HOUSE BILL No. 1080 A BILL FOR AN ACT to amend the Indiana Code concerning public safety. Be it enacted by the General Assembly of the State of Indiana: 1 SECTION 1. IC 36-5-7-6.5 IS ADDED TO THE INDIANA CODE 2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 3 1, 2024]: Sec. 6.5. (a) The appointment of a reserve deputy town 4 marshal is subject to the requirements set forth in IC 36-8-3-20. 5 (b) A reserve deputy town marshal may not act in an official 6 capacity as a reserve deputy town marshal unless the reserve 7 deputy town marshal is wearing a distinctive uniform and 8 identification authorized by the town marshal. 9 (c) If the reserve deputy town marshal's official duties include 10 patrolling with the use of a motor vehicle, the motor vehicle used 11 as part of the reserve deputy town marshal's official duties must: 12 (1) be marked as a police vehicle; and 13 (2) include identification of the particular town being served 14 by the reserve deputy town marshal; 15 in a manner that will clearly show to casual observations that the 16 motor vehicle is being used as a police vehicle of the particular 17 town served by the reserve deputy town marshal. 2024 IN 1080—LS 6302/DI 116 2 1 (d) The town council shall determine the placement and the size 2 of the identification of the particular town on a motor vehicle 3 described in subsection (c)(2). 2024 IN 1080—LS 6302/DI 116
