2828 A BILL FOR AN ACT to amend the Indiana Code concerning
2929 education.
3030 Be it enacted by the General Assembly of the State of Indiana:
3131 1 SECTION 1. IC 20-26-5-40.7 IS ADDED TO THE INDIANA
3232 2 CODE AS A NEW SECTION TO READ AS FOLLOWS
3333 3 [EFFECTIVE JULY 1, 2024]: Sec. 40.7. (a) As used in this section,
3434 4 "instructional time" has the meaning set forth in IC 20-30-2-1.
3535 5 (b) Each school corporation and charter school shall adopt and
3636 6 implement a wireless communication device policy that:
3737 7 (1) except as provided in subdivisions (2) and (3), prohibits a
3838 8 student from using a wireless communication device during
3939 9 instructional time;
4040 10 (2) authorizes a teacher to allow a student to use a wireless
4141 11 communication device for educational purposes during
4242 12 instructional time; and
4343 13 (3) permits a student to use a wireless communication device
4444 14 in the event of an emergency.
4545 15 (c) Each school corporation and charter school shall publish on
4646 16 its website the wireless communication device policy established
4747 17 under subsection (b).
