1355 Be it enacted by the General Assembly of the State of Indiana:
14-SECTION 1. IC 21-12-16-1.5 IS ADDED TO THE INDIANA

57+2 CODE AS A NEW SECTION TO READ AS FOLLOWS
58+3 [EFFECTIVE JULY 1, 2024]: Sec. 1.5. As used in this chapter,
59+4 "teacher" refers to a person who is employed by a public school or
60+5 an eligible school (as defined in IC 20-51-1-4.7) as a full-time
61+6 classroom teacher (as defined in IC 20-18-2-22(d)) whose primary
62+7 responsibility is the instruction of students.
63+8 SECTION 2. IC 21-12-16-5, AS AMENDED BY P.L.161-2023,
64+9 SECTION 1, AND AS AMENDED BY P.L.242-2023, SECTION 1,
65+10 AND AS AMENDED BY THE TECHNICAL CORRECTIONS BILL
66+11 OF THE 2024 GENERAL ASSEMBLY, IS CORRECTED AND
67+12 AMENDED TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2024]:
68+13 Sec. 5. (a) An applicant who is enrolled in an accredited postsecondary
69+14 educational institution after June 30, 2017, may qualify for a
70+15 scholarship under this chapter. section. To qualify for a scholarship, an
71+16 applicant must:
72+17 (1) apply for a scholarship on a form supplied by the commission;

74+1 (2) except as provided in subsection (b), have graduated from an
75+2 Indiana nonaccredited nonpublic or state accredited high school
76+3 accredited under IC 20-31-4.1 and:
77+4 (A) graduated in the highest twenty percent (20%) of students
78+5 in the applicant's high school graduating class;
79+6 (B) received a score in the top twentieth percentile on the SAT
80+7 or ACT examination; or
81+8 (C) achieved a cumulative grade point average upon
82+9 graduation of at least 3.5 3.0 on a 4.0 grading scale (or its
83+10 equivalent if another grading scale is used) for courses taken
84+11 during grades 9, 10, 11, and 12;
85+12 (3) have participated in school activities and community service
86+13 activities during high school;
87+14 (4) have applied to and been accepted for enrollment in an
88+15 accredited postsecondary educational institution approved by the
89+16 commission under section 10 of this chapter;
90+17 (5) agree in writing to:
91+18 (A) obtain a license to teach under IC 20-28-5; and
92+19 (B) teach be employed as a teacher for at least five (5)
93+20 consecutive years in a public school or an eligible school (as
94+21 defined in IC 20-51-1-4.7) in Indiana after graduating with a
95+22 baccalaureate degree from the accredited postsecondary
96+23 educational institution described in subdivision (4); and
97+24 (6) meet any other criteria established by the commission.
98+25 (b) A student who graduates from a nonaccredited nonpublic school
99+26 must meet the requirement described in subsection (a)(2)(B) in order
100+27 to meet the eligibility requirement described in subsection (a)(2).
101+28 SECTION 3. IC 21-12-16-5.5, AS ADDED BY P.L.242-2023,
102+29 SECTION 2, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
103+30 JULY 1, 2024]: Sec. 5.5. (a) An applicant who is enrolled in a
104+31 transition to teaching program after June 30, 2023, may qualify for a
105+32 scholarship under section 8.5 of this chapter.
106+33 (b) This subsection applies only to an applicant enrolled in a
107+34 transition to teaching program after June 30, 2023, and before July
108+35 1, 2024. To qualify for a scholarship, an applicant must:
109+36 (1) apply for a scholarship on a form supplied by the commission;
110+37 (2) possess a baccalaureate degree from an accredited
111+38 postsecondary four (4) year institution;
112+39 (3) have enrolled in a transition to teaching program described in
113+40 IC 20-28-4;
114+41 (4) agree in writing to:
115+42 (A) complete a transition to teaching program described in
116+EH 1042—LS 6221/DI 143 3
117+1 IC 20-28-4 and obtain an initial practitioner license under
118+2 IC 20-28; and
119+3 (B) teach for at least five (5) consecutive years in a public
120+4 school or an eligible school (as defined in IC 20-51-1-4.7) in
121+5 Indiana after obtaining the initial practitioner license under
122+6 IC 20-28-4-6; and
123+7 (5) meet any other criteria established by the commission.
124+8 (c) This subsection applies only to an applicant that initially
125+9 enrolls in a transition to teaching program after June 30, 2024. To
126+10 qualify for a scholarship, an applicant must:
127+11 (1) apply for a scholarship on a form supplied by the
128+12 commission;
129+13 (2) possess a baccalaureate degree from an accredited
130+14 postsecondary four (4) year institution;
131+15 (3) have enrolled in a transition to teaching program
132+16 described in IC 20-28-4;
133+17 (4) agree in writing to:
134+18 (A) complete a transition to teaching program described in
135+19 IC 20-28-4 and obtain an initial practitioner license under
136+20 IC 20-28; and
137+21 (B) teach for at least five (5) consecutive years in a public
138+22 school or an eligible school (as defined in IC 20-51-1-4.7) in
139+23 Indiana after obtaining the initial practitioner license
140+24 under IC 20-28-4-6;
141+25 (5) except as otherwise provided in section 8.5(c) of this
142+26 chapter, be a member of a household with an annual income
143+27 of one hundred thousand dollars ($100,000) or less; and
144+28 (6) meet any other criteria established by the commission.
145+29 SECTION 4. IC 21-12-16-6, AS AMENDED BY P.L.63-2021,
146+30 SECTION 3, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
147+31 JULY 1, 2024]: Sec. 6. (a) This section does not apply to a
148+32 scholarship awarded under section 8.5 of this chapter.
149+33 (b) The commission shall consider each application and determine
150+34 the eligibility of the applicant for the scholarship. The commission
151+35 shall give priority to recent high school graduates, students pursuing
152+36 teacher shortage areas as described in 34 CFR 682.210(q)(6), and
153+37 students showing significant financial need when selecting applicants.
154+38 (b) (c) The commission shall also give priority to an individual who
155+39 is a member of a household with an annual income of not more than the
156+40 amount required for the individual to qualify for the free or reduced
157+41 price lunch program under the national school lunch program as
158+42 determined for the immediately preceding taxable year for the

160+1 household for which the individual was claimed as a dependent.
161+2 SECTION 5. IC 21-12-16-7, AS AMENDED BY P.L.242-2023,
162+3 SECTION 3, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
163+4 JULY 1, 2024]: Sec. 7. Before receiving a scholarship under this
164+5 chapter, the applicant must enter into a contract with the commission
165+6 agreeing to:
166+7 (1) the terms and conditions described in section 5(a)(5), or
167+8 5.5(4), 5.5(b)(4), or 5.5(c)(4) of this chapter, as applicable; and
168+9 (2) any other terms and conditions established by the commission.
169+10 SECTION 6. IC 21-12-16-8.5, AS ADDED BY P.L.242-2023,
170+11 SECTION 5, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
171+12 JULY 1, 2024]: Sec. 8.5. (a) Subject to subsection (b), if an applicant
172+13 meets the requirements under section 5.5 of this chapter, the
173+14 commission may award a one (1) time nonrenewable scholarship to the
174+15 applicant in an amount of up to ten thousand dollars ($10,000) for
175+16 transition to teaching program and initial practitioner licensure costs
176+17 under IC 20-28-4.
177+18 (b) The total annual amount of scholarships awarded by the
178+19 commission under this section may not exceed one million dollars
179+20 ($1,000,000). If the total amount of scholarships exceeds the limit
180+21 under this subsection, the commission shall reduce the scholarships
181+22 awarded under subsection (a) in a manner prescribed by the
182+23 commission.
183+24 (c) Notwithstanding subsection (b), any balance in the next
184+25 generation Hoosier educators scholarship fund established by
185+26 section 3 of this chapter remaining after the commission has
186+27 awarded next generation Hoosier educators scholarships for a
187+28 fiscal year may be used to fund additional transition to teaching
188+29 scholarships as described in section 5.5 of this chapter. The
189+30 commission shall give priority for scholarships awarded under this
190+31 subsection to an applicant who is a member of a household with an
191+32 annual income of one hundred thousand dollars ($100,000) or less
192+33 in accordance with section 5.5(c)(5) of this chapter. However, if
193+34 there is a remaining balance in the next generation Hoosier
194+35 educators scholarship fund established by section 3 of this chapter
195+36 after awarding scholarships to individuals who meet the income
196+37 requirement described in section 5.5(c)(5) of this chapter, the
197+38 commission may award transition to teaching scholarships to
198+39 applicants who are members of a household with an annual income
199+40 that exceeds one hundred thousand dollars ($100,000).
200+41 SECTION 7. IC 21-12-16-12, AS AMENDED BY P.L.242-2023,
201+42 SECTION 8, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE

203+1 JULY 1, 2024]: Sec. 12. (a) Except as provided in subsections (b) and
204+2 (c), if an individual:
205+3 (1) receives a scholarship under section 5 or 5.5 of this chapter;
206+4 and
207+5 (2) fails to teach in a public school or an eligible school (as
208+6 defined in IC 20-51-1-4.7) in Indiana for at least five (5)
209+7 consecutive years as described in section 5(a)(5), or 5.5(4)
210+8 5.5(b)(4), or 5.5(c)(4) of this chapter, as applicable;
211+9 the individual shall repay the total amount of the scholarship awarded
212+10 to the individual under this chapter in a timely fashion. The total
213+11 amount that an individual is required to repay shall be reduced by
214+12 twenty percent (20%), as determined by the commission, for each
215+13 consecutive year the individual teaches at a public school or eligible
216+14 school (as defined in IC 20-51-1-4.7).
217+15 (b) The commission may extend the length of time in which an
218+16 individual must complete the requirements of an agreement described
219+17 in section 5(a)(5), or 5.5(4) 5.5(b)(4), or 5.5(c)(4) of this chapter if the
220+18 individual submits a petition to the commission in a manner prescribed
221+19 by the commission and the commission makes a determination that
222+20 extenuating circumstances, as determined by the commission,
223+21 prevented the individual from timely meeting the requirements
224+22 described in section 5(a)(5), or 5.5(4) 5.5(b)(4), or 5.5(c)(4) of this
225+23 chapter, as applicable.
226+24 (c) The commission may waive repayment under subsection (a) if
227+25 the individual has been declared to be totally and permanently disabled
228+26 under 34 CFR 685.213.
229+27 (d) The commission may enter into an agreement with the
230+28 department of state revenue established by IC 6-8.1-2-1 or another third
231+29 party vendor to assist in the enforcement of subsection (a) and section
232+30 11 of this chapter.
233+31 SECTION 8. IC 21-12-16.5-1.5 IS ADDED TO THE INDIANA
234+32 CODE AS A NEW SECTION TO READ AS FOLLOWS
235+33 [EFFECTIVE JULY 1, 2024]: Sec. 1.5. As used in this chapter,
236+34 "teacher" refers to a person who is employed by a public school or
237+35 an eligible school (as defined in IC 20-51-1-4.7) as a full-time

240+38 SECTION 9. IC 21-12-16.5-5, AS ADDED BY P.L.161-2023,

274+29 must meet the requirement described in subsection (a)(2)(B) in order
275+30 to meet the eligibility requirement described in subsection (a)(2).

29426 applicant must:
30427 (1) apply for a scholarship on a form supplied by the commission;
31428 (2) except as provided in subsection (b), have graduated from an
32429 Indiana nonaccredited nonpublic or state accredited high school
33430 accredited under IC 20-31-4.1 and:
34431 (A) graduated in the highest twenty percent (20%) of students

35433 in the applicant's high school graduating class;
36434 (B) received a score in the top twentieth percentile on the SAT
37-HEA 1042 — Concur 2
38435 or ACT examination; or
39436 (C) achieved a cumulative grade point average upon
40437 graduation of at least 3.5 3.0 on a 4.0 grading scale (or its
41438 equivalent if another grading scale is used) for courses taken
42439 during grades 9, 10, 11, and 12;
43440 (3) have participated in school activities and community service
44441 activities during high school;
45442 (4) have applied to and been accepted for enrollment in an
46443 accredited postsecondary educational institution approved by the
47444 commission under section 10 of this chapter;
48445 (5) agree in writing to:
49446 (A) obtain a license to teach under IC 20-28-5; and
50447 (B) teach be employed as a teacher for at least five (5)
51448 consecutive years in a public school or an eligible school (as
52449 defined in IC 20-51-1-4.7) in Indiana after graduating with a
53450 baccalaureate degree from the accredited postsecondary
54451 educational institution described in subdivision (4); and
55452 (6) meet any other criteria established by the commission.
56453 (b) A student who graduates from a nonaccredited nonpublic school
57454 must meet the requirement described in subsection (a)(2)(B) in order
58-to meet the eligibility requirement described in subsection (a)(2).
59-SECTION 3. IC 21-12-16-5.5, AS ADDED BY P.L.242-2023,
60-SECTION 2, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
61-JULY 1, 2024]: Sec. 5.5. (a) An applicant who is enrolled in a
62-transition to teaching program after June 30, 2023, may qualify for a
63-scholarship under section 8.5 of this chapter.
64-(b) This subsection applies only to an applicant enrolled in a
65-transition to teaching program after June 30, 2023, and before July
66-1, 2024. To qualify for a scholarship, an applicant must:
67-(1) apply for a scholarship on a form supplied by the commission;
68-(2) possess a baccalaureate degree from an accredited
69-postsecondary four (4) year institution;
70-(3) have enrolled in a transition to teaching program described in
71-IC 20-28-4;
72-(4) agree in writing to:
73-(A) complete a transition to teaching program described in
74-IC 20-28-4 and obtain an initial practitioner license under
75-IC 20-28; and
76-(B) teach for at least five (5) consecutive years in a public
77-school or an eligible school (as defined in IC 20-51-1-4.7) in
78-Indiana after obtaining the initial practitioner license under
79-IC 20-28-4-6; and

81-(5) meet any other criteria established by the commission.
82-(c) This subsection applies only to an applicant that initially
83-enrolls in a transition to teaching program after June 30, 2024. To
84-qualify for a scholarship, an applicant must:
85-(1) apply for a scholarship on a form supplied by the
86-commission;
87-(2) possess a baccalaureate degree from an accredited
88-postsecondary four (4) year institution;
89-(3) have enrolled in a transition to teaching program
90-described in IC 20-28-4;
91-(4) agree in writing to:
92-(A) complete a transition to teaching program described in
93-IC 20-28-4 and obtain an initial practitioner license under
94-IC 20-28; and
95-(B) teach for at least five (5) consecutive years in a public
96-school or an eligible school (as defined in IC 20-51-1-4.7) in
97-Indiana after obtaining the initial practitioner license
98-under IC 20-28-4-6;
99-(5) except as otherwise provided in section 8.5(c) of this
100-chapter, be a member of a household with an annual income
101-of one hundred thousand dollars ($100,000) or less; and
102-(6) meet any other criteria established by the commission.
103-SECTION 4. IC 21-12-16-6, AS AMENDED BY P.L.63-2021,
104-SECTION 3, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
105-JULY 1, 2024]: Sec. 6. (a) This section does not apply to a
106-scholarship awarded under section 8.5 of this chapter.
107-(b) The commission shall consider each application and determine
108-the eligibility of the applicant for the scholarship. The commission
109-shall give priority to recent high school graduates, students pursuing
110-teacher shortage areas as described in 34 CFR 682.210(q)(6), and
111-students showing significant financial need when selecting applicants.
112-(b) (c) The commission shall also give priority to an individual who
113-is a member of a household with an annual income of not more than the
114-amount required for the individual to qualify for the free or reduced
115-price lunch program under the national school lunch program as
116-determined for the immediately preceding taxable year for the
117-household for which the individual was claimed as a dependent.
118-SECTION 5. IC 21-12-16-7, AS AMENDED BY P.L.242-2023,
119-SECTION 3, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
120-JULY 1, 2024]: Sec. 7. Before receiving a scholarship under this
121-chapter, the applicant must enter into a contract with the commission
122-agreeing to:

124-(1) the terms and conditions described in section 5(a)(5), or
125-5.5(4), 5.5(b)(4), or 5.5(c)(4) of this chapter, as applicable; and
126-(2) any other terms and conditions established by the commission.
127-SECTION 6. IC 21-12-16-8.5, AS ADDED BY P.L.242-2023,
128-SECTION 5, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
129-JULY 1, 2024]: Sec. 8.5. (a) Subject to subsection (b), if an applicant
130-meets the requirements under section 5.5 of this chapter, the
131-commission may award a one (1) time nonrenewable scholarship to the
132-applicant in an amount of up to ten thousand dollars ($10,000) for
133-transition to teaching program and initial practitioner licensure costs
134-under IC 20-28-4.
135-(b) The total annual amount of scholarships awarded by the
136-commission under this section may not exceed one million dollars
137-($1,000,000). If the total amount of scholarships exceeds the limit
138-under this subsection, the commission shall reduce the scholarships
139-awarded under subsection (a) in a manner prescribed by the
140-commission.
141-(c) Notwithstanding subsection (b), any balance in the next
142-generation Hoosier educators scholarship fund established by
143-section 3 of this chapter remaining after the commission has
144-awarded next generation Hoosier educators scholarships for a
145-fiscal year may be used to fund additional transition to teaching
146-scholarships as described in section 5.5 of this chapter. The
147-commission shall give priority for scholarships awarded under this
148-subsection to an applicant who is a member of a household with an
149-annual income of one hundred thousand dollars ($100,000) or less
150-in accordance with section 5.5(c)(5) of this chapter. However, if
151-there is a remaining balance in the next generation Hoosier
152-educators scholarship fund established by section 3 of this chapter
153-after awarding scholarships to individuals who meet the income
154-requirement described in section 5.5(c)(5) of this chapter, the
155-commission may award transition to teaching scholarships to
156-applicants who are members of a household with an annual income
157-that exceeds one hundred thousand dollars ($100,000).
158-SECTION 7. IC 21-12-16-12, AS AMENDED BY P.L.242-2023,
159-SECTION 8, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
160-JULY 1, 2024]: Sec. 12. (a) Except as provided in subsections (b) and
161-(c), if an individual:
162-(1) receives a scholarship under section 5 or 5.5 of this chapter;
163-and
164-(2) fails to teach in a public school or an eligible school (as
165-defined in IC 20-51-1-4.7) in Indiana for at least five (5)

167-consecutive years as described in section 5(a)(5), or 5.5(4)
168-5.5(b)(4), or 5.5(c)(4) of this chapter, as applicable;
169-the individual shall repay the total amount of the scholarship awarded
170-to the individual under this chapter in a timely fashion. The total
171-amount that an individual is required to repay shall be reduced by
172-twenty percent (20%), as determined by the commission, for each
173-consecutive year the individual teaches at a public school or eligible
174-school (as defined in IC 20-51-1-4.7).
175-(b) The commission may extend the length of time in which an
176-individual must complete the requirements of an agreement described
177-in section 5(a)(5), or 5.5(4) 5.5(b)(4), or 5.5(c)(4) of this chapter if the
178-individual submits a petition to the commission in a manner prescribed
179-by the commission and the commission makes a determination that
180-extenuating circumstances, as determined by the commission,
181-prevented the individual from timely meeting the requirements
182-described in section 5(a)(5), or 5.5(4) 5.5(b)(4), or 5.5(c)(4) of this
183-chapter, as applicable.
184-(c) The commission may waive repayment under subsection (a) if
185-the individual has been declared to be totally and permanently disabled
186-under 34 CFR 685.213.
187-(d) The commission may enter into an agreement with the
188-department of state revenue established by IC 6-8.1-2-1 or another third
189-party vendor to assist in the enforcement of subsection (a) and section
190-11 of this chapter.
