BUCK, DONATO, BECKER, RANDOLPH , read first time and referred to Committee on 2024 RR 3538/DI SM Introduced Second Regular Session 123rd General Assembly (2024) SENATE RESOLUTION ____ MADAM PRESIDENT: I offer the following resolution and move its adoption: 1 A SENATE RESOLUTION to urging the Indiana federal 2 congressional delegation to support the Susan Muffley Act. 3 Whereas, The Susan Muffley Act is bipartisan legislation 4 that seeks to restore the full vested monthly benefits for eligible 5 participants of certain pension plans that were sponsored by 6 Delphi Corporation and terminated as a result of General 7 Motors' bankruptcy in 2009; 8 Whereas, Delphi Corporation was the largest domestic 9 automobile parts manufacturer of its time and was responsible 10 for transformative innovation, such as the self-starting engine, 11 ring terminal, radio with mechanical push-button presets, and 12 safety power steering, with General Motors accounting for the 13 majority of their sales and profit; 14 Whereas, Many companies unwillingly filed for bankruptcy 15 as a result of the Great Recession, the biggest global economic 16 downturn since the Great Depression, which devastated world 17 financial markets as well as the banking and real estate 18 industries during the late 2000s; 19 Whereas, During this time, the United States Pension 2024 RR 3538/DI SM 2 1 Benefit Guaranty Corporation assumed responsibility for 2 terminated benefits nationwide, including those of General 3 Motors, but only paid affected individuals up to a statutory 4 maximum benefit which for many fell far below what they 5 would have received under previous benefit plans; 6 Whereas, Over 21,000 Delphi Corporation salaried 7 retirees, including more than 4,000 Hoosiers, experienced 8 unexpected and significant losses to their benefits; 9 Whereas, On July 12, 2023, Senators Sherrod Brown and 10 Mike Braun filed S.2277, now named after Susan Muffley of 11 Russiaville, Indiana, the spouse of a Delphi employee affected 12 by General Motors' bankruptcy who was inspired by her 13 family's inability to afford medical care and fought tirelessly as 14 a core leader of the Delphi Salaried Retirees Association for 15 the restoration of lost benefits nationwide until her passing in 16 2012; and 17 Whereas, Enactment of the Susan Muffley Act would 18 recognize the hardships experienced by Delphi Corporation 19 salaried retirees nationwide and rectify the financial losses 20 which have plagued them for over a decade: Therefore, 21 Be it resolved by the Senate of the 22 General Assembly of the State of Indiana: 23 SECTION 1. That the Indiana Senate urges the Indiana 24 federal congressional delegation to support the Susan Muffley 25 Act. 26 SECTION 2.
