporation, charter school, or accredited nonpublic
144144 8 school (or a coalition of schools applying jointly) to:
145145 9 (1) establish a program to employ a school resource officer;
146146 10 (2) employ a law enforcement officer;
147147 11 (3) provide school resource officer training described in
148148 12 IC 20-26-18.2-1(c);
149149 13 (4) conduct a threat assessment;
150150 14 (5) purchase equipment to restrict access to the school or expedite
151151 15 the notification of first responders; or
152152 16 (6) implement a student and parent support services plan in the
153153 17 manner set forth in IC 20-34-9;
154154 18 in accordance with section 2(a) of this chapter.
155155 19 (b) A matching grant awarded to a school corporation, charter
156156 20 school, or accredited nonpublic school (or a coalition of schools
157157 21 applying jointly) may not exceed the lesser of the following during a
158158 22 two (2) year period beginning on or after May 1, 2013:
159159 23 (1) The total cost of the program established by the school
160160 24 corporation, charter school, or accredited nonpublic school (or the
161161 25 coalition of schools applying jointly).
162162 26 (2) Except as provided in subsection (d), the following amounts:
163163 27 (A) Thirty-five Fifty-two thousand five hundred dollars
164164 28 ($35,000) ($52,500) per year, in the case of a school
165165 29 corporation, charter school, or accredited nonpublic school
166166 30 that:
167167 31 (i) has an ADM of at least one (1) and less than one
168168 32 thousand one (1,001) students; and
169169 33 (ii) is not applying jointly with any other school corporation,
170170 34 charter school, or accredited nonpublic school.
171171 35 (B) Fifty Seventy-five thousand dollars ($50,000) ($75,000)
172172 36 per year, in the case of a school corporation, charter school, or
173173 37 accredited nonpublic school that:
174174 38 (i) has an ADM of more than one thousand (1,000) and less
175175 39 than five thousand one (5,001) students; and
176176 40 (ii) is not applying jointly with any other school corporation,
177177 41 charter school, or accredited nonpublic school.
178178 42 (C) Seventy-five One hundred twelve thousand dollars

180180 1 ($75,000) ($112,000) per year, in the case of a school
181181 2 corporation, charter school, or accredited nonpublic school
182182 3 that:
183183 4 (i) has an ADM of more than five thousand (5,000) and less
184184 5 than fifteen thousand one (15,001) students; and
185185 6 (ii) is not applying jointly with any other school corporation,
186186 7 charter school, or accredited nonpublic school.
187187 8 (D) One hundred fifty thousand dollars ($100,000) ($150,000)
188188 9 per year, in the case of a school corporation, charter school, or
189189 10 accredited nonpublic school that:
190190 11 (i) has an ADM of more than fifteen thousand (15,000); and
191191 12 (ii) is not applying jointly with any other school corporation,
192192 13 charter school, or accredited nonpublic school.
193193 14 (E) One hundred fifty thousand dollars ($100,000) ($150,000)
194194 15 per year, in the case of a coalition of schools applying jointly.
195195 16 (c) Except as provided in subsection (d), the match requirement for
196196 17 a grant under this chapter is based on the ADM, as follows:
197197 18 (1) For a school corporation, charter school, or accredited
198198 19 nonpublic school with an ADM of less than five hundred one
199199 20 (501) students, the grant match must be twenty-five percent
200200 21 (25%) of the grant amount described in subsection (b).
201201 22 (2) For a school corporation, charter school, or accredited
202202 23 nonpublic school with an ADM of more than five hundred (500)
203203 24 and less than one thousand one (1,001) students, the grant match
204204 25 must be fifty thirty-three percent (50%) (33%) of the grant
205205 26 amount described in subsection (b).
206206 27 (3) For a school corporation, charter school, or accredited
207207 28 nonpublic school with an ADM of more than one thousand
208208 29 (1,000) students or a coalition of schools applying jointly, the
209209 30 grant match must be one hundred fifty percent (100%) (50%) of
210210 31 the grant amount described in subsection (b).
211211 32 (d) A school corporation, charter school, or accredited nonpublic
212212 33 school may be eligible to receive a grant of up to:
213213 34 (1) one hundred fifty thousand dollars ($100,000) ($150,000) if:
214214 35 (A) the school corporation, charter school, or accredited
215215 36 nonpublic school receives a grant match of one hundred
216216 37 seventy-five percent (100%) (75%) of the requested grant
217217 38 amount; and
218218 39 (B) the board approves the grant request; or
219219 40 (2) for a school corporation, charter school, or accredited
220220 41 nonpublic school described subsection (c)(1) or (c)(2), a grant of
221221 42 up to fifty seventy-five thousand dollars ($50,000) ($75,000) if:

223223 1 (A) the school corporation, charter school, or accredited
224224 2 nonpublic school receives a grant match of fifty thirty-three
225225 3 percent (50%) (33%) of the requested grant amount; and
226226 4 (B) the board approves the grant request.
227227 5 (e) A school corporation, charter school, or accredited nonpublic
228228 6 school may receive only one (1) matching grant under this section each
229229 7 year.
230230 8 (f) The board may not award a grant to a school corporation, charter
231231 9 school, or accredited nonpublic school under this section unless the
232232 10 school corporation, charter school, or accredited nonpublic school is in
233233 11 a county that has a county school safety commission, as described in
234234 12 IC 5-2-10.1-10.
235235 13 (g) A matching grant awarded to a school corporation, charter
236236 14 school, or accredited nonpublic school under this section may be
237237 15 apportioned by the school corporation, charter school, or
238238 16 accredited nonpublic school to:
239239 17 (1) a career and technical education school described in
240240 18 IC 20-37-1-1; or
241241 19 (2) an educational service center (as defined in IC 20-20-1-2);
242242 20 for the purposes described in subsection (a).
