78 | 66 | | 3 Sec. 1. The following definitions apply throughout this chapter: |

79 | 67 | | 4 (1) "Eligible child" means a child who resides in Indiana and |
---|
80 | 68 | | 5 is not more than five (5) years of age. |
---|
81 | 69 | | 6 (2) "National early childhood literacy foundation" means a |
---|
82 | 70 | | 7 national nonprofit foundation that exists for the sole purpose |
---|
83 | 71 | | 8 of working with local nonprofit entities to identify eligible |
---|
84 | 72 | | 9 children and directly mail a reading selection each month to |
---|
85 | 73 | | 10 those children enrolled in the program at no cost to the |
---|
86 | 74 | | 11 family. |
---|
87 | 75 | | 12 (3) "Program" means the Indiana imagination library |
---|
88 | 76 | | 13 program established by section 2 of this chapter. |
---|
89 | 77 | | 14 (4) "Reading selection" means an age appropriate, high |
---|
90 | 78 | | 15 quality book mailed each month to an eligible child enrolled |
---|
91 | 79 | | 16 in the program. |
---|
92 | 80 | | 17 (5) "Statewide nonprofit organization" means the nonprofit |
---|
93 | 81 | | 18 organization described in section 3(a) of this chapter. |
---|
94 | 82 | | 19 Sec. 2. (a) The Indiana imagination library program is |
---|
95 | 83 | | 20 established to improve early childhood literacy by encouraging the |
---|
96 | 84 | | 21 children of Indiana to read regularly, engage in shared family |
---|
97 | 85 | | 22 reading, and build home libraries by providing monthly reading |
---|
98 | 86 | | 23 selections at no cost to the family of an eligible child. |
---|
99 | 87 | | 24 (b) The state library shall administer the program. |
---|
100 | 88 | | 25 Sec. 3. (a) The state library, in consultation with the department |
---|
101 | 89 | | 26 of education and the family and social services administration, |
---|
102 | 90 | | 27 shall: |
---|
103 | 91 | | 28 (1) establish a nonprofit organization that is tax exempt under |
---|
104 | 92 | | 29 Section 501(c)(3) of the Internal Revenue Code of 1986; or |
---|
105 | 93 | | 30 (2) enter into an agreement with a nonprofit organization that |
---|
106 | 94 | | 31 is: |
---|
107 | 95 | | 32 (A) an Indiana based nonprofit organization; |
---|
108 | 96 | | 33 (B) recognized as tax exempt under Section 501(c)(3) of the |
---|
109 | 97 | | 34 Internal Revenue Code of 1986; and |
---|
110 | 98 | | 35 (C) capable of fulfilling the statewide responsibilities under |
---|
111 | 99 | | 36 this chapter; |
---|
112 | 100 | | 37 to fulfill the statewide responsibilities under this chapter. |
---|
113 | 101 | | 38 (b) The statewide nonprofit organization shall do the following: |
---|
114 | 102 | | 39 (1) Manage the daily operations of the program. |
---|
115 | 103 | | 40 (2) Subject to the approval of the state library and budget |
---|
116 | 104 | | 41 agency, enter into an agreement with the national early |
---|
117 | 105 | | 42 childhood literacy foundation designated under section 4 of |
---|
119 | 107 | | 1 this chapter to directly mail reading selections to eligible |
---|
120 | 108 | | 2 children enrolled in the program at no cost to the family. |
---|
121 | 109 | | 3 (3) Establish nonprofit countywide or multi-county affiliate |
---|
122 | 110 | | 4 programs in all ninety-two (92) counties capable of fulfilling |
---|
123 | 111 | | 5 the responsibilities under this chapter. |
---|
124 | 112 | | 6 (4) Provide nonprofit countywide or multi-county affiliate |
---|
125 | 113 | | 7 programs assistance to: |
---|
126 | 114 | | 8 (A) promote the program; |
---|
127 | 115 | | 9 (B) enroll eligible children; |
---|
128 | 116 | | 10 (C) establish local or regional partnerships in support of |
---|
129 | 117 | | 11 the program; |
---|
130 | 118 | | 12 (D) secure adequate financial support; and |
---|
131 | 119 | | 13 (E) evaluate program performance. |
---|
132 | 120 | | 14 (5) Establish statewide partnerships to implement the |
---|
133 | 121 | | 15 program, including solicitation of public or private donations |
---|
134 | 122 | | 16 to: |
---|
135 | 123 | | 17 (A) the fund under section 5 of this chapter; or |
---|
136 | 124 | | 18 (B) the nonprofit countywide or multi-county affiliate |
---|
137 | 125 | | 19 programs. |
---|
138 | 126 | | 20 (6) Develop and implement the following: |
---|
139 | 127 | | 21 (A) A statewide marketing and communications plan to |
---|
140 | 128 | | 22 raise awareness of the program and increase the |
---|
141 | 129 | | 23 enrollment of eligible children through the nonprofit |
---|
142 | 130 | | 24 countywide and multi-county affiliate programs. The |
---|
143 | 131 | | 25 marketing and communications plan must include |
---|
144 | 132 | | 26 promotional materials and maintenance of a statewide |
---|
145 | 133 | | 27 website. |
---|
146 | 134 | | 28 (B) A program performance metric to measure the |
---|
147 | 135 | | 29 program's impact on early childhood literacy, reading, and |
---|
148 | 136 | | 30 kindergarten readiness in statewide, demographic, and |
---|
149 | 137 | | 31 geographic terms. |
---|
150 | 138 | | 32 (7) To the extent possible, provide reading selections in braille |
---|
151 | 139 | | 33 or audio format to eligible children enrolled in the program |
---|
152 | 140 | | 34 who are blind or visually impaired. |
---|
153 | 141 | | 35 Sec. 4. The state library shall designate a national early |
---|
154 | 142 | | 36 childhood literacy foundation capable of fulfilling the |
---|
155 | 143 | | 37 responsibilities under this chapter. |
---|
156 | 144 | | 38 Sec. 5. (a) The Indiana imagination library fund is established |
---|
157 | 145 | | 39 to support early childhood literacy efforts through funding the |
---|
158 | 146 | | 40 statewide nonprofit organization. |
---|
159 | 147 | | 41 (b) The state library shall administer the fund. |
---|
160 | 148 | | 42 (c) The fund consists of the following: |
---|
162 | 150 | | 1 (1) Appropriations made by the general assembly. |
---|
163 | 151 | | 2 (2) Donations, whether public or private, made to the state to |
---|
164 | 152 | | 3 achieve the purposes of the fund. |
---|
165 | 153 | | 4 (3) Interest as provided under subsection (e). |
---|
166 | 154 | | 5 (d) Expenses of administering the fund shall be paid from |
---|
167 | 155 | | 6 money in the fund. The state library may not allocate more than |
---|
168 | 156 | | 7 fifteen percent (15%) of the funds for administrative and support |
---|
169 | 157 | | 8 expenses by the statewide nonprofit organization. |
---|
170 | 158 | | 9 (e) The treasurer of state shall invest the money in the fund not |
---|
171 | 159 | | 10 currently needed to meet the obligations of the fund in the same |
---|
172 | 160 | | 11 manner as other public funds may be invested. Interest that |
---|
173 | 161 | | 12 accrues from these investments shall be deposited in the fund. |
---|
174 | 162 | | 13 (f) Money in the fund does not revert to the state general fund. |
---|
175 | 163 | | 14 Sec. 6. (a) Subject to the amount available in the fund, the |
---|
176 | 164 | | 15 statewide nonprofit organization shall provide a monthly payment |
---|
177 | 165 | | 16 to the national early childhood literacy foundation that equals fifty |
---|
178 | 166 | | 17 percent (50%) of the cost to directly mail reading selections to |
---|
179 | 167 | | 18 eligible children enrolled in the program. |
---|
180 | 168 | | 19 (b) Each nonprofit countywide or multi-county affiliate |
---|
181 | 169 | | 20 program shall provide a monthly payment to the program that |
---|
182 | 170 | | 21 equals the remaining cost after the payment under subsection (a) |
---|
183 | 171 | | 22 to directly mail reading selections to eligible children enrolled in |
---|
184 | 172 | | 23 the program residing in the affiliate program's county or counties |
---|
185 | 173 | | 24 of responsibility. The program shall provide this amount to the |
---|
186 | 174 | | 25 national early childhood literacy foundation. |
---|
187 | 175 | | 26 (c) Subject to the approval of the state library, the statewide |
---|
188 | 176 | | 27 nonprofit organization may waive, on a case by case emergency |
---|
189 | 177 | | 28 basis, the payment for a particular month described under |
---|
190 | 178 | | 29 subsection (b), in full or in part, to prevent the interruption of |
---|
191 | 179 | | 30 providing a reading selection to an eligible child enrolled in the |
---|
192 | 180 | | 31 program. The program must assume the full or partial cost of that |
---|
193 | 181 | | 32 particular waived payment. |
---|
194 | 182 | | 33 Sec. 7. The state library, in consultation with the department of |
---|
195 | 183 | | 34 education and the division of family resources established by |
---|
196 | 184 | | 35 IC 12-13-1-1, may establish a statewide advisory board to advise |
---|
197 | 185 | | 36 and support the program's development, expansion, accessibility, |
---|
198 | 186 | | 37 sustainment, and improvement. |
---|
199 | 187 | | 38 Sec. 8. (a) Beginning November 1, 2023, and not later than |
---|
200 | 188 | | 39 November 1 of each year thereafter, the state library, in |
---|
201 | 189 | | 40 conjunction with the statewide nonprofit organization, shall |
---|
202 | 190 | | 41 conduct a review of the program and submit a report to the |
---|
203 | 191 | | 42 governor and, in an electronic format under IC 5-14-6, to the |
---|
205 | 193 | | 1 interim study committee on education established by IC 2-5-1.3-4. |
---|
206 | 194 | | 2 (b) The report must include the following: |
---|
207 | 195 | | 3 (1) The program's revenue and expenditures during the |
---|
208 | 196 | | 4 previous state fiscal year. |
---|
209 | 197 | | 5 (2) The number of nonprofit countywide and multi-county |
---|
210 | 198 | | 6 affiliate programs established by the program. |
---|
211 | 199 | | 7 (3) The number of eligible children enrolled in the program |
---|
212 | 200 | | 8 statewide and in each affiliate program by age. |
---|
213 | 201 | | 9 (4) The estimated number of eligible children not enrolled in |
---|
214 | 202 | | 10 the program statewide and in each county by age. |
---|
215 | 203 | | 11 (5) The number of reading selections mailed to eligible |
---|
216 | 204 | | 12 children enrolled in the program statewide and in each |
---|
217 | 205 | | 13 affiliate program by age. |
---|
218 | 206 | | 14 (6) Information concerning affiliate program revenue and |
---|
219 | 207 | | 15 expenditures. |
---|
220 | 208 | | 16 (7) Program performance metrics concerning the literacy |
---|
221 | 209 | | 17 development, personal and family reading activities, and |
---|
222 | 210 | | 18 school readiness of program enrollees in statewide, |
---|
223 | 211 | | 19 demographic, and geographic terms, including parental and |
---|
224 | 212 | | 20 family satisfaction with the program. |
---|
225 | 213 | | 21 (8) A longitudinal data analysis of school readiness and |
---|
226 | 214 | | 22 educational outcomes of eligible enrolled children. |
---|
227 | 215 | | 23 (c) The department of education and the family and social |
---|
228 | 216 | | 24 services administration shall provide the state library with |
---|
229 | 217 | | 25 information necessary to comply with this section. |
