3535 A BILL FOR AN ACT to amend the Indiana Code concerning

3737 Be it enacted by the General Assembly of the State of Indiana:
3838 1 SECTION 1. IC 16-46-18 IS ADDED TO THE INDIANA CODE
3939 2 AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE

4141 4 Chapter 18. School Lead Testing and Remediation Grant
4242 5 Program
4343 6 Sec. 1. For purposes of this chapter, "public school corporation"
4444 7 has the meaning set forth in IC 4-4-38.5-6.2.
4545 8 Sec. 2. The school lead testing and remediation grant program
4646 9 is established. The state department shall administer the program.
4747 10 Sec. 3. (a) The school lead testing and remediation grant fund is
4848 11 established for the purpose of making grants to public school
4949 12 corporations to perform lead testing and remediation in schools.
5050 13 The state department shall administer the fund.
5151 14 (b) The fund consists of:
5252 15 (1) money appropriated to the fund by the general assembly;
5353 16 (2) money received from state or federal grants or programs;
5454 17 and

5656 1 (3) gifts, money, and donations received from any other
5757 2 source, including transfers from other funds or accounts.
5858 3 (c) The expenses of administering the fund shall be paid from
5959 4 money in the fund.
6060 5 (d) The treasurer of state shall invest the money in the fund not
6161 6 currently needed to meet the obligations of the fund in the same
6262 7 manner as other public money may be invested. Interest that
6363 8 accrues from the investments shall be deposited in the fund.
6464 9 (e) Money in the fund at the end of a state fiscal year does not
6565 10 revert to the state general fund.
6666 11 Sec. 4. (a) A public school corporation seeking a grant under
6767 12 this chapter must submit a proposal to the state department in a
6868 13 manner prescribed by the state department.
6969 14 (b) The state department, upon receiving a proposal from a
7070 15 public school corporation, shall either approve or reject the
7171 16 proposal.
7272 17 (c) The state department, upon the approval of a proposal from
7373 18 a public school corporation, shall make the grant to the public
7474 19 school corporation in a time and manner determined by the state
7575 20 department.
7676 21 Sec. 5. The state department may adopt necessary rules under
7777 22 IC 4-22-2 to implement this chapter.
