2929 A BILL FOR AN ACT to amend the Indiana Code concerning the
3030 general assembly.
3131 Be it enacted by the General Assembly of the State of Indiana:
3232 1 SECTION 1. IC 2-2.1-1-2, AS AMENDED BY P.L.201-2023,
3333 2 SECTION 36, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
3434 3 UPON PASSAGE]: Sec. 2. (a) The first regular session of each term of
3535 4 the general assembly shall convene on the third Tuesday after the first
3636 5 Monday of November of each even-numbered year to do the following:
3737 6 (1) Organize itself.
3838 7 (2) Elect its officers.
3939 8 (3) Receive the oath of office.
4040 9 (b) If a special session is called before the date set in subsection (a),
4141 10 then the organization, election, and receiving the oath of office shall be
4242 11 held on the first day of the special session.
4343 12 (c) The general assembly shall then adjourn until a day:
4444 13 (1) certain fixed by a concurrent resolution; or
4545 14 (2) when the gavel of each house falls in the presence of a quorum
4646 15 whether or not a day certain to reconvene in session has been
4747 16 fixed.
4848 17 (d) The general assembly shall reconvene in session no later than

5050 1 the fourth Monday in January of the following year.
5151 2 (e) The first regular session of each term of the general assembly
5252 3 shall adjourn sine die not later than April 29 May 15 in any
5353 4 odd-numbered year beginning after December 31, 2022. 2024.
5454 5 SECTION 2. IC 2-2.1-1-2.5, AS AMENDED BY P.L.201-2023,
5555 6 SECTION 37, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
5656 7 UPON PASSAGE]: Sec. 2.5. (a) The first regular technical session of
5757 8 the general assembly shall convene on the second Tuesday after the
5858 9 first Monday in June of each odd-numbered year.
5959 10 (b) Only the following may be considered and acted upon during a
6060 11 first regular technical session:
6161 12 (1) Bills enacted during the first regular session vetoed by the
6262 13 governor.
6363 14 (2) Bills to correct conflicts among bills enacted during the first
6464 15 regular session.
6565 16 (3) Bills to correct technical errors in bills enacted during the first
6666 17 regular session.
6767 18 (c) The first regular technical session must adjourn sine die before
6868 19 midnight after it convenes.
6969 20 (d) The first regular technical session is not required to convene if
7070 21 the speaker of the house of representatives and the president pro
7171 22 tempore of the senate jointly issue an order finding that the purposes
7272 23 for which a regular technical session may meet under subsection (b) do
7373 24 not justify the cost and inconvenience of meeting in a regular technical
7474 25 session.
7575 26 (e) If the general assembly does not meet in a regular technical
7676 27 session under this section, the general assembly shall consider and act
7777 28 upon vetoes of bills enacted during the first regular session at the next
7878 29 second regular session.
7979 30 (f) For purposes of Article 5, Section 14 of the Constitution of the
8080 31 State of Indiana, the first regular technical session is not considered a
8181 32 regular session if the general assembly does not consider or act upon
8282 33 vetoes of bills enacted during the first regular session under this
8383 34 section.
8484 35 SECTION 3. IC 2-2.1-1-3 IS REPEALED [EFFECTIVE UPON
8585 36 PASSAGE]. Sec. 3. (a) The second regular session of each term of the
8686 37 general assembly shall convene on the third Tuesday after the first
8787 38 Monday of November of each odd-numbered year. The general
8888 39 assembly shall then adjourn until a day:
8989 40 (1) certain fixed by a concurrent resolution; or
9090 41 (2) when the gavel of each house falls in the presence of a quorum
9191 42 whether or not a day certain to reconvene in session has been

9393 1 fixed.
9494 2 (b) The general assembly shall reconvene in session no later than
9595 3 the fourth Monday in January of the following year. The second regular
9696 4 session of each term of the general assembly shall adjourn sine die not

9898 6 SECTION 4. IC 2-2.1-1-3.5 IS REPEALED [EFFECTIVE UPON
9999 7 PASSAGE]. Sec. 3.5. (a) The second regular technical session of the
100100 8 general assembly shall convene on the second Tuesday after the first
101101 9 Monday in May of each even-numbered year.
102102 10 (b) Only the following may be considered and acted upon during a
103103 11 second regular technical session:
104104 12 (1) Bills enacted during the second regular session vetoed by the
105105 13 governor.
106106 14 (2) Bills to correct conflicts among bills enacted during the
107107 15 second regular session.
108108 16 (3) Bills to correct technical errors in bills enacted during the
109109 17 second regular session.
110110 18 (c) The second regular technical session must adjourn sine die
111111 19 before midnight after it convenes.
112112 20 (d) The second regular technical session is not required to convene
113113 21 if the speaker of the house of representatives and the president pro
114114 22 tempore of the senate jointly issue an order finding that the purposes
115115 23 for which a regular technical session may meet under subsection (b) do

118118 26 (e) If the general assembly does not meet in a regular technical

120120 28 upon vetoes of bills enacted during the second regular session at the

127127 35 SECTION 5. IC 2-2.1-1-9 IS AMENDED TO READ AS
128128 36 FOLLOWS [EFFECTIVE UPON PASSAGE]: Sec. 9. Procedures:
129129 37 Standing Committee Appointments. (a) By not later than ten (10) days
130130 38 after the election of officers as provided in sections 6 and 7 of this
131131 39 chapter, the appointments to the standing committees of the two (2)
132132 40 houses of the General Assembly shall be made and announced by the
133133 41 Speaker of the House of Representatives and the President Pro
134134 42 Tempore of the Senate, respectively.

136136 1 (b) At the reconvening in January of the first regular session, of the
137137 2 term, the lists of appointments to the standing committees shall be read
138138 3 in their respective houses and recorded in the journals thereof.
139139 4 (c) The members of the standing committees shall serve for the term
140140 5 of the General Assembly in which they are appointed, unless removed,
141141 6 suspended, or unable to serve.
142142 7 SECTION 6. IC 2-2.1-4-4, AS ADDED BY P.L.229-2011,
143143 8 SECTION 37, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
144144 9 UPON PASSAGE]: Sec. 4. As used in this chapter, "final day of
145145 10 session" means either of the following:
146146 11 (1) For a regular session convening before January 1, 2024,
147147 12 April 29 in odd-numbered years and March 14 in even-numbered
148148 13 years or
149149 14 (2) a date earlier than April 29 in odd-numbered years and March
150150 15 14 in even-numbered years, if unless the presiding officers of
151151 16 each body have:
152152 17 (A) jointly agreed; and
153153 18 (B) publicly announced;
154154 19 that the an earlier date will be the final day of session.
155155 20 (2) For a regular session convening after October 31, 2024,
156156 21 May 15 in odd-numbered years unless the presiding officers
157157 22 of each body have:
158158 23 (A) jointly agreed; and
159159 24 (B) publicly announced;
160160 25 that an earlier date will be the final day of session.
161161 26 SECTION 7. IC 2-5-1.1-1 IS AMENDED TO READ AS
162162 27 FOLLOWS [EFFECTIVE UPON PASSAGE]: Sec. 1. There is hereby
163163 28 created a legislative council which shall be composed of sixteen (16)
164164 29 members of the general assembly as follows:
165165 30 (a) From the senate: The president pro tempore, the minority leader,
166166 31 the majority caucus chairman, the minority caucus chairman, three (3)
167167 32 members appointed by the president pro tempore, and one (1) member
168168 33 appointed by the minority leader.
169169 34 (b) From the house of representatives: The speaker of the house, the
170170 35 majority leader, the minority leader, the majority caucus chairman, the
171171 36 minority caucus chairman, two (2) members appointed by the speaker,
172172 37 and one (1) member appointed by the minority leader.
173173 38 (c) The president of the senate may serve as an ex officio non-voting
174174 39 nonvoting member of the council.
175175 40 (d) The members of the council who serve by virtue of their office
176176 41 shall serve until their successors are selected.
177177 42 (e) The appointed members shall serve from the date of their

179179 1 appointment until the next general election at which they run for
180180 2 reelection, or until the convening of the first regular session of the next
181181 3 general assembly, whichever is first to occur. The president pro
182182 4 tempore, speaker, and minority leaders shall appoint their members not
183183 5 later than five (5) days after the close of a first regular session of a
184184 6 general assembly.
185185 7 SECTION 8. IC 3-3-2-1 IS AMENDED TO READ AS FOLLOWS
186186 8 [EFFECTIVE UPON PASSAGE]: Sec. 1. Congressional districts shall
187187 9 be established by law at the first regular session of the general
188188 10 assembly convening immediately following the United States decennial
189189 11 census.
190190 12 SECTION 9. IC 15-13-6-2, AS ADDED BY P.L.2-2008, SECTION
191191 13 4, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE UPON
192192 14 PASSAGE]: Sec. 2. (a) The advisory committee consists of the
193193 15 following members appointed after the first day of each regular
194194 16 session of the general assembly and before January 1 of the ensuing
195195 17 calendar year:
196196 18 (1) Four (4) members of the senate, not more than two (2) of
197197 19 whom are members of the same political party, appointed by the
198198 20 president pro tempore of the senate.
199199 21 (2) Four (4) members of the house of representatives, not more
200200 22 than two (2) of whom are members of the same political party,
201201 23 appointed by the speaker of the house of representatives.
202202 24 (b) A member appointed under subsection (a) begins serving on
203203 25 January 1 and serves until the first day of the first regular session of
204204 26 the next general assembly following the member's appointment.
205205 27 (c) A vacancy on the advisory committee shall be filled for the
206206 28 unexpired term by the appointing authority who appointed the member
207207 29 whose position is vacant.
208208 30 (d) After appointment of the members of the advisory committee
209209 31 under subsection (a), the:
210210 32 (1) speaker of the house of representatives shall name one (1) of
211211 33 the members as chairperson; and
212212 34 (2) president pro tempore of the senate shall name another
213213 35 member as vice chairperson.
214214 36 The chairperson and the vice chairperson serve until the first day of the
215215 37 second regular session of that general assembly. January 1 of the
216216 38 calendar year following the calendar year in which the terms of the
217217 39 members of the advisory committee began under subsection (a).
218218 40 The vice chairperson during the first session year of the members'
219219 41 term then becomes the chairperson for the second year, and the
220220 42 chairperson during the first session year of the members' term

222222 1 becomes the vice chairperson for the second year. The appointing
223223 2 authority may name a different chairperson or vice chairperson at any
224224 3 time.
225225 4 SECTION 10. IC 21-18-16-2, AS AMENDED BY P.L.201-2023,
226226 5 SECTION 226, IS AMENDED TO READ AS FOLLOWS
227227 6 [EFFECTIVE UPON PASSAGE]: Sec. 2. (a) The commission shall
228228 7 create a higher educational operating funding outcomes based formula
229229 8 that aligns with the goals outlined in the commission's long range plan
230230 9 for postsecondary education under IC 21-18-8.
231231 10 (b) The commission shall create a separate higher educational
232232 11 operating funding outcomes based formula for Ivy Tech Community
233233 12 College that:
234234 13 (1) aligns with the goals outlined in the commission's long range
235235 14 plan for postsecondary education under IC 21-18-8; and
236236 15 (2) focuses on employer needs, positive wage outcomes, and
237237 16 stackable credentials.
238238 17 (c) An outcomes based funding formula must be created and
239239 18 approved by the commission at a meeting of the commission on or
240240 19 before October 1 of each even-numbered year. prior to each
241241 20 odd-numbered year in which the general assembly will reconvene in a
242242 21 first regular session and consider a state budget bill.
243243 22 (d) The commission shall approve the metrics used for an outcomes
244244 23 based funding formula created under this chapter.
245245 24 SECTION 11. An emergency is declared for this act.
