38+A BILL FOR AN ACT to amend the Indiana Code concerning
39+agriculture and animals.
1440 Be it enacted by the General Assembly of the State of Indiana:
15-SECTION 1. IC 15-11-9-1.2 IS ADDED TO THE INDIANA CODE
16-AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
17-1, 2024]: Sec. 1.2. (a) The department shall conduct an economic
18-impact study based on the findings of the lost farmland report
19-described in section 1.1 of this chapter (before its expiration).
20-(b) The economic impact study must include an analysis of the
21-economic value to communities based on every acre of farmland.
22-(c) The department shall issue a report to the legislative council
23-containing the department's findings and recommendations in the
24-economic impact study, including any recommended legislation, in
25-an electronic format under IC 5-14-6 not later than July 1, 2025.
26-(d) This section expires December 1, 2025.

55+Mr. Speaker: Your Committee on Agriculture and Rural
56+Development, to which was referred House Bill 1417, has had the same
57+under consideration and begs leave to report the same back to the
58+House with the recommendation that said bill be amended as follows:

63+"SECTION 2. IC 15-13-7-1, AS AMENDED BY P.L.92-2019,
64+SECTION 23, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
65+JULY 1, 2024]: Sec. 1. (a) The commission and board shall hold one
66+(1) state agricultural fair each year. The fair must emphasize
67+agriculture and agribusiness.
68+(b) The commission is responsible for the following:
69+(1) Personnel.
70+(2) Management of the facilities.
71+(3) Contracts and contract procedures.
72+(4) All fiduciary responsibilities.
73+(5) Approving future dates of the fair.
74+(c) The board is responsible for the following:
75+(1) Committees established under IC 15-13-5-5.5 to assist with
76+planning the fair.
77+(2) Approving the annual premium books for the fair that set forth
78+the general terms and conditions, schedule, loading and unloading
79+of livestock, qualifications, animal testing, breed specific terms
80+and conditions, entry fees, and premiums for all fair exhibits and
81+judges.
82+(3) Advising on matters related to agriculture and livestock,
83+including department staffing and judges.
84+(4) Approving breed champions to be included in the celebration
85+of champions, and establishing the formula for determining
86+monetary awards, based on recommendations of the Indiana State
87+Fair Foundation.
88+(5) Approving Advising the commission on future dates of the
89+fair.
90+(6) Fundraising to support youth development.
91+(7) Advocating for the fair within the community.
92+(8) Participating in the commission's strategic planning process.
93+(d) The board:
94+(1) shall assign a delegated board member to a committee of the

96+board; and
97+(2) may assign a delegated board member to at least one (1)
98+department during the fair.
99+With the assistance of staff, the delegated board member is responsible
100+for compliance with the terms and conditions established by the board
101+within the delegated board member's department during the fair.
102+(e) The board shall provide a list of recommendations to the
103+commission concerning the hiring of judges for livestock and
104+competitive events during the fair. The commission may use the
105+recommendations provided by the board to hire judges for livestock
106+and competitive events during the fair.".

131+refers to the publication "Indiana Drainage Handbook: An

134+Streams and Ditches", which was prepared by the Christopher B.
135+Burke Engineering company in accordance with P.L.329-1995,

137+Sec. 4. (a) The department shall oversee and take all actions
138+necessary for the preparation and publication of an updated
139+version of the Indiana Drainage Handbook.
140+(b) The department may select a contractor to draft the updated
141+version of the Indiana Drainage Handbook. The contractor
142+selected under this subsection shall be subject to the supervision of
143+the department, and the text developed by the contractor shall be
144+subject to review and comment by the advisory board established
145+by section 5 of this chapter.
146+Sec. 5. (a) The secretary of agriculture and rural development
147+shall appoint an Indiana Drainage Handbook advisory board to:
148+(1) advise the contractor and the department on the
149+preparation of the updated version of the Indiana Drainage
150+Handbook; and
151+(2) review and comment on:
152+(A) the structure of; and
153+(B) the text of drafts of;
154+the updated version of the Indiana Drainage Handbook.
155+(b) The advisory board must include the following:
156+(1) A representative of the department.
157+(2) A licensed county surveyor.
158+(3) A county commissioner.
159+(4) A representative of a soil and water conservation district.
160+(5) A licensed engineer.
161+(6) A representative of the department of natural resources.
162+(7) A representative of the department of environmental
163+management.
164+(8) A farmer.
165+(9) A representative of the construction industry.
166+(10) A representative of the United States Fish and Wildlife
167+Service.
168+(11) A representative of the United States Army Corps of
169+Engineers.
170+(12) A representative of the United States Department of
171+Agriculture's Natural Resources Conservation Service.
172+(13) An individual focused on environmental stewardship and
173+sustainability.
174+(c) The secretary of agriculture and rural development shall

176+appoint one (1) member of the advisory board as chairperson.
177+(d) A member of the advisory board serves until:
178+(1) the updated version of the Indiana Drainage Handbook is
179+published on the website of the department of natural
180+resources or the department; and
181+(2) the secretary of agriculture and rural development
182+declares that the work of the advisory board is concluded.
183+(e) A vacancy on the advisory board shall be filled by
184+appointment by the secretary of agriculture and rural
185+development.
186+Sec. 6. (a) The advisory board may not take official action or
187+make official recommendations on:
188+(1) general drainage policies;
189+(2) the text of drafts of the updated version of the Indiana
190+Drainage Handbook; or
191+(3) the structure of the updated version of the Indiana
192+Drainage Handbook.
193+(b) Advice and comments provided by the advisory board are
194+not binding on the department or the contractor selected under
195+section 4 of this chapter.
196+Sec. 7. (a) The advisory board shall meet at the call of the
197+chairperson. After the contractor is selected under section 4 of this
198+chapter, the advisory board:
199+(1) shall meet at least two (2) times to review the work of the
200+contractor; and
201+(2) may meet at other times at the call of the chairperson as
202+the contractor's work on the updated Indiana Drainage
203+Handbook progresses.
204+(b) The expenses of the advisory board shall be paid from funds
205+appropriated to the department.
206+(c) Each member of the advisory board who is not a state
207+employee is entitled to the minimum salary per diem provided by
208+IC 4-10-11-2.1(b). The member is also entitled to reimbursement
209+for traveling expenses as provided under IC 4-13-1-4 and other
210+expenses actually incurred in connection with the member's duties
211+as provided in the state policies and procedures established by the
212+Indiana department of administration and approved by the budget
213+agency.
214+Sec. 8. (a) The department shall staff the advisory board.
215+(b) The department may record and keep records of comments
216+provided by the advisory board to the department or the
217+contractor selected under section 4 of this chapter.".
