36+A BILL FOR AN ACT to amend the Indiana Code concerning
37+agriculture and animals.
1438 Be it enacted by the General Assembly of the State of Indiana:
15-SECTION 1. IC 15-15-1-28, AS ADDED BY P.L.2-2008,
16-SECTION 6, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
17-JULY 1, 2024]: Sec. 28. (a) The state seed commissioner may by rule
18-define seed labeling and testing terms in common usage such as "pure
19-seed" and "germination".
20-(b) A rule adopted by the state seed commissioner under this section
21-must be based on published sources such as the rules of the Association
22-of Official Seed Analysts.
23-(c) The state seed commissioner shall apply the agricultural seed
24-and vegetable seed standards set forth in 7 CFR 201 as the state
25-germination standards and requirements for agricultural seed and
26-vegetable seed.
27-SECTION 2. IC 15-15-13-14, AS AMENDED BY P.L.190-2019,
28-SECTION 16, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
29-JULY 1, 2024]: Sec. 14. (a) The state seed commissioner shall adopt
30-rules under IC 4-22-2 to implement and administer this chapter.
31-(b) The state seed commissioner may adopt emergency rules in the
32-manner provided under IC 4-22-2-37.1 to comply with any federal
33-requirement under the Agriculture Improvement Act of 2018 to
34-implement and administer this chapter.
