30	30	A BILL FOR AN ACT to amend the Indiana Code concerning
31	31	transportation.
32	32	Be it enacted by the General Assembly of the State of Indiana:
33	33	1 SECTION 1. IC 8-23-2-21 IS ADDED TO THE INDIANA CODE
34	34	2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
35	35	3 1, 2023]: Sec. 21. (a) As used in this section, "intersection" means
36	36	4 the area embraced within:
37	37	5 (1) the prolongation or connection of the lateral curb lines, or
38	38	6 if none, then the lateral boundary lines of the roadways of two
39	39	7 (2) highways, streets, or roads that join at, or approximately
40	40	8 at, right angles; or
41	41	9 (2) the area within which vehicles traveling upon different
42	42	10 highways, streets, or roads joining at any other angle may
43	43	11 come in conflict.
44	44	12 (b) As used in this section, "legislative body" means the
45	45	13 following:
46	46	14 (1) The board of county commissioners, for a county not
47	47	15 subject to IC 36-2-3.5 or IC 36-3-1.
48	48	16 (2) The county council, for a county subject to IC 36-2-3.5.
49	49	17 (3) The city-county council, for a consolidated city or county

51	51	1 having a consolidated city.
52	52	2 (4) The common council, for a city other than a consolidated
53	53	3 city.
54	54	4 (5) The town council, for a town.
55	55	5 (6) The township board, for a township.
56	56	6 (7) The governing body of any other political subdivision that
57	57	7 has a governing body.
58	58	8 (8) The chief executive officer of any other political
59	59	9 subdivision that does not have a governing body.
60	60	10 (c) As used in this section, "unit" means a county, municipality,
61	61	11 township, or political subdivision.
62	62	12 (d) The department may not:
63	63	13 (1) perform traffic surveys of;
64	64	14 (2) engage in planning for; or
65	65	15 (3) perform construction, reconstruction, improvement,
66	66	16 maintenance, or repair to;
67	67	17 an intersection until the department has received input and
68	68	18 approval from the legislative body of the unit that has control over
69	69	19 the intersection where the tasks described in subdivisions (1)
70	70	20 through (3) would occur.
