26	26	A BILL FOR AN ACT to amend the Indiana Code concerning
27	27	insurance.
28	28	Be it enacted by the General Assembly of the State of Indiana:
29	29	1 SECTION 1. IC 5-10-8-15.5 IS ADDED TO THE INDIANA CODE
30	30	2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
31	31	3 1, 2024]: Sec. 15.5. (a) As used in this section, "covered individual"
32	32	4 means an individual who is:
33	33	5 (1) entitled to coverage under a state employee health plan;
34	34	6 and
35	35	7 (2) undergoing treatment for cancer.
36	36	8 (b) As used in this section, "scalp cooling item" means:
37	37	9 (1) a cooling cap;
38	38	10 (2) a hypothermia cap;
39	39	11 (3) a cold cap; and
40	40	12 (4) any other therapeutic device used to cool the scalp of an
41	41	13 individual to prevent or reduce hair loss during
42	42	14 chemotherapy.
43	43	15 (c) As used in this section, "state employee health plan" means
44	44	16 a:
45	45	17 (1) self-insurance program established under section 7(b) of
46	46	2024 IN 1341—LS 6831/DI 154 2
47	47	1 this chapter; or
48	48	2 (2) contract with a prepaid health care delivery plan that is
49	49	3 entered into or renewed under section 7(c) of this chapter;
50	50	4 to provide group health coverage. The term does not include a
51	51	5 dental or vision plan.
52	52	6 (d) A state employee health plan must provide coverage for
53	53	7 scalp cooling items for a covered individual.
54	54	8 SECTION 2. IC 27-8-24.5 IS ADDED TO THE INDIANA CODE
55	55	9 AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE
56	56	10 JULY 1, 2024]:
57	57	11 Chapter 24.5. Coverage for Scalp Cooling Items
58	58	12 Sec. 1. As used in this chapter, "insured" means an individual
59	59	13 who is:
60	60	14 (1) entitled to coverage under a policy of accident and sickness
61	61	15 insurance; and
62	62	16 (2) undergoing treatment for cancer.
63	63	17 Sec. 2. (a) As used in this chapter, "policy of accident and
64	64	18 sickness insurance" has the meaning set forth in IC 27-8-5-1.
65	65	19 (b) The term does not include the following:
66	66	20 (1) Accident only, credit, dental, vision, Medicare, Medicare
67	67	21 supplement, long term care, or disability income insurance.
68	68	22 (2) Coverage issued as a supplement to liability insurance.
69	69	23 (3) Automobile medical payment insurance.
70	70	24 (4) A specified disease policy.
71	71	25 (5) A limited benefit health insurance policy.
72	72	26 (6) A short term insurance plan that:
73	73	27 (A) may not be renewed; and
74	74	28 (B) has a duration of not more than six (6) months.
75	75	29 (7) A policy that provides a stipulated daily, weekly, or
76	76	30 monthly payment to an insured during hospital confinement,
77	77	31 without regard to the actual expense of the confinement.
78	78	32 (8) Worker's compensation or similar insurance.
79	79	33 (9) A student health insurance policy.
80	80	34 Sec. 3. As used in this section, "scalp cooling item" means:
81	81	35 (1) a cooling cap;
82	82	36 (2) a hypothermia cap;
83	83	37 (3) a cold cap; and
84	84	38 (4) any other therapeutic device used to cool the scalp of an
85	85	39 individual to prevent or reduce hair loss during
86	86	40 chemotherapy.
87	87	41 Sec. 4. A policy of accident and sickness insurance must provide
88	88	42 coverage for scalp cooling items for an insured.

91	91	2 CODE AS A NEW SECTION TO READ AS FOLLOWS
92	92	3 [EFFECTIVE JULY 1, 2024]: Sec. 20.5. (a) As used in this section,
93	93	4 "enrollee" includes only an enrollee who is undergoing treatment
94	94	5 for cancer.
95	95	6 (b) As used in this section, "scalp cooling item" means:
96	96	7 (1) a cooling cap;
97	97	8 (2) a hypothermia cap;
98	98	9 (3) a cold cap; and
99	99	10 (4) any other therapeutic device used to cool the scalp of an
100	100	11 individual to prevent or reduce hair loss during
101	101	12 chemotherapy.
102	102	13 (c) An individual contract or a group contract that provides
103	103	14 coverage for basic health care services must provide coverage for
104	104	15 scalp cooling items for an enrollee.
