40+A BILL FOR AN ACT to amend the Indiana Code concerning local
41+government.
1342 Be it enacted by the General Assembly of the State of Indiana:
14-SECTION 1. IC 36-8-11-4 IS AMENDED TO READ AS
15-FOLLOWS [EFFECTIVE JANUARY 1, 2025 (RETROACTIVE)]:
16-Sec. 4. (a) A county legislative body may establish fire protection
17-districts for any of the following purposes:
18-(1) Fire protection, including the capability for extinguishing all
19-fires that might be reasonably expected because of the types of
20-improvements, personal property, and real property within the
21-boundaries of the district.
22-(2) Fire prevention, including identification and elimination of all
23-potential and actual sources of fire hazard.
24-(3) If the county legislative body establishes a fire protection

45+3 Sec. 4. (a) A county legislative body may establish fire protection
46+4 districts for any of the following purposes:
47+5 (1) Fire protection, including the capability for extinguishing all
48+6 fires that might be reasonably expected because of the types of
49+7 improvements, personal property, and real property within the
50+8 boundaries of the district.
51+9 (2) Fire prevention, including identification and elimination of all
52+10 potential and actual sources of fire hazard.
53+11 (3) If the county legislative body establishes a fire protection
54+12 district for either or both of the purposes under subdivision
55+13 (1) or (2), in addition to those the fire protection district
56+14 purposes may include the provision of emergency medical
57+15 services (regulated under IC 16-31-3), basic life support, or
58+16 advanced life support. However, this subdivision may not
59+17 apply, and the purposes under this subdivision may not be

61+1 included with regard to the fire protection district, if another
62+2 local unit or organization is providing the services under this
63+3 subdivision with public funds to the area served by the fire
64+4 protection district.
65+5 (4) If the county legislative body establishes a fire protection
66+6 district for either or both of the purposes under subdivision
67+7 (1) or (2), in addition to those the fire protection district
68+8 purposes may include the prevention of hazards that may
69+9 cause loss of life, injury or other health impacts, property
70+10 damage, loss of livelihoods and services, social and economic
71+11 disruption, or environmental damage.
72+12 (3) (5) Other purposes or functions related to fire protection and
73+13 fire prevention.
74+14 (b) Any area may be established as a fire protection district, but one
75+15 (1) part of a district may not be completely separate from another part.
76+16 A municipality may be included in a district, but only if it consents by
77+17 ordinance, unless a majority of the freeholders of the municipality have
78+18 petitioned to be included in the district.
79+19 (c) Except as provided in subsection (d), the territory of a district
80+20 may consist of:
81+21 (1) one (1) or more townships and parts of one (1) or more
82+22 townships in the same county; or
83+23 (2) all of the townships in the same county.
84+24 The boundaries of a district need not coincide with those of other
85+25 political subdivisions.
86+26 (d) The territory of a district may consist of a municipality that is
87+27 located in more than one (1) county.
88+28 SECTION 2. An emergency is declared for this act.
