1212 MADAM PRESIDENT:
1313 I offer the following resolution and move its adoption:
1414 1 A SENATE RESOLUTION to urging the Indiana federal
1515 2 congressional delegation to support the Susan Muffley Act.
1616 3 Whereas, The Susan Muffley Act is bipartisan legislation
1717 4 that seeks to restore the full vested monthly benefits for eligible
1818 5 participants of certain pension plans that were sponsored by
1919 6 Delphi Corporation and terminated as a result of General
2020 7 Motors' bankruptcy in 2009;
2121 8 Whereas, Delphi Corporation was the largest domestic
2222 9 automobile parts manufacturer of its time and was responsible
2323 10 for transformative innovation, such as the self-starting engine,
2424 11 ring terminal, radio with mechanical push-button presets, and
2525 12 safety power steering, with General Motors accounting for the
2626 13 majority of their sales and profit;
2727 14 Whereas, Many companies unwillingly filed for bankruptcy
2828 15 as a result of the Great Recession, the biggest global economic
2929 16 downturn since the Great Depression, which devastated world
3030 17 financial markets as well as the banking and real estate
3131 18 industries during the late 2000s;
3232 19 Whereas, During this time, the United States Pension

3434 1 Benefit Guaranty Corporation assumed responsibility for
3535 2 terminated benefits nationwide, including those of General
3636 3 Motors, but only paid affected individuals up to a statutory
3737 4 maximum benefit which for many fell far below what they
3838 5 would have received under previous benefit plans;
3939 6 Whereas, Over 21,000 Delphi Corporation salaried
4040 7 retirees, including more than 4,000 Hoosiers, experienced
4141 8 unexpected and significant losses to their benefits;
4242 9 Whereas, On July 12, 2023, Senators Sherrod Brown and
4343 10 Mike Braun filed S.2277, now named after Susan Muffley of
4444 11 Russiaville, Indiana, the spouse of a Delphi employee affected
4545 12 by General Motors' bankruptcy who was inspired by her
4646 13 family's inability to afford medical care and fought tirelessly as
4747 14 a core leader of the Delphi Salaried Retirees Association for
4848 15 the restoration of lost benefits nationwide until her passing in
4949 16 2012; and
5050 17 Whereas, Enactment of the Susan Muffley Act would
5151 18 recognize the hardships experienced by Delphi Corporation
5252 19 salaried retirees nationwide and rectify the financial losses
5353 20 which have plagued them for over a decade: Therefore,
5454 21 Be it resolved by the Senate of the
5555 22 General Assembly of the State of Indiana:
5656 23 SECTION 1. That the Indiana Senate urges the Indiana
5757 24 federal congressional delegation to support the Susan Muffley
5858 25 Act.
5959 26 SECTION 2. The Secretary of the Senate is hereby directed
6060 27 to transmit copies of this Resolution to the Indiana federal
6161 28 congressional delegation.
