36 | 36 | | 3 [EFFECTIVE JULY 1, 2023]: Sec. 4. (a) For purposes of this section, |

37 | 37 | | 4 the term "county auditor" includes a person who: |
---|
38 | 38 | | 5 (1) is the auditor of a county that is a member of a multicounty |
---|
39 | 39 | | 6 public defender's office; and |
---|
40 | 40 | | 7 (2) is responsible for the receipt, disbursement, and accounting of |
---|
41 | 41 | | 8 all monies distributed to the multicounty public defender's office. |

42 | 42 | | 9 (b) A county auditor may submit on a quarterly basis a certified |
---|
43 | 43 | | 10 request to the public defender commission for reimbursement from the |
---|
44 | 44 | | 11 public defense fund for an amount equal to fifty sixty percent (50%) |

64 | 64 | | 13 (b) Except as provided under section 6 of this chapter, upon |

66 | 66 | | 15 commission that the request is in compliance with the guidelines and |

67 | 67 | | 16 standards set by the commission, the commission shall quarterly |
---|
68 | 68 | | 17 authorize an amount of reimbursement due the county or multicounty |
---|
69 | 69 | | 18 public defender's office |
---|
70 | 70 | | 19 (1) that is equal to fifty sixty percent (50%) (60%) of the county's |
---|
71 | 71 | | 20 or multicounty public defender's office's certified expenditures for |

72 | 72 | | 21 indigent defense services provided for a defendant against whom |

81 | 81 | | 30 (c) Upon receiving certification from the commission, the auditor of |
---|
82 | 82 | | 31 state shall issue a warrant to the treasurer of state for disbursement to |
---|
83 | 83 | | 32 the county or multicounty public defender's office of the amount |
---|
84 | 84 | | 33 certified. |
