Summary of Legislation: The bill specifies that statutes concerning behavioral health and human services
professionals may not be construed to limit social work or clinical social work services performed by an
employee or staff member of a Community Mental Health Center. The bill removes board approval to take
a licensure examination as a requirement for a temporary permit to profess to be a clinical social worker,
marriage and family therapist, mental health counselor, licensed addiction counselor, or licensed clinical
addiction counselor.
Effective Date:  July 1, 2024.
Explanation of State Expenditures: The bill may reduce the workload of the Behavioral Health and Human
Services Board (Board). However, the Professional Licensing Agency (PLA)  may need to update application
forms, website instructions, and the online application tool for behavioral health temporary permits, resulting
in an increase in workload for the PLA. However, additional expenses may be required for any updates
needed for the online license application tool. The amount of any additional expenditures would depend on
the contracted terms for the upgrade between the PLA and their vendor.
Explanation of State Revenues: Without need for Board approval to take the examination, fee revenue from
temporary permits issued may increase slightly if more applications are filed. The current application fee is
$25. There were 992 behavioral health temporary permits issued in FY 2023. If the bill leads to a five percent
increase in temporary permit applications, it would equal an increase of $1,250 in application fee revenue
per fiscal year to the state General Fund. Behavioral health temporary permits cannot be renewed and are
granted for a duration of one year.
