5543 A BILL FOR AN ACT to amend the Indiana Code concerning state
5644 offices and administration.
5745 Be it enacted by the General Assembly of the State of Indiana:
5846 1 SECTION 1. IC 4-23-7.1-2, AS AMENDED BY P.L.42-2018,
5947 2 SECTION 7, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
6048 3 JULY 1, 2023]: Sec. 2. The state library shall:
6149 4 (1) develop and provide library service to state government, its
6250 5 branches, its departments and its officials and employees;
6351 6 (2) provide for the individual citizens of the state those
6452 7 specialized library services not generally appropriate, economical
6553 8 or available in other libraries of the state;
6654 9 (3) encourage and support the development of the library
6755 10 profession;
6856 11 (4) strengthen services of all types of publicly and privately
6957 12 supported special, school, academic, and public libraries; and
7058 13 (5) manage the historical bureau under IC 4-23-7.2; and
7159 14 (6) administer the Indiana imagination library program
7260 15 under IC 4-23-7.6.

7866 3 Sec. 1. The following definitions apply throughout this chapter:
7967 4 (1) "Eligible child" means a child who resides in Indiana and
8068 5 is not more than five (5) years of age.
8169 6 (2) "National early childhood literacy foundation" means a
8270 7 national nonprofit foundation that exists for the sole purpose
8371 8 of working with local nonprofit entities to identify eligible
8472 9 children and directly mail a reading selection each month to
8573 10 those children enrolled in the program at no cost to the
8674 11 family.
8775 12 (3) "Program" means the Indiana imagination library
8876 13 program established by section 2 of this chapter.
8977 14 (4) "Reading selection" means an age appropriate, high
9078 15 quality book mailed each month to an eligible child enrolled
9179 16 in the program.
9280 17 (5) "Statewide nonprofit organization" means the nonprofit
9381 18 organization described in section 3(a) of this chapter.
9482 19 Sec. 2. (a) The Indiana imagination library program is
9583 20 established to improve early childhood literacy by encouraging the
9684 21 children of Indiana to read regularly, engage in shared family
9785 22 reading, and build home libraries by providing monthly reading
9886 23 selections at no cost to the family of an eligible child.
9987 24 (b) The state library shall administer the program.
10088 25 Sec. 3. (a) The state library, in consultation with the department
10189 26 of education and the family and social services administration,
10290 27 shall:
10391 28 (1) establish a nonprofit organization that is tax exempt under
10492 29 Section 501(c)(3) of the Internal Revenue Code of 1986; or
10593 30 (2) enter into an agreement with a nonprofit organization that
10694 31 is:
10795 32 (A) an Indiana based nonprofit organization;
10896 33 (B) recognized as tax exempt under Section 501(c)(3) of the
10997 34 Internal Revenue Code of 1986; and
11098 35 (C) capable of fulfilling the statewide responsibilities under
11199 36 this chapter;
112100 37 to fulfill the statewide responsibilities under this chapter.
113101 38 (b) The statewide nonprofit organization shall do the following:
114102 39 (1) Manage the daily operations of the program.
115103 40 (2) Subject to the approval of the state library and budget
116104 41 agency, enter into an agreement with the national early
117105 42 childhood literacy foundation designated under section 4 of

119107 1 this chapter to directly mail reading selections to eligible
120108 2 children enrolled in the program at no cost to the family.
121109 3 (3) Establish nonprofit countywide or multi-county affiliate
122110 4 programs in all ninety-two (92) counties capable of fulfilling
123111 5 the responsibilities under this chapter.
124112 6 (4) Provide nonprofit countywide or multi-county affiliate
125113 7 programs assistance to:
126114 8 (A) promote the program;
127115 9 (B) enroll eligible children;
128116 10 (C) establish local or regional partnerships in support of
129117 11 the program;
130118 12 (D) secure adequate financial support; and
131119 13 (E) evaluate program performance.
132120 14 (5) Establish statewide partnerships to implement the
133121 15 program, including solicitation of public or private donations
134122 16 to:
135123 17 (A) the fund under section 5 of this chapter; or
136124 18 (B) the nonprofit countywide or multi-county affiliate
137125 19 programs.
138126 20 (6) Develop and implement the following:
139127 21 (A) A statewide marketing and communications plan to
140128 22 raise awareness of the program and increase the
141129 23 enrollment of eligible children through the nonprofit
142130 24 countywide and multi-county affiliate programs. The
143131 25 marketing and communications plan must include
144132 26 promotional materials and maintenance of a statewide
145133 27 website.
146134 28 (B) A program performance metric to measure the
147135 29 program's impact on early childhood literacy, reading, and
148136 30 kindergarten readiness in statewide, demographic, and
149137 31 geographic terms.
150138 32 (7) To the extent possible, provide reading selections in braille
151139 33 or audio format to eligible children enrolled in the program
152140 34 who are blind or visually impaired.
153141 35 Sec. 4. The state library shall designate a national early
154142 36 childhood literacy foundation capable of fulfilling the
155143 37 responsibilities under this chapter.
156144 38 Sec. 5. (a) The Indiana imagination library fund is established
157145 39 to support early childhood literacy efforts through funding the
158146 40 statewide nonprofit organization.
159147 41 (b) The state library shall administer the fund.
160148 42 (c) The fund consists of the following:

162150 1 (1) Appropriations made by the general assembly.
163151 2 (2) Donations, whether public or private, made to the state to
164152 3 achieve the purposes of the fund.
165153 4 (3) Interest as provided under subsection (e).
166154 5 (d) Expenses of administering the fund shall be paid from
167155 6 money in the fund. The state library may not allocate more than
168156 7 fifteen percent (15%) of the funds for administrative and support
169157 8 expenses by the statewide nonprofit organization.
170158 9 (e) The treasurer of state shall invest the money in the fund not
171159 10 currently needed to meet the obligations of the fund in the same
172160 11 manner as other public funds may be invested. Interest that
173161 12 accrues from these investments shall be deposited in the fund.
174162 13 (f) Money in the fund does not revert to the state general fund.
175163 14 Sec. 6. (a) Subject to the amount available in the fund, the
176164 15 statewide nonprofit organization shall provide a monthly payment
177165 16 to the national early childhood literacy foundation that equals fifty
178166 17 percent (50%) of the cost to directly mail reading selections to
179167 18 eligible children enrolled in the program.
180168 19 (b) Each nonprofit countywide or multi-county affiliate
181169 20 program shall provide a monthly payment to the program that
182170 21 equals the remaining cost after the payment under subsection (a)
183171 22 to directly mail reading selections to eligible children enrolled in
184172 23 the program residing in the affiliate program's county or counties
185173 24 of responsibility. The program shall provide this amount to the
186174 25 national early childhood literacy foundation.
187175 26 (c) Subject to the approval of the state library, the statewide
188176 27 nonprofit organization may waive, on a case by case emergency
189177 28 basis, the payment for a particular month described under
190178 29 subsection (b), in full or in part, to prevent the interruption of
191179 30 providing a reading selection to an eligible child enrolled in the
192180 31 program. The program must assume the full or partial cost of that
193181 32 particular waived payment.
194182 33 Sec. 7. The state library, in consultation with the department of
195183 34 education and the division of family resources established by
196184 35 IC 12-13-1-1, may establish a statewide advisory board to advise
197185 36 and support the program's development, expansion, accessibility,
198186 37 sustainment, and improvement.
199187 38 Sec. 8. (a) Beginning November 1, 2023, and not later than
200188 39 November 1 of each year thereafter, the state library, in
201189 40 conjunction with the statewide nonprofit organization, shall
202190 41 conduct a review of the program and submit a report to the
203191 42 governor and, in an electronic format under IC 5-14-6, to the

205193 1 interim study committee on education established by IC 2-5-1.3-4.
206194 2 (b) The report must include the following:
207195 3 (1) The program's revenue and expenditures during the
208196 4 previous state fiscal year.
209197 5 (2) The number of nonprofit countywide and multi-county
210198 6 affiliate programs established by the program.
211199 7 (3) The number of eligible children enrolled in the program
212200 8 statewide and in each affiliate program by age.
213201 9 (4) The estimated number of eligible children not enrolled in
214202 10 the program statewide and in each county by age.
215203 11 (5) The number of reading selections mailed to eligible
216204 12 children enrolled in the program statewide and in each
217205 13 affiliate program by age.
218206 14 (6) Information concerning affiliate program revenue and
219207 15 expenditures.
220208 16 (7) Program performance metrics concerning the literacy
221209 17 development, personal and family reading activities, and
222210 18 school readiness of program enrollees in statewide,
223211 19 demographic, and geographic terms, including parental and
224212 20 family satisfaction with the program.
225213 21 (8) A longitudinal data analysis of school readiness and
226214 22 educational outcomes of eligible enrolled children.
227215 23 (c) The department of education and the family and social
228216 24 services administration shall provide the state library with
229217 25 information necessary to comply with this section.
