2828 A BILL FOR AN ACT to amend the Indiana Code concerning
2929 human services.
3030 Be it enacted by the General Assembly of the State of Indiana:
3131 1 SECTION 1. IC 12-15-35.5-11 IS ADDED TO THE INDIANA
3232 2 CODE AS A NEW SECTION TO READ AS FOLLOWS
3333 3 [EFFECTIVE JULY 1, 2024]: Sec. 11. (a) As used in this section,
3434 4 "office" includes the following:
3535 5 (1) The office of the secretary of family and social services.
3636 6 (2) A managed care organization that has contracted with the
3737 7 office of Medicaid policy and planning under this article.
3838 8 (3) A person that has contracted with a managed care
3939 9 organization described in subdivision (2).
4040 10 (b) The office shall allow a federally qualified health center (as
4141 11 defined in 42 U.S.C. 1396d(l)(2)(B)) to elect for a separate
4242 12 reimbursement under this article for pharmacy costs by removing
4343 13 pharmacy costs from the facility specific prospective payment
4444 14 system rate.
