Synopsis: Noneconomic damages. Prohibits a party to a personal
injury or wrongful death case from presenting certain evidence
concerning the recovery of noneconomic damages.

A BILL FOR AN ACT to amend the Indiana Code concerning civil
procedure.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 34-6-2-87.7, AS ADDED BY P.L.136-2015,
2 SECTION 3, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
3 JULY 1, 2024]: Sec. 87.7. "Noneconomic damages", for purposes of
4 IC 34-30-29.2 and IC 34-44-3, has the meaning set forth in
5 IC 34-30-29.2-2.
6 SECTION 2. IC 34-44-3 IS ADDED TO THE INDIANA CODE AS
7 A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY
8 1, 2024]:
9 Chapter 3. Evidence of Noneconomic Damages
10 Sec. 1. As used in this chapter, "noneconomic damages" has the
11 meaning set forth in IC 34-30-29.2-2.
12 Sec. 2. A party may not present the following to calculate or
13 request noneconomic damages in any proceeding on a claim of
14 personal injury or wrongful death:
15 (1) A specific dollar amount, including a monetary range.
16 (2) A mathematical formula.
17 (3) Units of time.

1 Sec. 3. This chapter does not create a right to recover
2 noneconomic damages if recovery of noneconomic damages is not
3 otherwise authorized by existing law.
