3232 A BILL FOR AN ACT to amend the Indiana Code concerning
3333 professions and occupations.
3434 Be it enacted by the General Assembly of the State of Indiana:
3535 1 SECTION 1. IC 25-23.6-4-2, AS AMENDED BY P.L.211-2019,
3636 2 SECTION 37, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
3737 3 JULY 1, 2024]: Sec. 2. (a) This article may not be construed to limit
3838 4 the social work or clinical social work services performed by a person
3939 5 who does not use a title specified in this article and who is one (1) of
4040 6 the following:
4141 7 (1) A licensed health care professional acting within the scope of
4242 8 the person's license.
4343 9 (2) A student, an intern, or a trainee pursuing a course of study in
4444 10 medicine, psychology, or a course of study to gain licensure under
4545 11 this article in an accredited eligible postsecondary educational
4646 12 institution or training institution accredited by the Council on
4747 13 Social Work Education, or a graduate accumulating experience
4848 14 required for licensure if:
4949 15 (A) the services are performed under qualified supervision and
5050 16 constitute a part of the person's supervised course of study or
5151 17 other level of supervision; and

5353 1 (B) the student or graduate uses a title that contains the term
5454 2 "intern", "student", or "trainee".
5555 3 (3) Not a resident of Indiana if the person performed social work
5656 4 in Indiana for not more than five (5) days in any one (1) month or
5757 5 more than fifteen (15) days in any one (1) calendar year and the
5858 6 person is authorized to perform such services under the laws of
5959 7 the state or country in which the person resides.
6060 8 (4) A rabbi, priest, Christian Science practitioner, minister, or
6161 9 other member of the clergy.
6262 10 (5) An employee or a volunteer for an organization performing
6363 11 charitable, religious, or educational functions, providing pastoral
6464 12 counseling, or other assistance.
6565 13 (6) A person who provides school counseling.
6666 14 (7) A governmental employee (as defined in IC 25-23.6-1-3.9).
6767 15 (8) An individual providing services under a contract with the
6868 16 department of child services who:
6969 17 (A) is employed by an organization that is nationally
7070 18 accredited and in good standing by the Joint Commission,
7171 19 Council on Accreditation, or the Commission on Accreditation
7272 20 of Rehabilitation Facilities;
7373 21 (B) is directly supervised by a licensed individual who is:
7474 22 (i) licensed under IC 25-23.6-2, as a social worker, clinical
7575 23 social worker, mental health counselor, mental health
7676 24 counselor associate, marriage and family therapist, or
7777 25 marriage and family therapist associate, and acting within
7878 26 the scope of the individual's license;
7979 27 (ii) licensed as a psychologist under IC 25-33 and acting
8080 28 within the scope of the individual's license; or
8181 29 (iii) licensed as a physician under IC 25-22.5 who is actively
8282 30 engaged in the practice of psychiatry and acting within the
8383 31 scope of the individual's license; and
8484 32 (C) meets any additional requirements established by the
8585 33 department of child services.
8686 34 (9) An individual providing services under a contract with the
8787 35 department of child services who:
8888 36 (A) has completed a bachelor's degree in social work from:
8989 37 (i) an eligible postsecondary educational institution that is
9090 38 accredited or approved for candidacy by the Council on
9191 39 Social Work Education or approved by the behavioral health
9292 40 and human services licensing board; or
9393 41 (ii) a foreign school that has a program of study that is
9494 42 approved by the Foreign Equivalency Determination Service

9696 1 of the Council on Social Work Education; and
9797 2 (B) is employed in a position for which the department of child
9898 3 services has specified that the job may be filled by individuals
9999 4 who have completed a bachelor-level degree in social work or
100100 5 other human services fields but do not need to be licensed.
101101 6 (10) An employee or staff member of a community mental
102102 7 health center.
103103 8 (b) Nothing in this section prohibits a person referred to in
104104 9 subsection (a) from qualifying for licensure under this article.
105105 10 SECTION 2. IC 25-23.6-5-11, AS AMENDED BY P.L.195-2018,
106106 11 SECTION 12, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
107107 12 JULY 1, 2024]: Sec. 11. (a) The board may issue a temporary permit
108108 13 to an individual to profess to be a clinical social worker if the
109109 14 individual pays a fee and the individual:
110110 15 (1) has a valid license or certificate to practice from another state
111111 16 and the individual has passed an examination substantially
112112 17 equivalent to the level for which licensure is being requested;
113113 18 (2) is practicing in a state that does not license or certify social
114114 19 workers or clinical social workers, but is certified by a national
115115 20 association approved by the board and the individual has applied
116116 21 for a license from the board; or
117117 22 (3) has been approved by the board to take the examination and
118118 23 has graduated from a school or program approved by the board
119119 24 and the individual has completed any experience requirement.
120120 25 (b) A temporary permit expires the earlier of:
121121 26 (1) the date the individual holding the permit is issued a license
122122 27 under this article;
123123 28 (2) the date the board disapproves the individual's license
124124 29 application; or
125125 30 (3) one hundred eighty (180) days after the initial permit is issued.
126126 31 (c) The board may renew a temporary permit if the individual
127127 32 holding the permit was scheduled to take the next examination and the
128128 33 individual:
129129 34 (1) did not take the examination; and
130130 35 (2) shows good cause for not taking the examination.
131131 36 (d) A permit renewed under subsection (c) expires on the date the
132132 37 individual holding the permit receives the results from the next
133133 38 examination given after the permit was issued, and may not be
134134 39 extended if the applicant has failed the examination.
135135 40 SECTION 3. IC 25-23.6-8-10 IS AMENDED TO READ AS
136136 41 FOLLOWS [EFFECTIVE JULY 1, 2024]: Sec. 10. (a) The board may
137137 42 issue a temporary permit to an individual to profess to be a marriage

139139 1 and family therapist if the individual pays a fee and the individual:
140140 2 (1) has a valid license or certificate to practice from another state
141141 3 and the individual has applied for a license from the board;
142142 4 (2) is practicing in a state that does not license or certify marriage
143143 5 and family therapists, but is certified by a national association
144144 6 approved by the board and the individual has applied for a license
145145 7 from the board; or
146146 8 (3) has been approved by the board to take the examination and
147147 9 has graduated from a school or program approved by the board
148148 10 and the individual has completed any experience requirement.
149149 11 (b) A temporary permit expires the earlier of:
150150 12 (1) the date the individual holding the permit is issued a license
151151 13 under this article;
152152 14 (2) the date the board disapproves the individual's license
153153 15 application; or
154154 16 (3) one hundred eighty (180) days after the initial permit is issued.
155155 17 (c) The board may renew a temporary permit if the individual
156156 18 holding the permit was scheduled to take the next examination and the
157157 19 individual:
158158 20 (1) did not take the examination; and
159159 21 (2) shows good cause for not taking the examination.
160160 22 (d) A permit renewed under subsection (c) expires on the date the
161161 23 individual holding the permit receives the results from the next
162162 24 examination given after the permit was issued.
163163 25 SECTION 4. IC 25-23.6-8.5-10 IS AMENDED TO READ AS
164164 26 FOLLOWS [EFFECTIVE JULY 1, 2024]: Sec. 10. (a) The board may
165165 27 issue a temporary permit to an individual to profess to be a mental
166166 28 health counselor if the individual pays a fee and the individual:
167167 29 (1) has a valid license or certificate to practice from another state
168168 30 and the individual has applied for a license from the board;
169169 31 (2) is practicing in a state that does not license or certify mental
170170 32 health counselors, but is certified by a national association
171171 33 approved by the board and the individual has applied for a license
172172 34 from the board; or
173173 35 (3) has been approved by the board to take the examination and
174174 36 has graduated from a school or program approved by the board
175175 37 and the individual has completed any experience requirement.
176176 38 (b) A temporary permit expires the earlier of:
177177 39 (1) the date the individual holding the permit is issued a license
178178 40 under this article; or
179179 41 (2) the date the board disapproves the individual's license

182182 1 (c) The board may renew a temporary permit if the individual
183183 2 holding the permit was scheduled to take the next examination and the
184184 3 individual:
185185 4 (1) did not take the examination; and
186186 5 (2) shows good cause for not taking the examination.
187187 6 (d) A permit renewed under subsection (c) expires on the date the
188188 7 individual holding the permit receives the results from the next
189189 8 examination given after the permit was issued.
190190 9 SECTION 5. IC 25-23.6-10.5-10, AS ADDED BY P.L.122-2009,
191191 10 SECTION 29, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
192192 11 JULY 1, 2024]: Sec. 10. (a) The board may issue a temporary permit
193193 12 to allow an individual to profess to be a licensed addiction counselor
194194 13 or licensed clinical addiction counselor if the individual pays a fee
195195 14 established by the board and the individual:
196196 15 (1) has a valid license or certificate to practice from another state
197197 16 and the individual has applied for a license from the board;
198198 17 (2) is practicing in a state that does not license addiction
199199 18 counselors or therapists but is certified by a national association
200200 19 approved by the board and the individual has applied for a license
201201 20 from the board; or
202202 21 (3) has been approved by the board to take the examination and
203203 22 has graduated from a school or program approved by the board
204204 23 and the individual has completed any experience requirement.
205205 24 (b) A temporary permit issued under this section expires the earliest
206206 25 of:
207207 26 (1) the date the individual holding the permit is issued a license
208208 27 under this article;
209209 28 (2) the date the board disapproves the individual's license
210210 29 application; or
211211 30 (3) one hundred eighty (180) days after the initial permit is issued.
212212 31 (c) The board may renew a temporary permit if the individual
213213 32 holding the permit is scheduled to take the next examination and the
214214 33 individual:
215215 34 (1) does not take the examination; and
216216 35 (2) shows good cause for not taking the examination.
217217 36 (d) A permit renewed under subsection (c) expires on the date the
218218 37 individual holding the permit receives the results from the next
219219 38 examination given after the permit was issued.
