15	15	savings to the state employee health plan; and (2) identify opportunities

17	17	providers about appropriate and necessary treatment.

33	33	A BILL FOR AN ACT to amend the Indiana Code concerning state
34	34	and local administration.
35	35	Be it enacted by the General Assembly of the State of Indiana:
36	36	1 SECTION 1. IC 5-10-8-27 IS ADDED TO THE INDIANA CODE
37	37	2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE
38	38	3 UPON PASSAGE]: Sec. 27. (a) As used in this section, "Choosing
39	39	4 Wisely initiative" means the initiative established by the American
40	40	5 Board of Internal Medicine Foundation that seeks to advance a
41	41	6 national dialogue on avoiding wasteful or unnecessary medical
42	42	7 tests, treatments, and procedures.
43	43	8 (b) As used in this section, "covered individual" means an
44	44	9 individual who is covered under a state employee health plan.
45	45	10 (c) As used in this section, "emerging therapies" means
46	46	11 therapeutic services that have not historically been covered by the
47	47	12 state employee health plan but for which new evidence may
48	48	13 demonstrate therapeutic enhancements or opportunities for cost
49	49	14 avoidance.
50	50	15 (d) As used in this section, "evidence" means peer reviewed
51	51	16 objective studies of emerging therapies.
52	52	17 (e) As used in this section, "regenerative injection therapy"

54	54	1 means a nonsurgical orthopedic treatment performed by injecting
55	55	2 into a joint or soft tissue a substance that stimulates the growth of
56	56	3 normal cells and tissues for the purpose of strengthening or
57	57	4 repairing a painful or injured joint or connective tissue.
58	58	5 (f) As used in this section, "state employee health plan" means
59	59	6 one (1) of the following:
60	60	7 (1) A self-insurance program established under section 7(b) of
61	61	8 this chapter.
62	62	9 (2) A contract with a prepaid health care delivery plan
63	63	10 entered into under section 7(c) of this chapter.
64	64	11 (g) Before January 1, 2025, the state personnel department shall
65	65	12 explore evidence supporting opportunities for benefit modification
66	66	13 of the state employee health plan informed by the following:
67	67	14 (1) The Choosing Wisely initiative.
68	68	15 (2) Emerging therapies.
69	69	16 (3) Therapeutic alternatives to invasive surgical procedures,
70	70	17 such as regenerative injection therapy.
71	71	18 (h) Before July 1, 2025, the state personnel department shall do
72	72	19 the following:
73	73	20 (1) Identify and consider implementation of pilot programs
74	74	21 that include step therapy or center of excellence approaches
75	75	22 for which evidence demonstrates cost savings to the state
76	76	23 employee health plan.
77	77	24 (2) Identify opportunities to stimulate conversations between
78	78	25 covered individuals and health care providers about
79	79	26 appropriate and necessary treatment, including treatment
80	80	27 recommendations identified by the Choosing Wisely initiative.
81	81	28 (i) This section expires July 1, 2026.
