3030 A BILL FOR AN ACT to amend the Indiana Code concerning
3131 transportation.
3232 Be it enacted by the General Assembly of the State of Indiana:
3333 1 SECTION 1. IC 8-23-2-21 IS ADDED TO THE INDIANA CODE
3434 2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
3535 3 1, 2023]: Sec. 21. (a) As used in this section, "intersection" means
3636 4 the area embraced within:
3737 5 (1) the prolongation or connection of the lateral curb lines, or
3838 6 if none, then the lateral boundary lines of the roadways of two
3939 7 (2) highways, streets, or roads that join at, or approximately
4040 8 at, right angles; or
4141 9 (2) the area within which vehicles traveling upon different
4242 10 highways, streets, or roads joining at any other angle may
4343 11 come in conflict.
4444 12 (b) As used in this section, "legislative body" means the
4545 13 following:
4646 14 (1) The board of county commissioners, for a county not
4747 15 subject to IC 36-2-3.5 or IC 36-3-1.
4848 16 (2) The county council, for a county subject to IC 36-2-3.5.
4949 17 (3) The city-county council, for a consolidated city or county

5151 1 having a consolidated city.
5252 2 (4) The common council, for a city other than a consolidated
5353 3 city.
5454 4 (5) The town council, for a town.
5555 5 (6) The township board, for a township.
5656 6 (7) The governing body of any other political subdivision that

5858 8 (8) The chief executive officer of any other political
5959 9 subdivision that does not have a governing body.
6060 10 (c) As used in this section, "unit" means a county, municipality,
6161 11 township, or political subdivision.
6262 12 (d) The department may not:
6363 13 (1) perform traffic surveys of;
6464 14 (2) engage in planning for; or
6565 15 (3) perform construction, reconstruction, improvement,
6666 16 maintenance, or repair to;
6767 17 an intersection until the department has received input and
6868 18 approval from the legislative body of the unit that has control over
6969 19 the intersection where the tasks described in subdivisions (1)
7070 20 through (3) would occur.
