53+A BILL FOR AN ACT to amend the Indiana Code concerning
54+higher education.
1355 Be it enacted by the General Assembly of the State of Indiana:
14-SECTION 1. IC 21-12-16-5, AS AMENDED BY P.L.63-2021,
15-SECTION 2, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
16-JULY 1, 2023]: Sec. 5. (a) An applicant who is enrolled in an
17-accredited postsecondary educational institution after June 30, 2017,
18-may qualify for a scholarship under this chapter. To qualify for a
19-scholarship, an applicant must:
20-(1) apply for a scholarship on a form supplied by the commission;
21-(2) except as provided in subsection (b), have graduated from an
22-Indiana nonaccredited nonpublic or state accredited high school
23-accredited under IC 20-31-4.1 and:
24-(A) graduated in the highest twenty percent (20%) of students
25-in the applicant's high school graduating class;
26-(B) received a score in the top twentieth percentile on the SAT
27-or ACT examination; or
28-(C) achieved a cumulative grade point average upon
29-graduation of at least 3.5 3.0 on a 4.0 grading scale (or its
30-equivalent if another grading scale is used) for courses taken
31-during grades 9, 10, 11, and 12;
32-(3) have participated in school activities and community service
33-activities during high school;
34-(4) have applied to and been accepted for enrollment in an
35-accredited postsecondary educational institution approved by the
36-HEA 1637 — Concur 2
37-commission under section 10 of this chapter;
38-(5) agree in writing to:
39-(A) obtain a license to teach under IC 20-28-5; and
40-(B) teach for at least five (5) consecutive years in a public
41-school or an eligible school (as defined in IC 20-51-1-4.7) in
42-Indiana after graduating with a baccalaureate degree from the
43-accredited postsecondary educational institution described in
44-subdivision (4); and
45-(6) meet any other criteria established by the commission.
46-(b) A student who graduates from a nonaccredited nonpublic school
47-must meet the requirement described in subsection (a)(2)(B) in order
48-to meet the eligibility requirement described in subsection (a)(2).
49-SECTION 2. IC 21-12-16-8, AS ADDED BY P.L.105-2016,
50-SECTION 1, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
51-JULY 1, 2023]: Sec. 8. (a) Subject to subsections (b) and (c), if an
52-applicant meets the requirements under this chapter, the commission
53-may award, for not more than four (4) academic years, a scholarship to
54-the applicant in an amount of seven ten thousand five hundred dollars
55-($7,500) ($10,000) for each academic year that the applicant attends
56-the accredited postsecondary educational institution approved by the
57-commission under section 10 of this chapter.
58-(b) The commission may not do the following:
59-(1) award a scholarship under this chapter in an amount of more
60-than a total of thirty forty thousand dollars ($30,000) ($40,000)
61-to an individual applicant.
62-(2) Award scholarships under this chapter to more than two
63-hundred (200) new applicants each academic year.
64-(c) If the total amount to be distributed from the fund in a state fiscal
65-year exceeds the amount available for distribution, the amount to be
66-distributed to each eligible applicant shall be proportionately reduced
67-so that the total reductions equal the amount of the excess.
68-SECTION 3. IC 21-12-16.5 IS ADDED TO THE INDIANA CODE
56+1 SECTION 1. IC 21-12-16-5, AS AMENDED BY P.L.63-2021,
57+2 SECTION 2, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
58+3 JULY 1, 2023]: Sec. 5. (a) An applicant who is enrolled in an

83+10 school or an eligible school (as defined in IC 20-51-1-4.7) in
84+11 Indiana after graduating with a baccalaureate degree from the
85+12 accredited postsecondary educational institution described in
86+13 subdivision (4); and
87+14 (6) meet any other criteria established by the commission.
88+15 (b) A student who graduates from a nonaccredited nonpublic school
89+16 must meet the requirement described in subsection (a)(2)(B) in order
90+17 to meet the eligibility requirement described in subsection (a)(2).
91+18 SECTION 2. IC 21-12-16-8, AS ADDED BY P.L.105-2016,
92+19 SECTION 1, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
93+20 JULY 1, 2023]: Sec. 8. (a) Subject to subsections (b) and (c), if an

110+37 SECTION 3. IC 21-12-16.5 IS ADDED TO THE INDIANA CODE
111+38 AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE

113+40 Chapter 16.5. Next Generation Hoosier Minority Educators
114+41 Scholarship
115+42 Sec. 1. As used in this chapter, "program" means the next

117+1 generation Hoosier minority educators scholarship program
118+2 established by section 2 of this chapter.
119+3 Sec. 2. (a) The next generation Hoosier minority educators
120+4 scholarship program is established.
121+5 (b) The commission shall receive and consider applications for
122+6 a next generation Hoosier minority educators scholarship under
123+7 this chapter.
124+8 Sec. 3. (a) The next generation Hoosier minority educators
125+9 scholarship fund is established for the purpose of providing
126+10 scholarships to attract and retain eligible applicants to the teaching
127+11 profession.
128+12 (b) The fund consists of the following:
129+13 (1) Appropriations made by the general assembly.
130+14 (2) Gifts, grants, devises, or bequests made to the commission
131+15 to achieve the purposes of the fund.
132+16 (c) The commission shall administer the fund.
133+17 (d) The expenses of administering the fund shall be paid from
134+18 money in the fund.
135+19 (e) The treasurer of state shall invest the money in the fund not
136+20 currently needed to meet the obligations of the fund in the same
137+21 manner as other public funds may be invested. Interest that
138+22 accrues from these investments shall be deposited in the fund.
139+23 (f) Money in the fund at the end of a state fiscal year does not
140+24 revert to the state general fund but remains available to be used for
141+25 the purposes of this chapter.
142+26 Sec. 4. The commission shall do all the following:
143+27 (1) Develop a promotional program to inform and attract
144+28 students to participate in the next generation Hoosier
145+29 minority educators scholarship program.
146+30 (2) Establish protocols and procedures concerning the
147+31 application process for the program.
148+32 (3) Develop protocols, in consultation with accredited
149+33 postsecondary educational institutions approved by the
150+34 commission under section 10 of this chapter, to ensure
151+35 successful completion of the program and assist graduates in
152+36 completing the requirements of the program.
153+37 (4) Establish, in coordination with the governor's office, a
154+38 guide for the management of the program by commission
155+39 personnel.
156+40 (5) Designate personnel to manage the program.
157+41 Sec. 5. (a) An applicant who is enrolled in an accredited
158+42 postsecondary educational institution may qualify for a scholarship

160+1 under this chapter. To qualify for a scholarship, an applicant must:
161+2 (1) apply for a scholarship on a form supplied by the
162+3 commission;
163+4 (2) except as provided in subsection (b), have graduated from
164+5 an Indiana nonaccredited nonpublic or state accredited high
165+6 school accredited under IC 20-31-4.1 and:
166+7 (A) graduated in the highest twenty percent (20%) of
167+8 students in the applicant's high school graduating class;
168+9 (B) received a score in the top twentieth percentile on the
169+10 SAT or ACT examination; or
170+11 (C) achieved a cumulative grade point average upon
171+12 graduation of at least 3.0 on a 4.0 grading scale (or its
172+13 equivalent if another grading scale is used) for courses
173+14 taken during grades 9, 10, 11, and 12;
174+15 (3) have participated in school activities and community
175+16 service activities during high school;
176+17 (4) have applied to and been accepted for enrollment in an
177+18 accredited postsecondary educational institution approved by
178+19 the commission under section 10 of this chapter;
179+20 (5) agree in writing to:
180+21 (A) obtain a license to teach under IC 20-28-5; and
181+22 (B) teach for at least five (5) consecutive years in a public
182+23 school or an eligible school (as defined in IC 20-51-1-4.7) in
183+24 Indiana after graduating with a baccalaureate degree from
184+25 the accredited postsecondary educational institution
185+26 described in subdivision (4);
186+27 (6) meet the definition of a minority under IC 21-13-1-6; and
187+28 (7) meet any other criteria established by the commission.
188+29 (b) A student who graduates from a nonaccredited nonpublic
189+30 school must meet the requirement described in subsection (a)(2)(B)
190+31 in order to meet the eligibility requirement described in subsection
191+32 (a)(2).
192+33 Sec. 6. (a) The commission shall consider each application and
193+34 determine the eligibility of the applicant for the scholarship. The
194+35 commission shall give priority to recent high school graduates,
195+36 students pursuing teacher shortage areas as described in 34 CFR
196+37 682.210(q)(6), and students showing significant financial need when
197+38 selecting applicants.
198+39 (b) The commission shall also give priority to an individual who
199+40 is a member of a household with an annual income of not more
200+41 than the amount required for the individual to qualify for the free
201+42 or reduced price lunch program under the national school lunch

203+1 program as determined for the immediately preceding taxable year
204+2 for the household for which the individual was claimed as a
205+3 dependent.
206+4 Sec. 7. Before receiving a scholarship under this chapter, the
207+5 applicant must enter into a contract with the commission agreeing
208+6 to:
209+7 (1) the terms and conditions described in section 5(a)(5) of this
210+8 chapter; and
211+9 (2) any other terms and conditions established by the
212+10 commission.
213+11 Sec. 7.5. A student who:
214+12 (1) is at least seventeen (17) years of age; and
215+13 (2) enters into a contract for a scholarship under this chapter
216+14 to defray the expense of attending any postsecondary
217+15 educational institution;
218+16 has full legal capacity to act in the student's own behalf in this
219+17 transaction and is subject to any obligation that arises from the
220+18 contract.
221+19 Sec. 8. (a) Subject to subsections (b) and (c), if an applicant
222+20 meets the requirements under this chapter, the commission may
223+21 award, for not more than four (4) academic years, a scholarship to
224+22 the applicant in an amount of ten thousand dollars ($10,000) for
225+23 each academic year that the applicant attends the accredited
226+24 postsecondary educational institution approved by the commission
227+25 under section 10 of this chapter.
228+26 (b) The commission may not award a scholarship under this
229+27 chapter in an amount of more than a total of forty thousand dollars
230+28 ($40,000) to an individual applicant.
231+29 (c) If the total amount to be distributed from the fund in a state
232+30 fiscal year exceeds the amount available for distribution, the
233+31 amount to be distributed to each eligible applicant shall be
234+32 proportionately reduced so that the total reductions equal the
235+33 amount of the excess.
236+34 Sec. 9. (a) Except as provided in subsection (b), the commission
237+35 shall establish standards that a student must meet to remain
238+36 eligible to receive a scholarship under this chapter. The standards
239+37 must include the following:
240+38 (1) Maintaining a cumulative minimum grade point average
241+39 of at least 3.0 on a 4.0 scale.
242+40 (2) Enrolling in and completing at least fifteen (15) credit
243+41 hours each semester or its equivalent.
244+42 (3) Any other requirements the commission considers

246+1 necessary.
247+2 (b) The commission may allow a student who fails to meet the
248+3 standards described in subsection (a) and is ineligible for an award
249+4 during the next academic year to maintain eligibility if the student
250+5 submits a petition to the commission in a manner prescribed by the
251+6 commission so that the commission may make a determination that
252+7 extenuating circumstances, as determined by the commission,
253+8 prevented the student from meeting the standards described in
254+9 subsection (a).
255+10 (c) If the commission grants a waiver under subsection (b), the
256+11 commission may:
257+12 (1) place the student on probationary status; and
258+13 (2) establish additional requirements for the student.
259+14 Sec. 10. (a) The commission may not award a scholarship under
260+15 this chapter to an applicant unless the applicant has applied to and
261+16 been accepted for enrollment in an accredited postsecondary
262+17 educational institution approved by the commission under this
263+18 section.
264+19 (b) The commission shall establish standards for teacher
265+20 education that an accredited postsecondary educational institution
266+21 must meet to receive approval by the commission under this
267+22 section, including the:
268+23 (1) information an accredited postsecondary educational
269+24 institution is required to submit to the commission regarding
270+25 the institution's teacher education program; and
271+26 (2) criteria and standards for approval.
272+27 Sec. 11. An individual who:
273+28 (1) received a scholarship under this chapter;
274+29 (2) is no longer enrolled in an accredited postsecondary
275+30 educational institution approved by the commission under
276+31 section 10 of this chapter; and
277+32 (3) did not receive a baccalaureate degree from an accredited
278+33 postsecondary educational institution approved by the
279+34 commission under section 10 of this chapter;
280+35 shall repay the amount of the scholarship awarded to the
281+36 individual under this chapter in a timely fashion, as determined by
282+37 the commission.
283+38 Sec. 12. (a) Except as provided in subsections (b) and (c), if an
284+39 individual:
285+40 (1) receives a scholarship under this chapter; and
286+41 (2) fails to teach in a public school or an eligible school (as
287+42 defined in IC 20-51-1-4.7) in Indiana for at least five (5)

289+1 consecutive years as described in section 5(a)(5) of this
290+2 chapter;
291+3 the individual shall repay the total amount of the scholarship
292+4 awarded to the individual under this chapter in a timely fashion.
293+5 The total amount that an individual is required to repay shall be
294+6 reduced by twenty percent (20%), as determined by the
295+7 commission, for each consecutive year the individual teaches at a
296+8 public school or eligible school (as defined in IC 20-51-1-4.7).
297+9 (b) The commission may extend the length of time in which an
298+10 individual must complete the requirements of an agreement
299+11 described in section 5(a)(5) of this chapter if the individual submits
300+12 a petition to the commission in a manner prescribed by the
301+13 commission and the commission makes a determination that
302+14 extenuating circumstances, as determined by the commission,
303+15 prevented the individual from timely meeting the requirements
304+16 described in section 5(a)(5) of this chapter.
305+17 (c) The commission may waive repayment under subsection (a)
306+18 if the individual has been declared to be totally and permanently
307+19 disabled under 34 CFR 685.213.
308+20 (d) The commission may enter into an agreement with the
309+21 department of state revenue established by IC 6-8.1-2-1 or another
310+22 third party vendor to assist in the enforcement of subsection (a)
311+23 and section 11 of this chapter.
312+24 Sec. 13. An individual who receives a scholarship under this
313+25 chapter is not required to teach at the same public school or
314+26 eligible school (as defined in IC 20-51-1-4.7) in Indiana for five (5)
315+27 consecutive years.
316+28 Sec. 14. The commission shall administer the scholarship
317+29 awarded under this chapter as a financial aid award.
318+30 Sec. 15. (a) Subject to subsections (c) and (d), the amount of a
319+31 scholarship awarded under this chapter may not be reduced
320+32 because the student receives other scholarships or forms of
321+33 financial aid.
322+34 (b) Except as otherwise provided under law and subject to
323+35 subsection (c), the amount of any other state financial aid received
324+36 by a student may not be reduced because the student receives a
325+37 scholarship under this chapter.
326+38 (c) The total amount of scholarships or other financial aid a
327+39 student receives may not exceed the total amount of expenses to
328+40 attend the accredited postsecondary educational institution,
329+41 including tuition, room, board, and other fees.
330+42 (d) The commission may not award a scholarship to an

332+1 individual under this chapter if the individual receives an award
333+2 under IC 21-12-16.
334+3 Sec. 16. An applicant is eligible to receive a scholarship under
335+4 this chapter only if an appropriation has been made to carry out
336+5 the specific purposes of this chapter.
337+6 Sec. 17. (a) The commission shall maintain complete and
338+7 accurate records in implementing the next generation Hoosier
339+8 minority educators scholarship fund established by section 3 of this
340+9 chapter, including records of the following:
341+10 (1) The receipt, disbursement, and uses of money from the
342+11 fund.
343+12 (2) The number of applications for the next generation
344+13 Hoosier minority educators scholarship.
345+14 (3) The number and amount of next generation Hoosier
346+15 minority educators scholarships that have been provided by
347+16 the commission.
348+17 (4) Any other information collected concerning the fund or
349+18 next generation Hoosier minority educators scholarships
350+19 awarded under this chapter.
351+20 (b) Not later than November 1, 2023, and each November 1
352+21 thereafter, the commission shall submit a report to the governor
353+22 and, in an electronic format under IC 5-14-6, to the general
354+23 assembly summarizing the records described in subsection (a).
355+24 Sec. 18. The commission shall notify all applicants approved
356+25 under section 5 of this chapter of the requirements under sections
357+26 11 and 12 of this chapter.
358+27 Sec. 19. The commission may adopt rules under IC 4-22-2
359+28 necessary to carry out this chapter.
360+29 SECTION 4. IC 21-13-8-2, AS AMENDED BY P.L.52-2022,
361+30 SECTION 8, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
362+31 JULY 1, 2023]: Sec. 2. A scholarship under section 1 of this chapter

88413 (2) Gifts, grants, devises, or bequests made to the commission
89414 to achieve the purposes of the fund.
90415 (c) The commission shall administer the fund.
91416 (d) The expenses of administering the fund shall be paid from
92417 money in the fund.
93418 (e) The treasurer of state shall invest the money in the fund not
94419 currently needed to meet the obligations of the fund in the same
95420 manner as other public funds may be invested. Interest that
96421 accrues from these investments shall be deposited in the fund.
97422 (f) Money in the fund at the end of a state fiscal year does not
98423 revert to the state general fund but remains available to be used for
99424 the purposes of this chapter.
100425 Sec. 4. The commission shall do all the following:
101426 (1) Develop a promotional program to inform and attract
102427 students to participate in the next generation Hoosier
103428 minority educators scholarship program.
104429 (2) Establish protocols and procedures concerning the
105430 application process for the program.
106431 (3) Develop protocols, in consultation with accredited
107432 postsecondary educational institutions approved by the
108433 commission under section 10 of this chapter, to ensure
109434 successful completion of the program and assist graduates in
110435 completing the requirements of the program.
111436 (4) Establish, in coordination with the governor's office, a
112437 guide for the management of the program by commission
113438 personnel.
114439 (5) Designate personnel to manage the program.
115440 Sec. 5. (a) An applicant who is enrolled in an accredited

116442 postsecondary educational institution may qualify for a scholarship
117443 under this chapter. To qualify for a scholarship, an applicant must:
118444 (1) apply for a scholarship on a form supplied by the
119445 commission;
120446 (2) except as provided in subsection (b), have graduated from
121447 an Indiana nonaccredited nonpublic or state accredited high

123448 school accredited under IC 20-31-4.1 and:
124449 (A) graduated in the highest twenty percent (20%) of
125450 students in the applicant's high school graduating class;
126451 (B) received a score in the top twentieth percentile on the
127452 SAT or ACT examination; or
128453 (C) achieved a cumulative grade point average upon
129454 graduation of at least 3.0 on a 4.0 grading scale (or its
130455 equivalent if another grading scale is used) for courses
131456 taken during grades 9, 10, 11, and 12;
132457 (3) have participated in school activities and community
133458 service activities during high school;
134459 (4) have applied to and been accepted for enrollment in an
135460 accredited postsecondary educational institution approved by
136461 the commission under section 10 of this chapter;
137462 (5) agree in writing to:
138463 (A) obtain a license to teach under IC 20-28-5; and
139464 (B) teach for at least five (5) consecutive years in a public
140465 school or an eligible school (as defined in IC 20-51-1-4.7) in
141466 Indiana after graduating with a baccalaureate degree from
142467 the accredited postsecondary educational institution
143468 described in subdivision (4);
144469 (6) meet the definition of a minority under IC 21-13-1-6; and
145470 (7) meet any other criteria established by the commission.
146471 (b) A student who graduates from a nonaccredited nonpublic
147472 school must meet the requirement described in subsection (a)(2)(B)
148473 in order to meet the eligibility requirement described in subsection
149474 (a)(2).
150475 Sec. 6. (a) The commission shall consider each application and
151476 determine the eligibility of the applicant for the scholarship. The
152477 commission shall give priority to recent high school graduates,
153478 students pursuing teacher shortage areas as described in 34 CFR
154479 682.210(q)(6), and students showing significant financial need when
155480 selecting applicants.
156481 (b) The commission shall also give priority to an individual who
157482 is a member of a household with an annual income of not more
158483 than the amount required for the individual to qualify for the free

159485 or reduced price lunch program under the national school lunch
160486 program as determined for the immediately preceding taxable year
161487 for the household for which the individual was claimed as a
162488 dependent.
163489 Sec. 7. Before receiving a scholarship under this chapter, the
164490 applicant must enter into a contract with the commission agreeing

166491 to:
167492 (1) the terms and conditions described in section 5(a)(5) of this
168493 chapter; and
169494 (2) any other terms and conditions established by the
170495 commission.
171496 Sec. 7.5. A student who:
172497 (1) is at least seventeen (17) years of age; and
173498 (2) enters into a contract for a scholarship under this chapter
174499 to defray the expense of attending any postsecondary
175500 educational institution;
176501 has full legal capacity to act in the student's own behalf in this
177502 transaction and is subject to any obligation that arises from the
178503 contract.
179504 Sec. 8. (a) Subject to subsections (b) and (c), if an applicant
180505 meets the requirements under this chapter, the commission may
181506 award, for not more than four (4) academic years, a scholarship to
182507 the applicant in an amount of ten thousand dollars ($10,000) for
183508 each academic year that the applicant attends the accredited
184509 postsecondary educational institution approved by the commission
185510 under section 10 of this chapter.
186511 (b) The commission may not award a scholarship under this
187512 chapter in an amount of more than a total of forty thousand dollars
188513 ($40,000) to an individual applicant.
189514 (c) If the total amount to be distributed from the fund in a state
190515 fiscal year exceeds the amount available for distribution, the
191516 amount to be distributed to each eligible applicant shall be
192517 proportionately reduced so that the total reductions equal the
193518 amount of the excess.
194519 Sec. 9. (a) Except as provided in subsection (b), the commission
195520 shall establish standards that a student must meet to remain
196521 eligible to receive a scholarship under this chapter. The standards
197522 must include the following:
198523 (1) Maintaining a cumulative minimum grade point average
199524 of at least 3.0 on a 4.0 scale.
200525 (2) Enrolling in and completing at least fifteen (15) credit
201526 hours each semester or its equivalent.

202528 (3) Any other requirements the commission considers
203529 necessary.
204530 (b) The commission may allow a student who fails to meet the
205531 standards described in subsection (a) and is ineligible for an award
206532 during the next academic year to maintain eligibility if the student
207533 submits a petition to the commission in a manner prescribed by the

209534 commission so that the commission may make a determination that
210535 extenuating circumstances, as determined by the commission,
211536 prevented the student from meeting the standards described in
212537 subsection (a).
213538 (c) If the commission grants a waiver under subsection (b), the
214539 commission may:
215540 (1) place the student on probationary status; and
216541 (2) establish additional requirements for the student.
217542 Sec. 10. (a) The commission may not award a scholarship under
218543 this chapter to an applicant unless the applicant has applied to and
219544 been accepted for enrollment in an accredited postsecondary
220545 educational institution approved by the commission under this
221546 section.
222547 (b) The commission shall establish standards for teacher
223548 education that an accredited postsecondary educational institution
224549 must meet to receive approval by the commission under this
225550 section, including the:
226551 (1) information an accredited postsecondary educational
227552 institution is required to submit to the commission regarding
228553 the institution's teacher education program; and
229554 (2) criteria and standards for approval.
230555 Sec. 11. An individual who:
231556 (1) received a scholarship under this chapter;
232557 (2) is no longer enrolled in an accredited postsecondary
233558 educational institution approved by the commission under
234559 section 10 of this chapter; and
235560 (3) did not receive a baccalaureate degree from an accredited
236561 postsecondary educational institution approved by the
237562 commission under section 10 of this chapter;
238563 shall repay the amount of the scholarship awarded to the
239564 individual under this chapter in a timely fashion, as determined by
240565 the commission.
241566 Sec. 12. (a) Except as provided in subsections (b) and (c), if an
242567 individual:
243568 (1) receives a scholarship under this chapter; and
244569 (2) fails to teach in a public school or an eligible school (as

245571 defined in IC 20-51-1-4.7) in Indiana for at least five (5)
246572 consecutive years as described in section 5(a)(5) of this
247573 chapter;
248574 the individual shall repay the total amount of the scholarship
249575 awarded to the individual under this chapter in a timely fashion.
250576 The total amount that an individual is required to repay shall be

252577 reduced by twenty percent (20%), as determined by the
253578 commission, for each consecutive year the individual teaches at a
254579 public school or eligible school (as defined in IC 20-51-1-4.7).
255580 (b) The commission may extend the length of time in which an
256581 individual must complete the requirements of an agreement
257582 described in section 5(a)(5) of this chapter if the individual submits
258583 a petition to the commission in a manner prescribed by the
259584 commission and the commission makes a determination that
260585 extenuating circumstances, as determined by the commission,
261586 prevented the individual from timely meeting the requirements
262587 described in section 5(a)(5) of this chapter.
263588 (c) The commission may waive repayment under subsection (a)
264589 if the individual has been declared to be totally and permanently
265590 disabled under 34 CFR 685.213.
266591 (d) The commission may enter into an agreement with the
267592 department of state revenue established by IC 6-8.1-2-1 or another
268593 third party vendor to assist in the enforcement of subsection (a)
269594 and section 11 of this chapter.
270595 Sec. 13. An individual who receives a scholarship under this
271596 chapter is not required to teach at the same public school or
272597 eligible school (as defined in IC 20-51-1-4.7) in Indiana for five (5)
273598 consecutive years.
274599 Sec. 14. The commission shall administer the scholarship
275600 awarded under this chapter as a financial aid award.
276601 Sec. 15. (a) Subject to subsections (c) and (d), the amount of a
277602 scholarship awarded under this chapter may not be reduced
278603 because the student receives other scholarships or forms of
279604 financial aid.
280605 (b) Except as otherwise provided under law and subject to
281606 subsection (c), the amount of any other state financial aid received
282607 by a student may not be reduced because the student receives a
283608 scholarship under this chapter.
284609 (c) The total amount of scholarships or other financial aid a
285610 student receives may not exceed the total amount of expenses to
286611 attend the accredited postsecondary educational institution,
287612 including tuition, room, board, and other fees.

288614 (d) The commission may not award a scholarship to an
289615 individual under this chapter if the individual receives an award
290616 under IC 21-12-16.
291617 Sec. 16. An applicant is eligible to receive a scholarship under
292618 this chapter only if an appropriation has been made to carry out
293619 the specific purposes of this chapter.

295620 Sec. 17. (a) The commission shall maintain complete and
296621 accurate records in implementing the next generation Hoosier
297622 minority educators scholarship fund established by section 3 of this
298623 chapter, including records of the following:
299624 (1) The receipt, disbursement, and uses of money from the
300625 fund.
301626 (2) The number of applications for the next generation
302627 Hoosier minority educators scholarship.
303628 (3) The number and amount of next generation Hoosier
304629 minority educators scholarships that have been provided by
305630 the commission.
306631 (4) Any other information collected concerning the fund or
307632 next generation Hoosier minority educators scholarships
308633 awarded under this chapter.
309634 (b) Not later than November 1, 2023, and each November 1
310635 thereafter, the commission shall submit a report to the governor
311636 and, in an electronic format under IC 5-14-6, to the general
312637 assembly summarizing the records described in subsection (a).
313638 Sec. 18. The commission shall notify all applicants approved
314639 under section 5 of this chapter of the requirements under sections
315640 11 and 12 of this chapter.
316641 Sec. 19. The commission may adopt rules under IC 4-22-2
317-necessary to carry out this chapter.
