Gaskill BILL STATUS: As Introduced FIRST SPONSOR: FUNDS AFFECTED:XGENERAL IMPACT: State & Local XDEDICATED FEDERAL Summary of Legislation: This bill prohibits a party to a personal injury or wrongful death case from presenting certain evidence concerning the recovery of noneconomic damages. Effective Date: July 1, 2024. Explanation of State Expenditures: If a political subdivision is a defendant in a personal injury case, this bill could reduce the amount of monetary damages that the court might award the injured party. Any reduction in the award is not able to be determined. Noneconomic damages include: • Physical and emotional pain and suffering. • Physical impairment. • Emotional distress. • Mental anguish. • Loss of enjoyment. • Loss of companionship, services, and consortium. • Any other nonpecuniary loss proximately caused by a motor vehicle accident.
