7	7	Synopsis: Child care assistance eligibility. Provides that a household
8	8	is eligible to begin receiving assistance under the federal Child Care
9	9	and Development Fund (CCDF) voucher program if the household, at
10	10	the time of the initial determination of the household's income
11	11	eligibility by the office of the secretary of family and social services
12	12	(FSSA): (1) has a household income that does not exceed 85% of
13	13	Indiana's state median income for the household's family size; (2)
14	14	includes an individual who is employed by a licensed child care center,
15	15	a licensed child care home, or a licensed or registered child care
16	16	ministry; and (3) otherwise meets federal eligibility requirements for
17	17	the CCDF program. Provides that a child who: (1) is a member of a
18	18	household with an annual income that does not exceed 85% of
19	19	Indiana's state median income for the child's family size; (2) resides
20	20	with a parent or guardian who is employed by a licensed child care
21	21	center, a licensed child care home, or a licensed or registered child care
22	22	ministry; and (3) meets other eligibility requirements for the
23	23	prekindergarten program under current law; is eligible for assistance
24	24	under the prekindergarten program.

41	41	A BILL FOR AN ACT to amend the Indiana Code concerning
42	42	human services.
43	43	Be it enacted by the General Assembly of the State of Indiana:
44	44	1 SECTION 1. IC 12-14-31-3 IS ADDED TO THE INDIANA CODE
45	45	2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE
46	46	3 UPON PASSAGE]: Sec. 3. A household that, at the time of the office
47	47	4 of the secretary's initial determination of the household's income
48	48	5 eligibility for purposes of entry into the CCDF program:
49	49	6 (1) has a household income that does not exceed eighty-five
50	50	7 percent (85%) of Indiana's state median income for the
51	51	8 household's family size;
52	52	9 (2) includes an individual who is employed by a:
53	53	10 (A) child care center licensed under IC 12-17.2-4;
54	54	11 (B) child care home licensed under IC 12-17.2-5; or
55	55	12 (C) child care ministry licensed or registered under
56	56	13 IC 12-17.2-6; and
57	57	14 (3) otherwise meets federal eligibility requirements for the
58	58	15 CCDF program;
59	59	16 is eligible for assistance under the CCDF program.
60	60	17 SECTION 2. IC 12-17.2-7.2-1, AS AMENDED BY P.L.201-2023,

62	62	1 SECTION 138, IS AMENDED TO READ AS FOLLOWS
63	63	2 [EFFECTIVE UPON PASSAGE]: Sec. 1. As used in this chapter,
64	64	3 "eligible child" refers to an individual: who:
65	65	4 (1) who is at least four (4) years of age and less than five (5) years
66	66	5 of age on August 1 of the state fiscal year for which a grant is
67	67	6 sought under the prekindergarten pilot program;
68	68	7 (2) who is a resident of Indiana or otherwise has legal settlement
69	69	8 in Indiana, as determined under IC 20-26-11;
70	70	9 (3) who:
71	71	10 (A) is a member of a household with an annual income that
72	72	11 does not exceed one hundred fifty percent (150%) of the
73	73	12 federal poverty level; or
74	74	13 (B) is a member of a household with an annual income that
75	75	14 does not exceed eighty-five percent (85%) of Indiana's
76	76	15 state median income for the individual's family size and
77	77	16 who resides with a parent or guardian who is employed by
78	78	17 a:
79	79	18 (i) child care center licensed under IC 12-17.2-4;
80	80	19 (ii) child care home licensed under IC 12-17.2-5; or
81	81	20 (iii) child care ministry licensed or registered under
82	82	21 IC 12-17.2-6;
83	83	22 (4) who receives qualified early education services from an
84	84	23 eligible provider, as determined by the office;
85	85	24 (5) who has a parent or guardian who participates in a parental
86	86	25 engagement and involvement component provided by the eligible
87	87	26 provider;
88	88	27 (6) who has a parent or guardian who agrees to ensure that the
89	89	28 child meets the attendance requirements determined by the office;
90	90	29 and
91	91	30 (7) who meets the requirements under section 7.2(a) and 7.2(c) of
92	92	31 this chapter.
93	93	32 SECTION 3. [EFFECTIVE UPON PASSAGE] (a) Not later than
94	94	33 December 31, 2024, the office of the secretary of family and social
95	95	34 services shall submit to the United States Department of Health
96	96	35 and Human Services any amendment to Indiana's Child Care and
97	97	36 Development Fund plan necessary to implement IC 12-14-31-3, as
98	98	37 added by this act, and IC 12-17.2-7.2-1, as amended by this act.
99	99	38 (b) This SECTION expires January 1, 2025.
100	100	39 SECTION 4. An emergency is declared for this act.
