77 Synopsis: Prohibition of certain abortion funding. Provides that except
88 when the state or a political subdivision is allowed to use funds under
99 its control for the performance of an abortion necessary to preserve the
1010 life of a pregnant woman, an Indiana governmental entity is prohibited
1111 from doing any of the following: (1) Making a payment from any fund
1212 for the performance of or costs associated with procuring an abortion.
1313 (2) Allowing the use of funds controlled by a hospital or ambulatory
1414 outpatient surgical center affiliated with the Indiana governmental
1515 entity for the performance of or costs associated with procuring an
1616 abortion. (3) Making a payment or grant from any fund under its
1717 control to an organization that performs abortions, makes referrals for
1818 individuals to obtain abortions, or uses public funds for the
1919 performance of or costs associated with procuring an abortion. Provides
2020 that the prohibition does not apply to a private entity's funds controlled
2121 by the private entity.

3737 A BILL FOR AN ACT to amend the Indiana Code concerning state

3939 Be it enacted by the General Assembly of the State of Indiana:

4545 6 Chapter 1. Definitions
4646 7 Sec. 1. The definitions in this chapter apply throughout this
4747 8 article.
4848 9 Sec. 2. "Indiana governmental entity" means a:
4949 10 (1) state agency (as defined in IC 1-1-15-3);
5050 11 (2) political subdivision (as defined in IC 36-1-2-13);
5151 12 (3) municipally owned utility (as defined in IC 8-1-2-1(h)), a
5252 13 joint agency created under IC 8-1-2.2-8, or a utility company
5353 14 owned, operated, or held in trust by a consolidated city; or
5454 15 (4) health care system affiliated with a state educational
5555 16 institution.
5656 17 Sec. 3. "Private entity" means a:

5858 1 (1) business corporation;
5959 2 (2) nonprofit corporation;
6060 3 (3) general partnership, including a limited liability
6161 4 partnership;
6262 5 (4) limited partnership; or
6363 6 (5) limited liability company.
6464 7 However, the term does not include a nonprofit health care system
6565 8 affiliated with a state educational institution.
6666 9 Sec. 4. "Public funds" means money:
6767 10 (1) derived from the revenue sources of an Indiana
6868 11 governmental entity; and
6969 12 (2) deposited into the general or a special fund of the Indiana
7070 13 governmental entity.
7171 14 Chapter 2. Prohibition on Public Funding of Abortion
7272 15 Sec. 1. This chapter does not apply to any private entity's funds
7373 16 controlled by the private entity.
7474 17 Sec. 2. Except as provided in IC 16-34-1-2, an Indiana
7575 18 governmental entity may not:
7676 19 (1) make a payment from any fund under its control for:
7777 20 (A) the performance of; or
7878 21 (B) costs associated with procuring;
7979 22 an abortion;
8080 23 (2) allow the use of any funds controlled by a hospital licensed
8181 24 under IC 16-21-2 or ambulatory outpatient surgical center
8282 25 licensed under IC 16-21-2 that is owned by or associated or
8383 26 affiliated with the Indiana governmental entity for:
8484 27 (A) the performance of; or
8585 28 (B) costs associated with procuring;
8686 29 an abortion; or
8787 30 (3) make a payment or grant from any fund under the Indiana
8888 31 governmental entity's control to an organization that:
8989 32 (A) performs abortions;
9090 33 (B) makes referrals for individuals to obtain an abortion;
9191 34 or
9292 35 (C) uses public funds for:
9393 36 (i) the performance of; or
9494 37 (ii) costs associated with procuring;
9595 38 an abortion.
9696 39 SECTION 2. An emergency is declared for this act.
