8581 A BILL FOR AN ACT to amend the Indiana Code concerning
8682 education.
8783 Be it enacted by the General Assembly of the State of Indiana:
8884 1 SECTION 1. IC 4-3-22-20, AS ADDED BY P.L.250-2023,
8985 2 SECTION 1, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
9086 3 UPON PASSAGE]: Sec. 20. (a) As used in this section, "state
9187 4 agency" has the meaning set forth in IC 4-12-1-2.
9288 5 (b) Before November 1, 2023, the department of education shall
9389 6 report to the legislative council in an electronic format under IC 5-14-6
9490 7 findings and recommendations for reducing the amount of redundant
9591 8 data that schools are required to submit to state agencies. (as defined
9692 9 in IC 4-12-1-2).
9793 10 (c) The OMB shall establish a kindergarten through grade 12
9894 11 data governance team comprised of subject matter experts from
9995 12 state agencies that collect data, reports, and other information
10096 13 from schools and school corporations, as determined by the OMB.
10197 14 (d) Not later than November 1, 2024, the kindergarten through
10298 15 grade 12 data governance team established by the OMB under
10399 16 subsection (c) shall:
104100 17 (1) develop a comprehensive plan to:

106102 1 (A) address the amount of redundant data that schools and
107103 2 school corporations are required to submit to state
108104 3 agencies; and
109105 4 (B) streamline the collection of data, reports, and other
110106 5 information from schools and school corporations;
111107 6 (2) create a kindergarten through grade 12 data inventory
112108 7 that identifies all data, reports, and other information schools
113109 8 and school corporations are required to submit to state
114110 9 agencies;
115111 10 (3) seek from stakeholders through a stakeholder survey input
116112 11 and recommendations for reducing the amount of redundant
117113 12 data that schools and school corporations are required to
118114 13 submit to state agencies; and
119115 14 (4) submit a report to the legislative council in an electronic
120116 15 format under IC 5-14-6 that includes:
121117 16 (A) the comprehensive plan developed under this
122118 17 subsection;
123119 18 (B) the kindergarten through grade 12 data inventory
124120 19 created under this subsection;
125121 20 (C) a summary of the input and recommendations received
126122 21 from stakeholders through the stakeholder survey; and
127123 22 (D) updated findings and recommendations for reducing
128124 23 the amount of redundant data that schools and school
129125 24 corporations are required to submit to state agencies.
130126 25 (e) This section expires July 1, 2025.
131127 26 SECTION 2. IC 20-19-3-35 IS ADDED TO THE INDIANA CODE
132128 27 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE
133129 28 UPON PASSAGE]: Sec. 35. (a) Not later than July 1, 2024, the
134130 29 department shall do the following:
135131 30 (1) Establish an online, self-paced professional development
136132 31 module to support educators in doing the following with
137133 32 regard to mathematics:
138134 33 (A) Implementing the Indiana academic standards.
139135 34 (B) Applying effective teaching strategies.
140136 35 (C) Emphasizing contextual problem solving.
141137 36 (D) Fostering collaborative learning environments.
142138 37 (E) Using universal supports for students.
143139 38 (2) Develop math descriptions correlated to proficiency level
144140 39 descriptors to track proficiency at the student level that are:
145141 40 (A) appropriately aligned to the Indiana academic
146142 41 standards; and
147143 42 (B) readily available to educators, parents, and students

149145 1 across the state.
150146 2 (3) Create and identify dedicated math resources for parents,
151147 3 families, and educators to assist with intervention and
152148 4 enrichment opportunities and instructional strategies.
153149 5 (b) Not later than July 1, 2024, the department shall post the
154150 6 resources created and identified under subsection (a)(3) on the
155151 7 department's website.
156152 8 (c) Not later than December 1, 2024, the department shall
157153 9 submit a plan to the legislative council in an electronic format
158154 10 under IC 5-14-6 that includes:
159155 11 (1) strategies for the early identification of students who are
160156 12 at risk of not meeting grade level proficiency in mathematics;
161157 13 and
162158 14 (2) recommendations for high quality intervention policies for
163159 15 mathematics that focus on:
164160 16 (A) providing data driven, systematic small group or
165161 17 individualized instruction focused on building student
166162 18 understanding through mathematical learning
167-19 progressions;
168-20 (B) using materials aligned to daily core instruction; and
169-21 (C) using evidence based instructional strategies to
170-22 promote:
171-23 (i) conceptual understanding;
172-24 (ii) procedural fluency; and
173-25 (iii) real world problem solving.
174-26 This subsection expires July 1, 2025.
175-27 SECTION 3. IC 20-20-43-4, AS AMENDED BY P.L.73-2019,
176-28 SECTION 4, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
177-29 JULY 1, 2024]: Sec. 4. (a) As used in this section, "literacy coach"
178-30 has the meaning set forth in IC 20-20-49-3.2.
179-31 (b) After June 30, 2017, a school corporation or charter school may
180-32 receive a grant to implement the following:
181-33 (1) The System for Teacher and Student Advancement (TAP)
182-34 teacher performance model program.
183-35 (2) The Opportunity Culture teacher performance model.
184-36 (3) A model teacher performance program approved by a national
185-37 school employee organization.
186-38 (4) A teacher performance model program that includes the
187-39 implementation of all the following elements:
188-40 (A) A comprehensive pay progression for teacher leaders
189-41 based on demonstrated skill development, escalating levels of
190-42 responsibility and duties, and demonstrated academic

164+20 (B) using evidence based instructional strategies to
165+21 promote:
166+22 (i) conceptual understanding;
167+23 (ii) procedural fluency; and
168+24 (iii) real world problem solving.
169+25 This subsection expires July 1, 2025.

212-21 (H) Evidence of teacher support for the proposed teacher
213-22 leadership and pay system, including support from the local
214-23 school employee organization (if applicable).
215-24 (I) Plans for ongoing evaluation of the pay system.
216-25 (J) A sustainable pay system.
217-26 (K) A plan for how teacher leadership positions and ongoing
218-27 training for teacher leaders will improve student achievement.
219-28 (5) The Indiana education residency pilot program established in
220-29 IC 20-20-44.
221-30 (6) A literacy coaching model program that includes and
222-31 implements the following elements:
223-32 (A) A system that supports literacy coaches by
224-33 incentivizing the following:
225-34 (i) Mentoring and training of literacy coaches.
226-35 (ii) Reducing literacy coaching loads or providing release
227-36 time for literacy coaches to support professional
228-37 learning.
229-38 (iii) Reviewing professional portfolios and student
230-39 performance.
231-40 (B) Connection to high quality professional development,
232-41 including release time for literacy coaches providing
233-42 professional development and instructional coaching, that

226+39 (B) Connection to high quality professional development,
227+40 including release time for literacy coaches providing
228+41 professional development and instructional coaching, that
229+42 provides literacy coaches with the knowledge and skills

235-1 provides literacy coaches with the knowledge and skills
236-2 needed to advance the learning of teachers, administrators,
237-3 and students.
238-4 (b) (c) To receive a grant, a:
239-5 (1) school corporation, in consultation with the school
240-6 corporation's school employee organization; or
241-7 (2) charter school, in consultation with the charter school's school
242-8 employee organization (if applicable);
243-9 shall apply for the grant in a manner prescribed by the department. The
244-10 department shall establish eligibility requirements. However, the
245-11 department may not award grants to more than thirty (30) school
246-12 corporations or charter schools during any school year. When awarding
247-13 grants under this chapter, the department shall select a geographically
248-14 diverse set of school corporations and charter schools, including school
249-15 corporations and charter schools located in urban, suburban, and rural
250-16 areas.
251-17 (c) (d) A school corporation or charter school that is awarded a
252-18 grant under this chapter shall receive a grant for three (3) consecutive
253-19 school years. The amount of the grant may not exceed the costs
254-20 incurred by the school corporation or charter school to implement the
255-21 program. A school corporation or charter school may receive a
256-22 matching grant from a corporation, foundation, or any other entity in
257-23 addition to a grant awarded under this chapter.
258-24 SECTION 4. IC 20-20-49-3.2 IS ADDED TO THE INDIANA
259-25 CODE AS A NEW SECTION TO READ AS FOLLOWS
260-26 [EFFECTIVE JULY 1, 2024]: Sec. 3.2. (a) This subsection applies
261-27 before July 1, 2027. As used in this chapter, "literacy coach" refers
262-28 to an individual whose primary responsibility is to provide literacy
263-29 training and support to administrators and teachers. This
264-30 subsection expires July 1, 2027.
265-31 (b) This subsection applies after June 30, 2027. As used in this
266-32 chapter, "literacy coach" means an individual:
267-33 (1) whose primary responsibility is to provide literacy
268-34 training and support to administrators and teachers; and
269-35 (2) who has received the literacy endorsement described in
270-36 IC 20-28-5-19.7.

300-23 (B) tutoring;
301-24 in the context of modeling and coaching in or outside of a
302-25 teacher's classroom.
303-26 SECTION 6. IC 20-20-49-4, AS ADDED BY P.L.250-2023,
304-27 SECTION 10, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
305-28 JULY 1, 2024]: Sec. 4. Money allocated for grants under this chapter
306-29 must be used for the following:
307-30 (1) Placing literacy instructional coaches in elementary schools
308-31 for the purposes of training and supporting teachers and
309-32 administrators in order to improve instruction related to the
310-33 science of reading.
311-34 (2) Training teachers and school principals in instructional
312-35 practices aligned with the science of reading.
313-36 (3) Increasing instructional time, including summer literacy
314-37 programs or high-dosage tutoring, for students who have been
315-38 identified as struggling readers based on a diagnostic screening
316-39 authorized by the department under IC 20-35.5-2-2.
317-40 (4) Elementary schools and school corporations purchasing
318-41 curricular materials that:
319-42 (A) align with science of reading; and

327-7 department may, after June 30, 2024, award a grant under this chapter

338-18 (B) may include, if the school corporation or charter school is
339-19 requesting grant funds for the purpose described in section
340-20 4(3) or 4(4) of this chapter the following, as applicable:
341-21 (i) Increasing instructional time, including summer literacy
342-22 programs or high-dosage tutoring, for students who have
343-23 been identified as struggling readers based on a diagnostic
344-24 screening authorized by the department under
345-25 IC 20-35.5-2-2.
346-26 (ii) Elementary schools and school corporations purchasing
347-27 curricular materials that align with the science of reading
348-28 and receive approval by the department.
349-29 (3) Submits the following information:
350-30 (A) Evidence supporting the school corporation's or charter
351-31 school's plan under subdivision (2).
352-32 (B) The number of elementary school teachers and literacy
353-33 instructional coaches employed by the school corporation or
354-34 charter school.
355-35 (C) Any other pertinent information required by the
356-36 department.
357-37 (b) Any instruction under a plan that includes increasing
358-38 instructional time as described in subsection (a)(2)(B)(i) must align
359-39 with the science of reading.
360-40 SECTION 8. IC 20-20-49-6, AS ADDED BY P.L.250-2023,
361-41 SECTION 10, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
362-42 JULY 1, 2024]: Sec. 6. Upon review of applications received under

376-13 AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE
377-14 JULY 1, 2024]:
378-15 Chapter 50. Mastery Based Education Program
379-16 Sec. 1. As used in this chapter, "dedicated lead partner" means
380-17 an experienced and specialized individual or entity that provides
381-18 assistance in implementing mastery based education in a school.
382-19 Sec. 2. As used in this chapter, "mastery" means evidenced
383-20 attainment of predefined, rigorous learning objectives that:
384-21 (1) are transferable; and
385-22 (2) qualify a student for advancement to subsequent
386-23 educational levels or competencies.
387-24 Sec. 3. As used in this chapter, "mastery based education"
388-25 means an innovative, learner centered approach to teaching and
389-26 learning that focuses on the mastery of specific skills or knowledge
390-27 areas rather than the amount of time spent in a classroom.
391-28 Sec. 4. As used in this chapter, "program" refers to the mastery
392-29 based education program established by section 5 of this chapter.
393-30 Sec. 5. (a) The mastery based education program is established
394-31 to support a school corporation or charter school that is selected by
395-32 the department under subsection (b) in implementing mastery
396-33 based education.
397-34 (b) The department:
398-35 (1) shall administer the program; and
399-36 (2) may select:
400-37 (A) school corporations;
401-38 (B) charter schools; or
402-39 (C) both school corporations and charter schools;
403-40 that meet the requirements under this chapter to participate
404-41 in the program.
405-42 Sec. 6. (a) To apply for participation in the program, a school
360+1 corporations and charter schools subject to available money and in
361+2 accordance with the following priorities:
362+3 (1) To the extent possible, to achieve geographic balance

414-8 school participating in the program.
415-9 (2) Review annually the masteries established under
416-10 subdivision (1) and, as applicable, do the following:
417-11 (A) Amend or remove masteries.
418-12 (B) Establish new common masteries.
419-13 (3) Create criteria for masteries that are, when applicable,
420-14 transferable among different subject areas and courses to
421-15 ensure that a mastery can satisfy multiple requirements.
422-16 (b) The department may consult with any of the following
423-17 regarding establishing and reviewing masteries and creating
424-18 criteria under subsection (a):
425-19 (1) Dedicated lead partners.
426-20 (2) School corporations and charter schools participating in
427-21 the program.
428-22 (3) Any other individual or entity, as determined by the
429-23 department.
430-24 (c) The department may request information from a school
431-25 corporation or charter school participating in the program for the
432-26 purpose of assessing the effectiveness of the program.
433-27 (d) A school corporation or charter school shall respond to a
434-28 request for information under subsection (c) in a form, manner,
435-29 and frequency determined by the department.
436-30 Sec. 8. (a) Except as provided under subsections (b) and (c), a
437-31 school maintained by a school corporation or charter school that
438-32 participates in the program is exempt from all requirements of this
439-33 title except for requirements under this chapter or requirements
440-34 established under federal law.
441-35 (b) A school described in subsection (a) is not exempt from the
442-36 following:
443-37 (1) Any of the nonwaivable provisions listed under
444-38 IC 20-31-4.1-7.
445-39 (2) IC 20-30-5.6.
446-40 (3) IC 20-30-2.
447-41 (c) The department may require a school described in
448-42 subsection (a) to comply with any requirements described in
403+1 manner established by the department.
404+2 (b) The department shall approve or deny an application
405+3 submitted by a school corporation or charter school under this
406+4 section.

442+40 (c) The department may require a school described in
443+41 subsection (a) to comply with any requirements described in
444+42 subsection (a) if the department determines that the school is not

450-1 subsection (a) if the department determines that the school is not
451-2 meeting academic performance expectations.
452-3 Sec. 9. The state board may adopt rules under IC 4-22-2
453-4 necessary to implement this chapter.
454-5 Sec. 10. On or before December 1, 2026, the budget committee
455-6 shall review the program, and the department shall make a
456-7 presentation to the budget committee regarding the progress and
457-8 results of the program.
458-9 Sec. 11. This chapter expires June 30, 2027.
459-10 SECTION 10. IC 20-28-3-1, AS AMENDED BY P.L.170-2023,
460-11 SECTION 16, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
461-12 JULY 1, 2024]: Sec. 1. (a) As used in this section, "teacher candidate"
462-13 means an individual recommended for an initial teaching license from
463-14 a teacher preparation program located in Indiana.
464-15 (b) As used in this section, "teacher preparation program" includes,
465-16 but is not limited to, the following:
466-17 (1) A teacher education school or department.
467-18 (2) A transition to teaching program under IC 20-28-4.
468-19 (3) Any other entity approved by the department to offer a course
469-20 of study leading to an initial teaching license.
470-21 (c) The department shall:
471-22 (1) arrange a statewide system of professional instruction for
472-23 teacher education;
473-24 (2) accredit and review teacher preparation programs that comply
474-25 with the rules of the department;
475-26 (3) approve content area licensure programs for particular kinds
476-27 of teachers in accredited teacher preparation programs; and
477-28 (4) specify the types of licenses for individuals who complete
478-29 programs of approved courses.
479-30 (d) The department shall work with teacher preparation programs to
480-31 develop a system of teacher education that ensures individuals who
481-32 complete teacher preparation programs are able to meet the highest
482-33 professional standards.
483-34 (e) Before July 1, 2015, the department shall establish standards for
484-35 the continuous improvement of program processes and the performance
485-36 of individuals who complete teacher preparation programs. The state
486-37 board shall adopt rules containing the standards not later than two
487-38 hundred seventy (270) days after the department finishes the standards.
488-39 (f) The standards established under subsection (e) must include
489-40 benchmarks for performance, including test score data for each teacher
490-41 preparation entity on content area licensure tests and test score data for
491-42 each teacher preparation entity on pedagogy licensure tests.

447+2 (d) A school described in subsection (a) is subject to collective
448+3 bargaining under IC 20-29 unless the school corporation
449+4 authorizes the school to opt out of collective bargaining or, if the
450+5 school is a charter school, the school opts out of collective
451+6 bargaining.
452+7 Sec. 9. The state board may adopt rules under IC 4-22-2
453+8 necessary to implement this chapter.
454+9 Sec. 10. On or before December 1, 2026, the budget committee

499-7 on the teacher preparation program's website. In addition to reporting
500-8 performance, each teacher preparation program must report to the
501-9 department the following:
502-10 (1) The attrition, retention, and completion rates of teacher
503-11 candidates for the previous three (3) calendar years. The teacher
504-12 preparation program must also provide underlying data, as
505-13 determined by the department, used as part of calculating the
506-14 teacher preparation program's retention rates.
507-15 (2) The number of teacher candidates in each content area who
508-16 complete the teacher preparation program during the year,
509-17 disaggregated by ranges of cumulative grade point averages.
510-18 (3) The number of teacher candidates in each content area who,
511-19 during the year:
512-20 (A) do not pass a content area licensure examination; and
513-21 (B) do not retake the content area licensure examination.
514-22 (h) In making information available to the public on the
515-23 department's website, the department shall include in the report under
516-24 subsection (g), in addition to the matrix ratings described in subsection
517-25 (i), the following information:
518-26 (1) Average scaled or standard scores of teacher candidates who
519-27 complete teacher preparation programs on basic skills, content
520-28 area, and pedagogy licensure examinations.
521-29 (2) The average number of times teacher candidates who
522-30 complete a teacher preparation program take each licensing test
523-31 before receiving a passing score and the percentage of teacher
524-32 candidates who receive a passing score on each licensing test on
525-33 the teacher candidates' first attempts.
526-34 (i) Not later than July 30, 2016, the department and the commission
527-35 for higher education, in conjunction with the state board, the
528-36 Independent Colleges of Indiana, Inc., and teacher preparation
529-37 programs, shall establish a matrix rating system for teacher preparation
530-38 programs based on the performance of the programs as demonstrated
531-39 by the data collected under subsections (g) and (h). The matrix rating
532-40 system may not rank or compare teacher preparation programs. The
533-41 matrix rating system must be based on data collected for teachers who
534-42 initially receive their teaching license during the previous three (3)

542-7 standards, for teacher preparation programs accredited by the
543-8 Council for the Accreditation of Educator Preparation;
544-9 (2) rigorous academic entry requirements for admission into a
545-10 teacher preparatory program that are equivalent to the minimum
546-11 academic requirements determined by the Council for the
547-12 Accreditation of Educator Preparation, for teacher preparation
548-13 programs that are not accredited by the Council for the
549-14 Accreditation of Educator Preparation; or
550-15 (3) the Association for Advancing Quality in Educator
551-16 Preparation standards, for teacher preparation programs
552-17 accredited by the Association for Advancing Quality in Educator
553-18 Preparation.
554-19 The department shall include information reported to the department
555-20 on the department's website.
556-21 (k) Not later than July 30, 2016, the department and the commission
557-22 for higher education, in conjunction with the state board, the
558-23 Independent Colleges of Indiana, Inc., and teacher preparation
559-24 programs, shall establish a minimum rating under the matrix rating
560-25 system established under subsection (i) that teacher preparation
561-26 programs must achieve to avoid referral under subsection (l).
562-27 (l) Not later than July 1 of each year, the department shall submit a
563-28 list of teacher preparation programs that do not meet the minimum
564-29 rating established under subsection (k) or the requirements of section
565-30 3.1 of this chapter to the commission for higher education and the
566-31 Independent Colleges of Indiana, Inc. for one (1) of the following
567-32 actions:
568-33 (1) In the case of a state educational institution, the commission
569-34 for higher education shall place the teacher preparation program
570-35 on an improvement plan with clear performance goals and a
571-36 designated period in which the performance goals must be
572-37 achieved.
573-38 (2) In the case of a proprietary postsecondary educational
574-39 institution, the commission for higher education shall recommend
575-40 to the teacher preparation program an improvement plan with
576-41 clear performance goals and a designated period in which the
577-42 performance goals should be achieved.

556+25 (k) Not later than July 30, 2016, the department and the commission
557+26 for higher education, in conjunction with the state board, the
558+27 Independent Colleges of Indiana, Inc., and teacher preparation
559+28 programs, shall establish a minimum rating under the matrix rating
560+29 system established under subsection (i) that teacher preparation
561+30 programs must achieve to avoid referral under subsection (l).
562+31 (l) Not later than July 1 of each year, the department shall submit a
563+32 list of teacher preparation programs that do not meet the minimum
564+33 rating established under subsection (k) or the requirements of section
565+34 3.1 of this chapter to the commission for higher education and the
566+35 Independent Colleges of Indiana, Inc. for one (1) of the following
567+36 actions:
568+37 (1) In the case of a state educational institution, the commission
569+38 for higher education shall place the teacher preparation program
570+39 on an improvement plan with clear performance goals and a
571+40 designated period in which the performance goals must be
572+41 achieved.
573+42 (2) In the case of a proprietary postsecondary educational

579-1 (3) In the case of a nonprofit college or university, the
580-2 Independent Colleges of Indiana, Inc., shall coordinate a peer
581-3 review process to make recommendations to the peer institution
582-4 in achieving the department's performance metrics.
583-5 (m) The department shall approve at least two (2) accreditors that:
584-6 (1) accredit teacher preparation programs; and
585-7 (2) are recognized by the Council for Higher Education
586-8 Accreditation;
587-9 to accredit teacher preparation programs for use in Indiana.
588-10 (n) Not later than December 31, 2024, the department and the
589-11 commission for higher education, in conjunction with the state
590-12 board, shall partner with teacher preparation programs to receive
591-13 an outside evaluation by a nationally recognized nonprofit,
592-14 nonpartisan organization that leverages evidence based approaches
593-15 on the science of reading to evaluate teacher preparation reading
594-16 instruction programs.
595-17 SECTION 11. IC 20-28-3-3.2 IS ADDED TO THE INDIANA

608-30 content that prepares elementary school teacher candidates to:
609-31 (1) effectively teach foundational math skills explicitly and
610-32 systematically;
611-33 (2) implement math instruction using high quality
612-34 instructional material; and
613-35 (3) understand and use student data to make instructional
614-36 decisions.
615-37 SECTION 12. IC 20-28-5-19.7, AS AMENDED BY SEA 1-2024,
616-38 SECTION 5, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
617-39 JULY 1, 2024]: Sec. 19.7. (a) Not later than July 1, 2024, the state
618-40 board shall establish and require a literacy endorsement for individuals
619-41 first licensed after June 30, 2025, to teach a content area involving

623-2 (b) Except as provided in section 19.8(a) of this chapter, beginning
624-3 July 1, 2027, the department may not renew a practitioner license or an
625-4 accomplished practitioner license, or a comparable license under prior
626-5 rules, issued to an individual who, based on the content area for which
627-6 the individual is licensed, including special education, provides literacy
628-7 instruction to students in prekindergarten through grade 5 unless the
629-8 individual receives a literacy endorsement under this section.
630-9 (c) To be eligible to receive a literacy endorsement, an individual
631-10 must meet the following:
632-11 (1) Complete eighty (80) hours of evidence based professional
633-12 development that is:
634-13 (A) aligned to the science of reading; and
635-14 (B) provided by an organization that is:
636-15 (i) accredited by the International Dyslexia Association;
637-16 or
638-17 (ii) aligned with Knowledge and Practice Standards for
639-18 Teachers of Reading (KPS); and
640-19 (B) (C) approved by the department.
641-20 (2) Demonstrate proficiency in scientifically based reading
642-21 instruction skills aligned to the science of reading on a written
643-22 examination or through other procedures prescribed by the
644-23 department in accordance with this section.
645-24 (d) The eighty (80) hours of evidence based professional
646-25 development required under subsection (c)(1) must provide
647-26 individualized and on demand support. The evidence based
648-27 professional development required under subsection (c)(1) must:
649-28 (1) promote explicit, systematic, and cumulative instruction as the
650-29 primary approach to literacy instruction;
651-30 (2) align with both word recognition and language
652-31 comprehension;
653-32 (2) (3) promote an understanding of how language, reading, and
654-33 writing relate to each other;
655-34 (3) (4) promote strategies for differentiated instruction for:
656-35 (A) students with:
657-36 (i) reading difficulties; or
658-37 (ii) disabilities; and
659-38 (B) English language learners;
660-39 (4) (5) focus on phonemic awareness, phonics, fluency,
661-40 vocabulary, and comprehension; and
662-41 (5) (6) allow participants to implement the strategies into a
663-42 classroom environment with the opportunity for feedback
618+1 [EFFECTIVE JULY 1, 2024]: Sec. 28. (a) As used in this section,
619+2 "visiting teacher" means a citizen of another country who:
620+3 (1) is or will be visiting the United States; and
621+4 (2) is employed as a teacher at a school corporation in
622+5 Indiana.
623+6 (b) The department may issue a visiting teacher license only to
624+7 a visiting teacher who has successfully completed an educational
625+8 training program from an accredited institution.
626+9 (c) A visiting teacher license issued to a visiting teacher must be
627+10 a five (5) year nonrenewable license.
628+11 SECTION 13. IC 20-33-2-13, AS AMENDED BY P.L.160-2023,

640+23 SECTION 14. IC 20-36-5-1, AS AMENDED BY P.L.10-2019,
641+24 SECTION 88, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
642+25 JULY 1, 2024]: Sec. 1. A student shall receive credits toward
643+26 graduation or an Indiana diploma with a Core 40 with academic honors
644+27 designation by demonstrating the student's proficiency in a course or
645+28 subject area required for graduation or the Indiana diploma with a Core
646+29 40 with academic honors designation, whether or not the student has
647+30 completed course work in the subject area, by any one (1) or more of
648+31 the following methods:
649+32 (1) Receiving a score that demonstrates proficiency on a
650+33 standardized assessment of academic or subject area competence
651+34 that is accepted by accredited postsecondary educational
652+35 institutions.
653+36 (2) Successfully completing a similar course at an eligible
654+37 institution under the postsecondary enrollment program under
655+38 IC 21-43-4.
656+39 (3) Receiving a score of three (3), four (4), or five (5) on an
657+40 advanced placement examination for a course or subject area.
658+41 (4) Receiving a score of E(e) or higher on a Cambridge
659+42 International Advanced A or AS level examination for a course or

665-1 throughout the professional development experience.
666-2 (e) The written examination required under subsection (c)(2) shall
667-3 ensure the individual demonstrates the ability to:
668-4 (1) effectively teach foundational reading skills, phonemic
669-5 awareness, phonics, fluency, vocabulary, and comprehension;
670-6 (2) implement reading instruction using high quality instructional
671-7 materials aligned to the science of reading; and
672-8 (3) provide effective instruction and interventions for students
673-9 with reading deficiencies.
674-10 (f) The department shall approve and provide the evidence based
675-11 professional development necessary for an individual to receive a
676-12 literacy endorsement under this section.
677-13 (g) The department shall establish the procedure for an existing
678-14 teacher to add the literacy endorsement established under this section
679-15 to the teacher's license.
680-16 (h) The state board shall adopt rules under IC 4-22-2 to do the
681-17 following:
682-18 (1) Adopt, validate, and implement the examination or other
683-19 procedures required by subsection (c)(2).
684-20 (2) Establish examination scores indicating proficiency.
685-21 (3) Otherwise carry out the purposes of this section.
686-22 SECTION 13. IC 20-28-5-28 IS ADDED TO THE INDIANA

683+23 honors designation.
684+24 (c) If a high school student who takes an International
685+25 Baccalaureate examination receives a score of four (4) or higher on
686+26 the examination, the student is entitled to receive postsecondary
687+27 level academic credit at a state educational institution that counts
688+28 toward meeting the student's degree requirements if the elective
689+29 credit is part of the student's degree requirements.
690+30 (d) A state educational institution may require a score higher
691+31 than a score of four (4) on an International Baccalaureate
692+32 examination if the credit is to be used for meeting a course
693+33 requirement for a particular major at the state educational
694+34 institution.
695+35 SECTION 16. [EFFECTIVE JULY 1, 2024] (a) 511 IAC 16-2-5(a)

841770 IC 4-13-1-4 and other expenses actually incurred in connection
842771 with the member's duties as provided in the state polices and
843772 procedures established by the Indiana department of
844773 administration and approved by the budget agency.
845774 (c) A member of the committee who is a state employee is
846775 entitled to reimbursement for traveling expenses as provided under
847776 IC 4-13-1-4 and other expenses actually incurred in connection
848777 with the member's duties as provided in the state policies and
849778 procedures established by the Indiana department of
850779 administration and approved by the budget agency.
851780 (d) Expenses paid under this section shall be payable from

859788 Sec. 6. (a) After July 31, 2024, all qualified data collections must
860789 be expressly approved by the state board after it is has been
861790 reviewed by the committee under subsection (c) before schools and
862791 school corporations are required to submit the information to the
863792 state board or the department. The department may not require
864793 schools or school corporations to submit any qualified data
865794 collection unless the qualified data collection is approved by the
866795 state board under this subsection. The department shall maintain
867796 on its website a list of all qualified data collections approved by the
868797 state board and the deadline by which each school or school
869798 corporation shall submit the information.
870799 (b) After July 31, 2024, the state board and the department may
871800 not sanction, penalize, or in any way hold a school or school
872801 corporation accountable for failing to submit a qualified data
873802 collection report if the qualified data collection was not approved
874803 by the state board under subsection (a).
875804 (c) Not later than August 1, 2024, the committee, in consultation
876805 with the department, shall review current collection of:
877806 (1) qualified data from accredited schools; and
878807 (2) data collection by another public agency (as defined in
879808 IC 5-14-1.5-2) of the state from accredited schools.
880809 Based on the committee's review, the committee shall make
881810 recommendations to the state board whether to continue the
882811 qualified data collection and ways or methods to streamline
883812 qualified data collection and data collection by another public
884813 agency of the state from schools, including the development of a
885814 standardized school improvement plan template for use by school
886815 corporations to prepare school improvement plans. After
887816 submitting the committee's initial recommendations regarding
888817 current qualified data and data collections to the state board, the
889818 committee shall review qualified data collection requests made by
890819 the department and the state board after July 31, 2024, and make
891820 recommendations to the state board as to whether the qualified
892821 data collection is necessary or ways to streamline the qualified data
893822 collection. In addition, the committee shall review and make
894823 recommendations to the state board under subsection (d)
895824 regarding methods to streamline school safety and discipline
896825 reporting requirements as well as establishing a streamlined
897826 method to uniformly and consistently report instances of bullying
898827 throughout Indiana. The committee may not change the data
899828 reporting requirements for data used by the state board to place
900829 each school in a category or designation of school performance

902831 under IC 20-31-8-4.
903832 (d) The committee shall submit its recommendations under
904833 subsection (c) to the state board. Upon receipt of the committee's

906835 disapprove the qualified data request or recommendations. The
907836 decision of the state board is final. The state board shall consider
908837 the committee's recommendations at the state board's next meeting
909838 after receiving the committee's recommendations under subsection
910839 (c).
911840 (e) The committee may recommend the collection of qualified
912841 data under subsection (c) and the state board may approve the
913842 recommendation under subsection (d) only if the:
914843 (1) qualified data is not available to the public agency
915844 requesting the information from any other source; and
916845 (2) benefit from the collection of the qualified data is greater
917846 than the overall administrative cost of collecting the qualified
918847 data.
919848 Sec. 7. (a) Before December 1, 2024, the state board, in
920849 consultation with the department and based upon
921850 recommendations by the committee, shall review all statutory
922851 reporting requirements and qualified data collection and data
923852 collection by various public agencies (as defined in IC 5-14-1.5-2)
924853 of the state and shall submit a report to the governor and, in an
925854 electronic format under IC 5-14-6, to the general assembly. The
926855 report must include the following:
927856 (1) A detailed description of actions that will be taken by the
928857 state board and the department to reduce the amount of
929858 information schools or school corporations must report to the
930859 state.
931860 (2) A detailed summary describing the actions taken by the
932861 department and the state board to combine, streamline, or
933862 eliminate duplicative data or information requests from
934863 schools and school corporations.
935864 (3) A detailed description of how the state board is working
936865 with other public agencies of the state to minimize or
937866 streamline data collection by those agencies.
938867 (4) Specific legislative recommendations to the general
939868 assembly necessary to eliminate duplicative data reporting
940869 and any recommended legislative changes that would make
941870 school data reporting to various public agencies of the state
942871 more efficient and cost effective.
943872 (b) Before December 1, 2025, the state board shall submit an

945874 updated report to the governor and, in an electronic format under
946875 IC 5-14-6, to the general assembly containing the progress of the
947876 state board and the department to eliminate duplicative data

950879 data reporting to the state that was not included in the state
951880 board's report submitted under subsection (a).
952881 Sec. 8. (a) After June 30, 2024, all reports required to be
953882 submitted to a public agency (as defined in IC 5-14-1.5-2) of the
954883 state by accredited schools must be collected electronically and
955884 must be collected through one (1) regularly scheduled consolidated
956885 report that is collected no more frequently than on a quarterly
957886 basis through an electronic data base administered by the
958887 department established by rule under IC 4-22-2.
959888 (b) This section does not apply to:
960889 (1) any collection of data if the office of management and
961890 budget has approved a waiver of the application of this
962891 section;
963892 (2) tax reporting;
964893 (3) an investigation authorized by federal or state statute or
965894 regulation; or
966895 (4) testing material.
967896 Sec. 9. The state board may adopt rules under IC 4-22-2
968897 necessary to administer this chapter.

1004933 in the context of modeling and coaching in or outside of a
1005934 teacher's classroom.
1006935 (c) A literacy coach shall not be assigned a regular classroom

1026955 based education program established by section 5 of this chapter.
1027956 Sec. 5. (a) The mastery based education program is established
1028957 to allow a school corporation or charter school that is selected by
1029958 the department under subsection (b) to implement mastery based

1031960 education in:
1032961 (1) one (1) or more schools maintained by the school
1033962 corporation; or
1034963 (2) the charter school.

1039968 (B) charter schools; or
1040969 (C) both school corporations and charter schools;
1041970 that meet the requirements under section 6 of this chapter to
1042971 participate in the program.
1043972 Sec. 6. (a) To apply for participation in the program, a school
1044973 corporation or charter school shall do the following:
1045974 (1) Apply on a form and in a manner established by the
1046975 department.
1047976 (2) Submit to the department a plan for the establishment and
1048977 implementation of mastery based education in the school
1049978 corporation or charter school that:
1050979 (A) meets the requirements of section 7 of this chapter; and
1051980 (B) includes specific measurable goals or student outcomes
1052981 the school corporation or charter school intends to achieve.
1053982 (b) The department shall approve or deny a plan submitted by
1054983 a school corporation or charter school under this section.
1055984 Sec. 7. Mastery based education implemented by a school
1056985 corporation or charter school under this chapter must meet the
1057986 following requirements:
1058987 (1) A student participating in the mastery based education
1059988 must:
1060989 (A) advance based upon mastery of the subject matter and
1061990 not based on time in a classroom;
1062991 (B) receive timely, differentiated support based on the
1063992 student's individual learning needs; and
1064993 (C) be empowered daily to make important decisions
1065994 about:
1066995 (i) the student's learning experiences and learning
1067996 environment;
1068997 (ii) how the student will create and apply knowledge; and
1069998 (iii) how the student will demonstrate learning.
1070999 (2) Standards in the mastery based education must be broken
10711000 down into masteries that include rigorous, clear, measurable,
10721001 and transferable learning objectives that empower students.

10741003 (3) Assessments administered under the mastery based
10751004 education must focus on evaluating skills and not on
10761005 memorization.
10771006 (4) Learning outcomes for the mastery based education must

10801009 (B) the development of work ready skills.
10811010 Sec. 8. If a student:
10821011 (1) obtains a credit for mastery based education; and
10831012 (2) subsequently transfers to another school corporation or
10841013 charter school in Indiana;
10851014 the school corporation or charter school to which the student
10861015 transfers shall count the credit by a previous school corporation or
10871016 charter school that the student attended toward the student's
10881017 graduation requirements.
10891018 Sec. 9. (a) The department may do the following:
10901019 (1) Establish common masteries that may be used by each
10911020 school participating in the program.
10921021 (2) Review annually the masteries established under
10931022 subdivision (1) and, as applicable, do the following:
10941023 (A) Amend or remove masteries.
10951024 (B) Establish new common masteries.
10961025 (3) Create criteria for masteries that are, when applicable,
10971026 transferable among different subject areas and courses to
10981027 ensure that a mastery can satisfy multiple requirements.
10991028 (b) The department may consult with any of the following
11001029 regarding establishing and reviewing masteries and creating
11011030 criteria under subsection (a):
11021031 (1) Approved dedicated lead partners.
11031032 (2) School corporations and charter schools participating in
11041033 the program.
11051034 (3) Any other individual or entity, as determined by the
11061035 department.
11071036 (c) The department may request information from a school
11081037 corporation or charter school participating in the program for the
11091038 purpose of assessing the effectiveness of the program.
11101039 (d) A school corporation or charter school shall respond to a
11111040 request for information under subsection (c) in a form, manner,
11121041 and frequency determined by the department.
11131042 Sec. 10. The department shall do the following:
11141043 (1) Approve dedicated lead partners that a school corporation
11151044 or charter school participating in the program may contract

11171046 with in accordance with this chapter.
11181047 (2) Create and maintain a list of the approved dedicated lead
11191048 partners on the department's website.
11201049 Sec. 11. The commission for higher education shall work with
11211050 school corporations and charter schools participating in the
11221051 program to ensure that:
11231052 (1) credits earned through the program are included on the
11241053 student's high school transcript; and
11251054 (2) a student enrolled in the program has access to early
11261055 college credit.
11271056 Sec. 12. (a) Except as provided under subsections (b) and (c), a
11281057 school maintained by a school corporation or charter school that
11291058 participates in the program:
11301059 (1) is exempt from all requirements of this title except for
11311060 requirements under this chapter or requirements established
11321061 under federal law; and
11331062 (2) may not award graduation waivers under IC 20-32-3 or
11341063 IC 20-32-5.1.
11351064 (b) A school described in subsection (a) is not exempt from the
11361065 following:
11371066 (1) Except as provided under subsection (d), any of the
11381067 nonwaivable provisions listed under IC 20-31-4.1-7.
11391068 (2) IC 20-30-5.6.
11401069 (3) IC 20-30-2.
11411070 (c) The department may require a school described in
11421071 subsection (a) to comply with any requirements described in
11431072 subsection (a)(1) if the department determines that the school is not
11441073 meeting the specific measurable goals or student outcomes
11451074 submitted in the school corporation's or charter school's plan
11461075 under section 6(a) of this chapter.
11471076 (d) A school described in subsection (a) is subject to collective
11481077 bargaining under IC 20-29 unless the school corporation
11491078 authorizes the school to opt out of collective bargaining or, if the
11501079 school is a charter school, the school opts out of collective
11511080 bargaining.
11521081 Sec. 13. Not later than November 1, 2025, and not later than
11531082 November 1 each year thereafter, the department shall:
11541083 (1) compile and prepare a report that includes information
11551084 regarding the program; and
11561085 (2) submit the report to the legislative council in an electronic
11571086 format under IC 5-14-6.

14031332 [EFFECTIVE JULY 1, 2024]: Sec. 3.2. (a) This subsection applies

14281357 (C) comprehensive intervention reading programs;
14291358 are implemented with fidelity.
14301359 (6) Training teachers to diagnose and address a reading
14311360 deficiency.
14321361 (7) Working with teachers in applying evidence based reading
14331362 strategies in other content areas, including:
14341363 (A) prioritizing time spent on those teachers;
14351364 (B) activities and roles that will have the greatest impact
14361365 on student achievement; and
14371366 (C) prioritizing coaching and mentoring in classrooms.
14381367 (8) Helping to increase instructional density to meet the needs
14391368 of all students.
14401369 (9) Working with students through:
14411370 (A) whole and small group instruction; or
14421371 (B) tutoring;
14431372 in the context of modeling and coaching in or outside of a

15391468 the examination, the student is entitled to receive postsecondary
15401469 level academic credit at a state educational institution that counts
15411470 toward meeting the student's degree requirements if the elective
15421471 credit is part of the student's degree requirements.
15431472 (d) A state educational institution may require a score higher
15441473 than a score of four (4) on an International Baccalaureate
15451474 examination if the credit is to be used for meeting a course
15461475 requirement for a particular major at the state educational
15471476 institution.".

1605-(c) To be eligible to receive a literacy endorsement, an individual

1607-(1) Complete eighty (80) hours of evidence based professional
1608-development that is:
1609-(A) aligned to the science of reading; and
1610-(B) provided by an organization that is:
1611-(i) accredited by the International Dyslexia Association;
1612-or
1613-(ii) aligned with Knowledge and Practice Standards for
1614-Teachers of Reading (KPS); and
1615-(B) (C) approved by the department.
1616-(2) Demonstrate proficiency in scientifically based reading
1617-instruction skills aligned to the science of reading on a written
1618-examination or through other procedures prescribed by the
1619-department in accordance with this section.
1620-(d) The eighty (80) hours of evidence based professional
1621-development required under subsection (c)(1) must provide
1622-individualized and on demand support. The evidence based
1623-professional development required under subsection (c)(1) must:
1624-(1) promote explicit, systematic, and cumulative instruction as the
1625-primary approach to literacy instruction;
1626-(2) align with both word recognition and language
1627-comprehension;
1628-(2) (3) promote an understanding of how language, reading, and
1629-writing relate to each other;
1630-(3) (4) promote strategies for differentiated instruction for:
1631-(A) students with:
1632-(i) reading difficulties; or
1633-(ii) disabilities; and
1634-(B) English language learners;
1635-(4) (5) focus on phonemic awareness, phonics, fluency,
1636-vocabulary, and comprehension; and
1637-(5) (6) allow participants to implement the strategies into a
1638-classroom environment with the opportunity for feedback
1639-throughout the professional development experience.
1640-(e) The written examination required under subsection (c)(2) shall
1641-ensure the individual demonstrates the ability to:
1642-(1) effectively teach foundational reading skills, phonemic
1643-awareness, phonics, fluency, vocabulary, and comprehension;

1645-(2) implement reading instruction using high quality instructional
1646-materials aligned to the science of reading; and
1647-(3) provide effective instruction and interventions for students
1648-with reading deficiencies.
1649-(f) The department shall approve and provide the evidence based
1650-professional development necessary for an individual to receive a
1651-literacy endorsement under this section.
1652-(g) The department shall establish the procedure for an existing
1653-teacher to add the literacy endorsement established under this section
1654-to the teacher's license.
1655-(h) The state board shall adopt rules under IC 4-22-2 to do the
1656-following:
1657-(1) Adopt, validate, and implement the examination or other
1658-procedures required by subsection (c)(2).
1659-(2) Establish examination scores indicating proficiency.
1660- (3) Otherwise carry out the purposes of this section.".
