HOUSE ENROLLED ACT No. 1065 AN ACT to amend the Indiana Code concerning health. Be it enacted by the General Assembly of the State of Indiana: SECTION 1. IC 16-18-2-45.1 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2025]: Sec. 45.1. "Cancer clinical trial", for purposes of IC 16-48-18, has the meaning set forth in IC 16-46-18-1. SECTION 2. IC 16-18-2-268.1 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2025]: Sec. 268.1. "Participant", for purposes of IC 16-48-18, has the meaning set forth in IC 16-46-18-2. SECTION 3. IC 16-18-2-294.5, AS AMENDED BY P.L.208-2015, SECTION 4, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2025]: Sec. 294.5. (a) "Program", for purposes of IC 16-40-4, has the meaning set forth in IC 16-40-4-3. (b) "Program", for purposes of IC 16-41-7.5, has the meaning set forth in IC 16-41-7.5-2. (c) "Program", for purposes of IC 16-46-18, has the meaning set forth in IC 16-46-18-3. (c) (d) "Program", for purposes of IC 16-47-1, has the meaning set forth in IC 16-47-1-3. SECTION 4. IC 16-46-18 IS ADDED TO THE INDIANA CODE AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE HEA 1065 2 JULY 1, 2025]: Chapter 18. Cancer Clinical Trial Participation Program Sec. 1. As used in this chapter, "cancer clinical trial" refers to a research study in which an individual receives a new cancer treatment, including medication, chemotherapy, or adult stem cell therapy. Sec. 2. As used in this chapter, "participant" refers to an individual who participates in a program. Sec. 3. As used in this chapter, "program" means a cancer clinical trial participation program described in section 4 of this chapter. Sec. 4. An organization or entity may establish and administer a program for the purpose of providing payment to a participant for reasonable costs incurred by a participant while participating in a cancer clinical trial. Sec. 5. (a) An organization or entity that establishes and administers a program shall do the following: (1) Subject to section 6 of this chapter, establish guidelines for financial eligibility for the program, which must be based on financial need. (2) Collaborate with health care providers to notify a prospective participant about the program. (3) Provide written notice to a prospective participant on the: (A) requirements described in this section; (B) nature and availability of financial support provided under the program; and (C) program's financial eligibility guidelines. (4) Receive and review applications for participation in the program. (5) Establish a process for awarding payments. (6) Subject to approval by the organization or entity, provide payment to a participant for reasonable costs incurred by the participant while participating in a cancer clinical trial, including costs for the following: (A) Travel. (B) Lodging. (C) Parking and tolls. (D) Other costs, as determined by the organization or entity. (7) Comply with all applicable state and federal laws. (b) An organization or entity that establishes and administers a program may, in addition to payments provided to a participant, HEA 1065 3 provide to one (1) individual, including a relative or friend, designated by a participant payment for reasonable costs described in subsection (a)(6) incurred while the individual attends a cancer clinical trial to support the participant. Sec. 6. An individual is eligible to participate in a program if the individual: (1) is an Indiana resident; (2) has an income that does not exceed seven hundred percent (700%) of the federal poverty level; (3) resides in an underserved area, as determined by the organization or entity; and (4) is eligible to participate in a cancer clinical trial. Sec. 7. An organization or entity that operates a program may accept gifts, grants, and donations from a public or private source to establish and administer the program.
