2727 A BILL FOR AN ACT to amend the Indiana Code concerning
2828 higher education.
2929 Be it enacted by the General Assembly of the State of Indiana:
3030 1 SECTION 1. IC 12-32-1-6, AS AMENDED BY P.L.172-2018,
3131 2 SECTION 1, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
3232 3 JULY 1, 2024]: Sec. 6. An agency or a political subdivision required
3333 4 to verify the eligibility of an individual under section 5 of this chapter
3434 5 shall do the following:
3535 6 (1) Require the individual to execute a verification stating under
3636 7 penalty of perjury that the individual: one (1) of the following:
3737 8 (A) The individual is a United States citizen.
3838 9 (B) The individual is a qualified alien (as defined under 8
3939 10 U.S.C. 1641). or
4040 11 (C) The individual meets the following:
4141 12 (i) The individual is authorized by the federal government to
4242 13 work in the United States as provided under section 6.5 of
4343 14 this chapter.
4444 15 (ii) The individual is executing the verification only for the
4545 16 purpose of applying for a professional or occupational
4646 17 license (as defined in section 6.5(a) of this chapter).

4848 1 (D) The individual:
4949 2 (i) is not applying for any state or local public benefit or
5050 3 federal public benefit, other than the resident tuition
5151 4 rate, that is provided by the agency or political
5252 5 subdivision; and
5353 6 (ii) meets the requirements under IC 21-14-11.5-1.
5454 7 (2) Maintain a verification executed in accordance with
5555 8 subdivision (1) for at least five (5) years.
5656 9 SECTION 2. IC 21-14-11-1, AS AMENDED BY P.L.180-2013,
5757 10 SECTION 2, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
5858 11 JULY 1, 2024]: Sec. 1. (a) This section does not apply to an individual
5959 12 who was enrolled in a state educational institution on or before July 1,
6060 13 2011.
6161 14 (b) Except as provided in IC 21-14-11.5-1, an individual who is
6262 15 not lawfully present in the United States is not eligible to pay the
6363 16 resident tuition rate that is determined by the state educational
6464 17 institution.
6565 18 SECTION 3. IC 21-14-11.5 IS ADDED TO THE INDIANA CODE
6666 19 AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE
6767 20 JULY 1, 2024]:
6868 21 Chapter 11.5. Resident Tuition for Eligible Individuals
6969 22 Sec. 1. An individual is eligible to pay the resident tuition rate
7070 23 that is determined by a state educational institution if the
7171 24 individual:
7272 25 (1) attended a public or nonpublic high school (as defined in
7373 26 IC 20-18-2-7) in Indiana for at least three (3) years; and
7474 27 (2) has received a diploma of graduation, or the equivalent of
7575 28 a diploma, from a public or nonpublic high school (as defined
7676 29 in IC 20-18-2-7) in Indiana.
7777 30 Sec. 2. The commission may adopt rules under IC 4-22-2 to
7878 31 implement this chapter.
