HOUSE BILL No. 1227
A BILL FOR AN ACT to amend the Indiana Code concerning
education.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 20-34-4.5-0.2, AS ADDED BY P.L.117-2017,
2 SECTION 3, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
3 JULY 1, 2024]: Sec. 0.2. As used in this chapter, "emergency
4 medication" means any of the following:
5 (1) Albuterol.
6 (2) Epinephrine.
7 (3) Naloxone, including naloxone nasal spray, as an overdose
8 intervention drug that is subject to IC 16-42-27.
9 SECTION 2. IC 20-34-4.5-1, AS AMENDED BY P.L.164-2023,
10 SECTION 55, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
11 JULY 1, 2024]: Sec. 1. (a) Except as provided in subsection (c), a
12 school or a school corporation may:
13 (1) fill a prescription or statewide standing order for an
14 emergency medication; and
15 (2) store the emergency medication:
16 (A) if the prescription or statewide standing order is filled by
17 a school, in the school; or

1 (B) if the prescription or statewide standing order is filled by
2 a school corporation, in a school in the school corporation;
3 and
4 (3) work in cooperation with an opioid overdose prevention
5 organization to carry out the purposes of this chapter;
6 if a health care provider who is licensed in Indiana and whose scope of
7 practice includes the prescribing of medication writes the prescription
8 or the state health commissioner issues a statewide standing order for
9 the emergency medication for the school or school corporation.
10 (b) The school shall store the emergency medication in a safe
11 location in which only school employees have access.
12 (c) A school or a school corporation shall:
13 (1) fill a statewide standing order for naloxone nasal spray;
14 and
15 (2) store the naloxone nasal spray in a location in the school
16 that is readily accessible for use by a school nurse or by a
17 school employee who has received training described in
18 section 2 of this chapter.
19 SECTION 3. IC 20-34-4.5-3, AS AMENDED BY P.L.164-2023,
20 SECTION 56, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
21 JULY 1, 2024]: Sec. 3. (a) A health care provider who is licensed in
22 Indiana and whose scope of practice includes the prescribing of
23 medication may:
24 (1) write; or
25 (2) transmit in an electronic format for an electronically
26 transmitted prescription;
27 a prescription, drug order, or protocol for an emergency medication for
28 a school or school corporation.
29 (b) Except as provided in subsection (d), the state health
30 commissioner or the state health commissioner's designee who is a
31 licensed prescriber may issue a statewide standing order, prescription,
32 or protocol for emergency stock medication for schools or school
33 corporations.
34 (c) Except as provided in subsection (e), a pharmacist licensed
35 under IC 25-26 may dispense a valid prescription, drug order, standing
36 order, or protocol for an emergency medication issued in the name of
37 a school or school corporation.
38 (d) The state health commissioner or the state health
39 commissioner's designee who is a licensed prescriber shall issue a
40 statewide standing order or prescription for naloxone nasal spray
41 for each:
42 (1) school; or

1 (2) school corporation on behalf of each school.
2 The standing order or prescription shall provide at least one (1)
3 carton of naloxone nasal spray per five hundred (500) students
4 enrolled at a school.
5 (e) A pharmacist licensed under IC 25-26 shall dispense a valid
6 prescription, standing order, or protocol for naloxone nasal spray
7 issued in the name of a school or school corporation on behalf of
8 each school.
