251 | | - | 17 (c) (d) A school corporation or charter school that is awarded a |

253 | | - | 19 school years. The amount of the grant may not exceed the costs |

254 | | - | 20 incurred by the school corporation or charter school to implement the |

256 | | - | 22 matching grant from a corporation, foundation, or any other entity in |

420 | | - | 14 transferable among different subject areas and courses to |
---|
421 | | - | 15 ensure that a mastery can satisfy multiple requirements. |

422 | | - | 16 (b) The department may consult with any of the following |
---|
423 | | - | 17 regarding establishing and reviewing masteries and creating |
---|
424 | | - | 18 criteria under subsection (a): |
---|
425 | | - | 19 (1) Dedicated lead partners. |
---|
426 | | - | 20 (2) School corporations and charter schools participating in |
---|
427 | | - | 21 the program. |
---|
428 | | - | 22 (3) Any other individual or entity, as determined by the |
---|
429 | | - | 23 department. |
---|
430 | | - | 24 (c) The department may request information from a school |
---|
431 | | - | 25 corporation or charter school participating in the program for the |
---|
432 | | - | 26 purpose of assessing the effectiveness of the program. |
---|
433 | | - | 27 (d) A school corporation or charter school shall respond to a |
---|
434 | | - | 28 request for information under subsection (c) in a form, manner, |
---|
435 | | - | 29 and frequency determined by the department. |
---|
436 | | - | 30 Sec. 8. (a) Except as provided under subsections (b) and (c), a |
---|
437 | | - | 31 school maintained by a school corporation or charter school that |
---|
438 | | - | 32 participates in the program is exempt from all requirements of this |
---|
439 | | - | 33 title except for requirements under this chapter or requirements |
---|
440 | | - | 34 established under federal law. |
---|
441 | | - | 35 (b) A school described in subsection (a) is not exempt from the |
---|
442 | | - | 36 following: |
---|
443 | | - | 37 (1) Any of the nonwaivable provisions listed under |
---|
444 | | - | 38 IC 20-31-4.1-7. |

---|

502 | | - | 10 (1) The attrition, retention, and completion rates of teacher |
---|
503 | | - | 11 candidates for the previous three (3) calendar years. The teacher |
---|
504 | | - | 12 preparation program must also provide underlying data, as |
---|
505 | | - | 13 determined by the department, used as part of calculating the |
---|
506 | | - | 14 teacher preparation program's retention rates. |
---|
507 | | - | 15 (2) The number of teacher candidates in each content area who |
---|
508 | | - | 16 complete the teacher preparation program during the year, |
---|
509 | | - | 17 disaggregated by ranges of cumulative grade point averages. |
---|
510 | | - | 18 (3) The number of teacher candidates in each content area who, |
---|
511 | | - | 19 during the year: |
---|
512 | | - | 20 (A) do not pass a content area licensure examination; and |
---|
513 | | - | 21 (B) do not retake the content area licensure examination. |
---|
514 | | - | 22 (h) In making information available to the public on the |
---|
515 | | - | 23 department's website, the department shall include in the report under |
---|
516 | | - | 24 subsection (g), in addition to the matrix ratings described in subsection |
---|
517 | | - | 25 (i), the following information: |

518 | | - | 26 (1) Average scaled or standard scores of teacher candidates who |
---|
519 | | - | 27 complete teacher preparation programs on basic skills, content |
---|
520 | | - | 28 area, and pedagogy licensure examinations. |

521 | | - | 29 (2) The average number of times teacher candidates who |
---|
522 | | - | 30 complete a teacher preparation program take each licensing test |
---|
523 | | - | 31 before receiving a passing score and the percentage of teacher |
---|
524 | | - | 32 candidates who receive a passing score on each licensing test on |
---|
525 | | - | 33 the teacher candidates' first attempts. |

526 | | - | 34 (i) Not later than July 30, 2016, the department and the commission |
---|
527 | | - | 35 for higher education, in conjunction with the state board, the |

528 | | - | 36 Independent Colleges of Indiana, Inc., and teacher preparation |

529 | | - | 37 programs, shall establish a matrix rating system for teacher preparation |

---|
531 | | - | 39 by the data collected under subsections (g) and (h). The matrix rating |

532 | | - | 40 system may not rank or compare teacher preparation programs. The |
---|
533 | | - | 41 matrix rating system must be based on data collected for teachers who |
---|
534 | | - | 42 initially receive their teaching license during the previous three (3) |
---|

550 | | - | 15 (3) the Association for Advancing Quality in Educator |
---|

588 | | - | 10 (n) Not later than December 31, 2024, the department and the |

589 | | - | 11 commission for higher education, in conjunction with the state |
---|
590 | | - | 12 board, shall partner with teacher preparation programs to receive |
---|
591 | | - | 13 an outside evaluation by a nationally recognized nonprofit, |
---|
592 | | - | 14 nonpartisan organization that leverages evidence based approaches |
---|
593 | | - | 15 on the science of reading to evaluate teacher preparation reading |
---|
594 | | - | 16 instruction programs. |
---|
595 | | - | 17 SECTION 11. IC 20-28-3-3.2 IS ADDED TO THE INDIANA |

611 | | - | 33 (2) implement math instruction using high quality |
---|
612 | | - | 34 instructional material; and |
---|
613 | | - | 35 (3) understand and use student data to make instructional |
---|
614 | | - | 36 decisions. |

615 | | - | 37 SECTION 12. IC 20-28-5-19.7, AS AMENDED BY SEA 1-2024, |

678 | | - | 14 teacher to add the literacy endorsement established under this section |

---|

851 | 780 | | (d) Expenses paid under this section shall be payable from |
---|
852 | 781 | | amounts appropriated to the department. |
---|
853 | 782 | | Sec. 5. The committee shall meet at least once every six (6) |
---|
854 | 783 | | months and at the call of the chairperson. A member of the |
---|
855 | 784 | | committee may participate in a committee meeting using an |
---|
856 | 785 | | electronic communication in the manner prescribed in |
---|
857 | 786 | | IC 5-14-1.5-3.6. |
---|
859 | 788 | | Sec. 6. (a) After July 31, 2024, all qualified data collections must |
---|
860 | 789 | | be expressly approved by the state board after it is has been |
---|
861 | 790 | | reviewed by the committee under subsection (c) before schools and |
---|
862 | 791 | | school corporations are required to submit the information to the |
---|
863 | 792 | | state board or the department. The department may not require |
---|
864 | 793 | | schools or school corporations to submit any qualified data |
---|
865 | 794 | | collection unless the qualified data collection is approved by the |
---|
866 | 795 | | state board under this subsection. The department shall maintain |
---|
867 | 796 | | on its website a list of all qualified data collections approved by the |
---|
868 | 797 | | state board and the deadline by which each school or school |
---|
869 | 798 | | corporation shall submit the information. |
---|
870 | 799 | | (b) After July 31, 2024, the state board and the department may |
---|
871 | 800 | | not sanction, penalize, or in any way hold a school or school |
---|
872 | 801 | | corporation accountable for failing to submit a qualified data |
---|
873 | 802 | | collection report if the qualified data collection was not approved |
---|
874 | 803 | | by the state board under subsection (a). |
---|
875 | 804 | | (c) Not later than August 1, 2024, the committee, in consultation |
---|
876 | 805 | | with the department, shall review current collection of: |
---|
877 | 806 | | (1) qualified data from accredited schools; and |
---|
878 | 807 | | (2) data collection by another public agency (as defined in |
---|
879 | 808 | | IC 5-14-1.5-2) of the state from accredited schools. |
---|
880 | 809 | | Based on the committee's review, the committee shall make |
---|
881 | 810 | | recommendations to the state board whether to continue the |
---|
882 | 811 | | qualified data collection and ways or methods to streamline |
---|
883 | 812 | | qualified data collection and data collection by another public |
---|
884 | 813 | | agency of the state from schools, including the development of a |
---|
885 | 814 | | standardized school improvement plan template for use by school |
---|
886 | 815 | | corporations to prepare school improvement plans. After |
---|
887 | 816 | | submitting the committee's initial recommendations regarding |
---|
888 | 817 | | current qualified data and data collections to the state board, the |
---|
889 | 818 | | committee shall review qualified data collection requests made by |
---|
890 | 819 | | the department and the state board after July 31, 2024, and make |
---|
891 | 820 | | recommendations to the state board as to whether the qualified |
---|
892 | 821 | | data collection is necessary or ways to streamline the qualified data |
---|
893 | 822 | | collection. In addition, the committee shall review and make |
---|
894 | 823 | | recommendations to the state board under subsection (d) |
---|
895 | 824 | | regarding methods to streamline school safety and discipline |
---|
896 | 825 | | reporting requirements as well as establishing a streamlined |
---|
897 | 826 | | method to uniformly and consistently report instances of bullying |
---|
898 | 827 | | throughout Indiana. The committee may not change the data |
---|
899 | 828 | | reporting requirements for data used by the state board to place |
---|
900 | 829 | | each school in a category or designation of school performance |
---|
902 | 831 | | under IC 20-31-8-4. |
---|
903 | 832 | | (d) The committee shall submit its recommendations under |
---|
904 | 833 | | subsection (c) to the state board. Upon receipt of the committee's |
---|
905 | 834 | | recommendations, the state board shall vote to either approve or |
---|
906 | 835 | | disapprove the qualified data request or recommendations. The |
---|
907 | 836 | | decision of the state board is final. The state board shall consider |
---|
908 | 837 | | the committee's recommendations at the state board's next meeting |
---|
909 | 838 | | after receiving the committee's recommendations under subsection |
---|
910 | 839 | | (c). |
---|
911 | 840 | | (e) The committee may recommend the collection of qualified |
---|
912 | 841 | | data under subsection (c) and the state board may approve the |
---|
913 | 842 | | recommendation under subsection (d) only if the: |
---|
914 | 843 | | (1) qualified data is not available to the public agency |
---|
915 | 844 | | requesting the information from any other source; and |
---|
916 | 845 | | (2) benefit from the collection of the qualified data is greater |
---|
917 | 846 | | than the overall administrative cost of collecting the qualified |
---|
918 | 847 | | data. |
---|
919 | 848 | | Sec. 7. (a) Before December 1, 2024, the state board, in |
---|
920 | 849 | | consultation with the department and based upon |
---|
921 | 850 | | recommendations by the committee, shall review all statutory |
---|
922 | 851 | | reporting requirements and qualified data collection and data |
---|
923 | 852 | | collection by various public agencies (as defined in IC 5-14-1.5-2) |
---|
924 | 853 | | of the state and shall submit a report to the governor and, in an |
---|
925 | 854 | | electronic format under IC 5-14-6, to the general assembly. The |
---|
926 | 855 | | report must include the following: |
---|
927 | 856 | | (1) A detailed description of actions that will be taken by the |
---|
928 | 857 | | state board and the department to reduce the amount of |
---|
929 | 858 | | information schools or school corporations must report to the |
---|
930 | 859 | | state. |
---|
931 | 860 | | (2) A detailed summary describing the actions taken by the |
---|
932 | 861 | | department and the state board to combine, streamline, or |
---|
933 | 862 | | eliminate duplicative data or information requests from |
---|
934 | 863 | | schools and school corporations. |
---|
935 | 864 | | (3) A detailed description of how the state board is working |
---|
936 | 865 | | with other public agencies of the state to minimize or |
---|
937 | 866 | | streamline data collection by those agencies. |
---|
938 | 867 | | (4) Specific legislative recommendations to the general |
---|
939 | 868 | | assembly necessary to eliminate duplicative data reporting |
---|
940 | 869 | | and any recommended legislative changes that would make |
---|
941 | 870 | | school data reporting to various public agencies of the state |
---|
942 | 871 | | more efficient and cost effective. |
---|
943 | 872 | | (b) Before December 1, 2025, the state board shall submit an |
---|
945 | 874 | | updated report to the governor and, in an electronic format under |
---|
946 | 875 | | IC 5-14-6, to the general assembly containing the progress of the |
---|
947 | 876 | | state board and the department to eliminate duplicative data |
---|
948 | 877 | | reporting and information requests to schools of any additional |
---|
949 | 878 | | recommended legislative changes that would streamline school |
---|
950 | 879 | | data reporting to the state that was not included in the state |
---|
951 | 880 | | board's report submitted under subsection (a). |
---|
952 | 881 | | Sec. 8. (a) After June 30, 2024, all reports required to be |
---|
953 | 882 | | submitted to a public agency (as defined in IC 5-14-1.5-2) of the |
---|
954 | 883 | | state by accredited schools must be collected electronically and |
---|
955 | 884 | | must be collected through one (1) regularly scheduled consolidated |
---|
956 | 885 | | report that is collected no more frequently than on a quarterly |
---|
957 | 886 | | basis through an electronic data base administered by the |
---|
958 | 887 | | department established by rule under IC 4-22-2. |
---|
959 | 888 | | (b) This section does not apply to: |
---|
960 | 889 | | (1) any collection of data if the office of management and |
---|
961 | 890 | | budget has approved a waiver of the application of this |
---|
962 | 891 | | section; |
---|
963 | 892 | | (2) tax reporting; |
---|
964 | 893 | | (3) an investigation authorized by federal or state statute or |
---|
965 | 894 | | regulation; or |
---|
966 | 895 | | (4) testing material. |

1002 | 931 | | (A) whole and small group instruction; or |
---|

---|
1018 | 947 | | (1) are transferable; and |
---|
1019 | 948 | | (2) qualify a student for advancement to subsequent |
---|
1020 | 949 | | educational levels or competencies. |
---|
1021 | 950 | | Sec. 3. As used in this chapter, "mastery based education" |
---|
1022 | 951 | | means an innovative, learner centered approach to teaching and |
---|
1023 | 952 | | learning that focuses on the mastery of specific skills or knowledge |
---|
1024 | 953 | | areas rather than the amount of time spent in a classroom. |
---|
1025 | 954 | | Sec. 4. As used in this chapter, "program" refers to the mastery |
---|
1026 | 955 | | based education program established by section 5 of this chapter. |
---|
1027 | 956 | | Sec. 5. (a) The mastery based education program is established |
---|
1028 | 957 | | to allow a school corporation or charter school that is selected by |
---|
1029 | 958 | | the department under subsection (b) to implement mastery based |
---|
1031 | 960 | | education in: |
---|
1032 | 961 | | (1) one (1) or more schools maintained by the school |
---|
1033 | 962 | | corporation; or |
---|
1034 | 963 | | (2) the charter school. |
---|
1035 | 964 | | (b) The department: |
---|
1036 | 965 | | (1) shall administer the program; and |
---|
1037 | 966 | | (2) may select: |
---|
1038 | 967 | | (A) school corporations; |
---|
1039 | 968 | | (B) charter schools; or |
---|
1040 | 969 | | (C) both school corporations and charter schools; |
---|
1041 | 970 | | that meet the requirements under section 6 of this chapter to |
---|
1042 | 971 | | participate in the program. |
---|
1043 | 972 | | Sec. 6. (a) To apply for participation in the program, a school |
---|
1044 | 973 | | corporation or charter school shall do the following: |
---|
1045 | 974 | | (1) Apply on a form and in a manner established by the |
---|
1046 | 975 | | department. |
---|
1047 | 976 | | (2) Submit to the department a plan for the establishment and |
---|
1048 | 977 | | implementation of mastery based education in the school |
---|
1049 | 978 | | corporation or charter school that: |
---|
1050 | 979 | | (A) meets the requirements of section 7 of this chapter; and |
---|
1051 | 980 | | (B) includes specific measurable goals or student outcomes |
---|
1052 | 981 | | the school corporation or charter school intends to achieve. |
---|
1053 | 982 | | (b) The department shall approve or deny a plan submitted by |
---|
1054 | 983 | | a school corporation or charter school under this section. |
---|
1055 | 984 | | Sec. 7. Mastery based education implemented by a school |
---|
1056 | 985 | | corporation or charter school under this chapter must meet the |
---|
1057 | 986 | | following requirements: |
---|
1058 | 987 | | (1) A student participating in the mastery based education |
---|
1059 | 988 | | must: |
---|
1060 | 989 | | (A) advance based upon mastery of the subject matter and |
---|
1061 | 990 | | not based on time in a classroom; |
---|
1062 | 991 | | (B) receive timely, differentiated support based on the |
---|
1063 | 992 | | student's individual learning needs; and |
---|
1064 | 993 | | (C) be empowered daily to make important decisions |
---|
1065 | 994 | | about: |
---|
1066 | 995 | | (i) the student's learning experiences and learning |
---|
1067 | 996 | | environment; |
---|
1068 | 997 | | (ii) how the student will create and apply knowledge; and |
---|
1069 | 998 | | (iii) how the student will demonstrate learning. |
---|
1070 | 999 | | (2) Standards in the mastery based education must be broken |
---|
1071 | 1000 | | down into masteries that include rigorous, clear, measurable, |
---|
1072 | 1001 | | and transferable learning objectives that empower students. |
---|
1074 | 1003 | | (3) Assessments administered under the mastery based |
---|
1075 | 1004 | | education must focus on evaluating skills and not on |
---|
1076 | 1005 | | memorization. |
---|
1077 | 1006 | | (4) Learning outcomes for the mastery based education must |
---|
1078 | 1007 | | emphasize masteries that include: |
---|
1079 | 1008 | | (A) application and creation of knowledge; and |
---|
1080 | 1009 | | (B) the development of work ready skills. |
---|
1081 | 1010 | | Sec. 8. If a student: |
---|
1082 | 1011 | | (1) obtains a credit for mastery based education; and |
---|
1083 | 1012 | | (2) subsequently transfers to another school corporation or |
---|
1084 | 1013 | | charter school in Indiana; |
---|
1085 | 1014 | | the school corporation or charter school to which the student |
---|
1086 | 1015 | | transfers shall count the credit by a previous school corporation or |
---|
1087 | 1016 | | charter school that the student attended toward the student's |
---|
1088 | 1017 | | graduation requirements. |
---|
1089 | 1018 | | Sec. 9. (a) The department may do the following: |
---|
1090 | 1019 | | (1) Establish common masteries that may be used by each |
---|
1091 | 1020 | | school participating in the program. |
---|
1092 | 1021 | | (2) Review annually the masteries established under |
---|
1093 | 1022 | | subdivision (1) and, as applicable, do the following: |
---|
1094 | 1023 | | (A) Amend or remove masteries. |
---|
1095 | 1024 | | (B) Establish new common masteries. |
---|
1096 | 1025 | | (3) Create criteria for masteries that are, when applicable, |
---|
1097 | 1026 | | transferable among different subject areas and courses to |
---|
1098 | 1027 | | ensure that a mastery can satisfy multiple requirements. |
---|
1099 | 1028 | | (b) The department may consult with any of the following |
---|
1100 | 1029 | | regarding establishing and reviewing masteries and creating |
---|
1101 | 1030 | | criteria under subsection (a): |
---|
1102 | 1031 | | (1) Approved dedicated lead partners. |
---|
1103 | 1032 | | (2) School corporations and charter schools participating in |
---|
1104 | 1033 | | the program. |
---|
1105 | 1034 | | (3) Any other individual or entity, as determined by the |
---|
1106 | 1035 | | department. |
---|
1107 | 1036 | | (c) The department may request information from a school |
---|
1108 | 1037 | | corporation or charter school participating in the program for the |
---|
1109 | 1038 | | purpose of assessing the effectiveness of the program. |
---|
1110 | 1039 | | (d) A school corporation or charter school shall respond to a |
---|
1111 | 1040 | | request for information under subsection (c) in a form, manner, |
---|
1112 | 1041 | | and frequency determined by the department. |
---|
1113 | 1042 | | Sec. 10. The department shall do the following: |
---|
1114 | 1043 | | (1) Approve dedicated lead partners that a school corporation |
---|
1115 | 1044 | | or charter school participating in the program may contract |
---|
1117 | 1046 | | with in accordance with this chapter. |
---|
1118 | 1047 | | (2) Create and maintain a list of the approved dedicated lead |
---|
1119 | 1048 | | partners on the department's website. |
---|
1120 | 1049 | | Sec. 11. The commission for higher education shall work with |
---|
1121 | 1050 | | school corporations and charter schools participating in the |
---|
1122 | 1051 | | program to ensure that: |
---|
1123 | 1052 | | (1) credits earned through the program are included on the |
---|
1124 | 1053 | | student's high school transcript; and |
---|
1125 | 1054 | | (2) a student enrolled in the program has access to early |
---|
1126 | 1055 | | college credit. |
---|
1127 | 1056 | | Sec. 12. (a) Except as provided under subsections (b) and (c), a |
---|
1128 | 1057 | | school maintained by a school corporation or charter school that |
---|
1129 | 1058 | | participates in the program: |
---|
1130 | 1059 | | (1) is exempt from all requirements of this title except for |
---|
1131 | 1060 | | requirements under this chapter or requirements established |
---|
1132 | 1061 | | under federal law; and |
---|
1133 | 1062 | | (2) may not award graduation waivers under IC 20-32-3 or |
---|
1134 | 1063 | | IC 20-32-5.1. |
---|
1135 | 1064 | | (b) A school described in subsection (a) is not exempt from the |
---|
1136 | 1065 | | following: |
---|
1137 | 1066 | | (1) Except as provided under subsection (d), any of the |
---|
1138 | 1067 | | nonwaivable provisions listed under IC 20-31-4.1-7. |
---|
1139 | 1068 | | (2) IC 20-30-5.6. |

---|
1149 | 1078 | | authorizes the school to opt out of collective bargaining or, if the |
---|
1150 | 1079 | | school is a charter school, the school opts out of collective |
---|
1151 | 1080 | | bargaining. |
---|
1152 | 1081 | | Sec. 13. Not later than November 1, 2025, and not later than |
---|
1153 | 1082 | | November 1 each year thereafter, the department shall: |
---|
1154 | 1083 | | (1) compile and prepare a report that includes information |
---|
1155 | 1084 | | regarding the program; and |
---|
1156 | 1085 | | (2) submit the report to the legislative council in an electronic |

1624 | | - | (1) promote explicit, systematic, and cumulative instruction as the |

1625 | | - | primary approach to literacy instruction; |

1626 | | - | (2) align with both word recognition and language |
---|
1627 | | - | comprehension; |
---|
1628 | | - | (2) (3) promote an understanding of how language, reading, and |
---|
1629 | | - | writing relate to each other; |
---|
1630 | | - | (3) (4) promote strategies for differentiated instruction for: |
---|
1631 | | - | (A) students with: |
---|
1632 | | - | (i) reading difficulties; or |
---|
1633 | | - | (ii) disabilities; and |
---|
1634 | | - | (B) English language learners; |
---|
1635 | | - | (4) (5) focus on phonemic awareness, phonics, fluency, |

1636 | | - | vocabulary, and comprehension; and |
---|
