27	27	A BILL FOR AN ACT to amend the Indiana Code concerning
28	28	human services.
29	29	Be it enacted by the General Assembly of the State of Indiana:
30	30	1 SECTION 1. IC 12-15-5-22 IS ADDED TO THE INDIANA CODE
31	31	2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
32	32	3 1, 2025]: Sec. 22. (a) As used in this section, "office" includes the
33	33	4 following:
34	34	5 (1) The office of the secretary of family and social services.
35	35	6 (2) A managed care organization that has contracted with the
36	36	7 office of Medicaid policy and planning under this article.
37	37	8 (3) A person that has contracted with a managed care
38	38	9 organization described in subdivision (2).
39	39	10 (b) The office shall provide coverage for the treatment of obesity
40	40	11 that includes the following:
41	41	12 (1) Prevention and wellness services.
42	42	13 (2) Nutrition counseling.
43	43	14 (3) Intensive behavioral therapy.
44	44	15 (4) Bariatric surgery.
45	45	16 (5) Any medication approved by the federal Food and Drug
46	46	17 Administration for chronic weight management.

48	48	1 (c) Criteria for coverage of a medication described in subsection
49	49	2 (b)(5) shall not be more restrictive than the indication for the
50	50	3 medication approved by the federal Food and Drug
51	51	4 Administration.
52	52	5 (d) The office shall provide a Medicaid recipient unrestricted
53	53	6 access (as defined in IC 12-15-35.5-2.5) to a medication described
54	54	7 in subsection (b)(5).
55	55	8 (e) This section does not preclude the Medicaid program's use
56	56	9 of utilization management to determine the medical necessity for
57	57	10 treatment of obesity under this section if the appropriateness and
58	58	11 medical necessity determinations are made in the same manner as
59	59	12 the determinations for the treatment of other illnesses, conditions,
60	60	13 or disorders covered by the state Medicaid plan.
61	61	14 (f) Not later than January 1, 2026, and every January 1
62	62	15 thereafter, the office shall provide written notice to recipients,
63	63	16 providers, and prescribers concerning the coverage for the
64	64	17 treatment of obesity described in this section.
