9	9	greater than 26,000 pounds from 65 miles per hour to 70 miles per hour
10	10	when the vehicle is operated on a highway that is: (1) on the national
11	11	system of interstate and defense highways located outside an urbanized
12	12	area with a population of at least 50,000; or (2) the responsibility of the
13	13	Indiana finance authority. Reconciles the conflicting provisions
14	14	regarding the maximum speed limit in an alley.

30	30	A BILL FOR AN ACT to amend the Indiana Code concerning
31	31	motor vehicles.
32	32	Be it enacted by the General Assembly of the State of Indiana:
33	33	1 SECTION 1. IC 9-21-5-2, AS AMENDED BY P.L.189-2018,
34	34	2 SECTION 104, IS AMENDED TO READ AS FOLLOWS
35	35	3 [EFFECTIVE JULY 1, 2024]: Sec. 2. (a) Except when a special hazard
36	36	4 exists that requires lower speed for compliance with section 1 of this
37	37	5 chapter, the slower speed limit specified in this section or established
38	38	6 as authorized by section 3 of this chapter is the maximum lawful speed.
39	39	7 A person may not drive a vehicle on a highway at a speed in excess of
40	40	8 the following maximum limits:
41	41	9 (1) Thirty (30) miles per hour in an urban district.
42	42	10 (2) Fifty-five (55) miles per hour, except as provided in
43	43	11 subdivisions (1), (3), (4), (5), (6), and (7).
44	44	12 (3) Seventy (70) miles per hour on a highway on the national
45	45	13 system of interstate and defense highways located outside of an
46	46	14 urbanized area (as defined in 23 U.S.C. 101) with a population of
47	47	15 at least fifty thousand (50,000). except as provided in subdivision
48	48	16 (4).
49	49	17 (4) Sixty-five (65) miles per hour for a vehicle (other than a bus)

51	51	1 having a declared gross weight greater than twenty-six thousand
52	52	2 (26,000) pounds on a highway on the national system of interstate
53	53	3 and defense highways located outside an urbanized area (as
54	54	4 defined in 23 U.S.C. 101) with a population of at least fifty
55	55	5 thousand (50,000).
56	56	6 (5) (4) Sixty-five (65) miles per hour on:
57	57	7 (A) U.S. 20 from the intersection of U.S. 20 and County Road
58	58	8 17 in Elkhart County to the intersection of U.S. 20 and U.S. 31
59	59	9 in St. Joseph County;
60	60	10 (B) U.S. 31 from the intersection of U.S. 31 and U.S. 20 in St.
61	61	11 Joseph County to the boundary line between Indiana and
62	62	12 Michigan; and
63	63	13 (C) a highway classified by the Indiana department of
64	64	14 transportation as an INDOT Freeway.
65	65	15 (6) (5) Seventy (70) miles per hour on a highway that is the
66	66	16 responsibility of the Indiana finance authority established by
67	67	17 IC 5-1.2-3.
68	68	18 (A) seventy (70) miles per hour for:
69	69	19 (i) a motor vehicle having a declared gross weight of not
70	70	20 more than twenty-six thousand (26,000) pounds; or
71	71	21 (ii) a bus; or
72	72	22 (B) sixty-five (65) miles per hour for a motor vehicle having
73	73	23 a declared gross weight greater than twenty-six thousand
74	74	24 (26,000) pounds.
75	75	25 (7) (6) Sixty (60) miles per hour on a highway that:
76	76	26 (A) is not designated as a part of the national system of
77	77	27 interstate and defense highways;
78	78	28 (B) has four (4) or more lanes;
79	79	29 (C) is divided into two (2) or more roadways by:
80	80	30 (i) an intervening space that is unimproved and not intended
81	81	31 for vehicular travel;
82	82	32 (ii) a physical barrier; or
83	83	33 (iii) a dividing section constructed to impede vehicular
84	84	34 traffic; and
85	85	35 (D) is located outside an urbanized area (as defined in 23
86	86	36 U.S.C. 101) with a population of at least fifty thousand
87	87	37 (50,000).
88	88	38 (8) (7) Fifteen (15) miles per hour in an alley.
89	89	39 (b) A person who violates subsection (a) commits a Class C
90	90	40 infraction.
