2727 A BILL FOR AN ACT to amend the Indiana Code concerning
2828 human services.
2929 Be it enacted by the General Assembly of the State of Indiana:
3030 1 SECTION 1. IC 12-15-5-22 IS ADDED TO THE INDIANA CODE
3131 2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
3232 3 1, 2025]: Sec. 22. (a) As used in this section, "office" includes the
3333 4 following:
3434 5 (1) The office of the secretary of family and social services.
3535 6 (2) A managed care organization that has contracted with the
3636 7 office of Medicaid policy and planning under this article.
3737 8 (3) A person that has contracted with a managed care
3838 9 organization described in subdivision (2).
3939 10 (b) The office shall provide coverage for the treatment of obesity
4040 11 that includes the following:
4141 12 (1) Prevention and wellness services.
4242 13 (2) Nutrition counseling.
4343 14 (3) Intensive behavioral therapy.
4444 15 (4) Bariatric surgery.
4545 16 (5) Any medication approved by the federal Food and Drug
4646 17 Administration for chronic weight management.

4848 1 (c) Criteria for coverage of a medication described in subsection
4949 2 (b)(5) shall not be more restrictive than the indication for the
5050 3 medication approved by the federal Food and Drug
5151 4 Administration.
5252 5 (d) The office shall provide a Medicaid recipient unrestricted
5353 6 access (as defined in IC 12-15-35.5-2.5) to a medication described
5454 7 in subsection (b)(5).
5555 8 (e) This section does not preclude the Medicaid program's use
5656 9 of utilization management to determine the medical necessity for
5757 10 treatment of obesity under this section if the appropriateness and
5858 11 medical necessity determinations are made in the same manner as
5959 12 the determinations for the treatment of other illnesses, conditions,
6060 13 or disorders covered by the state Medicaid plan.
6161 14 (f) Not later than January 1, 2026, and every January 1
6262 15 thereafter, the office shall provide written notice to recipients,
6363 16 providers, and prescribers concerning the coverage for the
6464 17 treatment of obesity described in this section.
