2626 A BILL FOR AN ACT to amend the Indiana Code concerning
2727 higher education.
2828 Be it enacted by the General Assembly of the State of Indiana:
2929 1 SECTION 1. IC 12-32-1-6, AS AMENDED BY P.L.172-2018,
3030 2 SECTION 1, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
3131 3 JULY 1, 2025]: Sec. 6. An agency or a political subdivision required
3232 4 to verify the eligibility of an individual under section 5 of this chapter
3333 5 shall do the following:
3434 6 (1) Require the individual to execute a verification stating under
3535 7 penalty of perjury that the individual: one (1) of the following:
3636 8 (A) The individual is a United States citizen.
3737 9 (B) The individual is a qualified alien (as defined under 8
3838 10 U.S.C. 1641). or
3939 11 (C) The individual meets the following:
4040 12 (i) The individual is authorized by the federal government to
4141 13 work in the United States as provided under section 6.5 of
4242 14 this chapter.
4343 15 (ii) The individual is executing the verification only for the
4444 16 purpose of applying for a professional or occupational
4545 17 license (as defined in section 6.5(a) of this chapter).

4747 1 (D) The individual:
4848 2 (i) is not applying for any state or local public benefit or
4949 3 federal public benefit, other than the resident tuition
5050 4 rate, that is provided by the agency or political
5151 5 subdivision; and
5252 6 (ii) meets the requirements under IC 21-14-11.5-1.
5353 7 (2) Maintain a verification executed in accordance with
5454 8 subdivision (1) for at least five (5) years.
5555 9 SECTION 2. IC 21-14-11-1, AS AMENDED BY P.L.180-2013,
5656 10 SECTION 2, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
5757 11 JULY 1, 2025]: Sec. 1. (a) This section does not apply to an individual
5858 12 who was enrolled in a state educational institution on or before July 1,
5959 13 2011.
6060 14 (b) Except as provided in IC 21-14-11.5-1, an individual who is
6161 15 not lawfully present in the United States is not eligible to pay the
6262 16 resident tuition rate that is determined by the state educational
6363 17 institution.
6464 18 SECTION 3. IC 21-14-11.5 IS ADDED TO THE INDIANA CODE
6565 19 AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE
6666 20 JULY 1, 2025]:
6767 21 Chapter 11.5. Resident Tuition Rate for Eligible Individuals
6868 22 Sec. 1. An individual is eligible to pay the resident tuition rate
6969 23 that is determined by a state educational institution if the
7070 24 individual:
7171 25 (1) attended a public or nonpublic high school (as defined in
7272 26 IC 20-18-2-7) in Indiana for at least three (3) years; and
7373 27 (2) has received a diploma of graduation, or the equivalent of
7474 28 a diploma, from a public or nonpublic high school (as defined
7575 29 in IC 20-18-2-7) in Indiana.
7676 30 Sec. 2. The commission may adopt rules under IC 4-22-2 to
7777 31 implement this chapter.
