2828 A BILL FOR AN ACT to amend the Indiana Code concerning state
2929 offices and administration and to make an appropriation.
3030 Be it enacted by the General Assembly of the State of Indiana:
3131 1 SECTION 1. IC 5-16-16 IS ADDED TO THE INDIANA CODE AS

3434 4 Chapter 16. Grant Program for the Installation of Lactation
3535 5 Rooms in Public Buildings
3636 6 Sec. 1. This chapter applies to a public agency.
3737 7 Sec. 2. As used in this chapter, "authority" refers to the Indiana
3838 8 housing and community development authority created by
3939 9 IC 5-20-1-3.
4040 10 Sec. 3. As used in this chapter, "fund" refers to the lactation
4141 11 room grant fund established by section 10 of this chapter.
4242 12 Sec. 4. As used in this chapter, "grant program" refers to the
4343 13 grant program for the installation of lactation rooms established
4444 14 by section 7 of this chapter.
4545 15 Sec. 5. As used in this chapter, "lactation room" means a room
4646 16 designated and equipped for the purpose of allowing mothers to
4747 17 nurse or express milk in a clean and private setting within a public

4949 1 building.
5050 2 Sec. 6. As used in this chapter, "public agency" has the meaning
5151 3 set forth in IC 5-30-1-11.
5252 4 Sec. 7. The grant program for the installation of lactation rooms
5353 5 is established to provide grants to public agencies to offset costs
5454 6 incurred in the installation of lactation rooms when constructing
5555 7 or renovating public buildings.
5656 8 Sec. 8. (a) The authority shall administer the grant program.
5757 9 The authority shall do the following:
5858 10 (1) Adopt guidelines to determine standards for awarding
5959 11 grants under this chapter, including standards for
6060 12 determining whether a lactation room complies with section
6161 13 9 of this chapter and any other applicable governmental or
6262 14 other nationally recognized standards that apply to the
6363 15 provision of lactation rooms in public buildings.
6464 16 (2) Prepare and supervise the issuance of public information
6565 17 concerning the grant program.
6666 18 (3) Prescribe the form for and regulate the submission of
6767 19 applications for grants under this chapter.
6868 20 (b) A public agency may apply in the manner prescribed by the
6969 21 authority for a grant under this chapter to offset costs incurred in
7070 22 the installation of a lactation room in a public building managed by
7171 23 the public agency.
7272 24 Sec. 9. A lactation room installed by a public agency that
7373 25 receives a grant under this chapter must meet the following
7474 26 standards:
7575 27 (1) The space must be shielded from view and free from
7676 28 intrusion of others.
7777 29 (2) The room must be functional, with a private space with a
7878 30 place to sit and a flat surface, other than the floor, to place a
7979 31 breast pump and other supplies.
8080 32 (3) The room must provide the following:
8181 33 (A) Access to electricity for the use of a breast pump.
8282 34 (B) Good lighting.
8383 35 (C) A comfortable temperature.
8484 36 (D) Proper ventilation.
8585 37 Sec. 10. (a) The lactation room grant fund is established to
8686 38 provide grants under this chapter. The authority shall administer
8787 39 the fund.
8888 40 (b) The fund consists of:
8989 41 (1) money appropriated to the fund by the general assembly;
9090 42 (2) money received from state or federal grants or programs

9292 1 for the purposes of this chapter; and
9393 2 (3) donations, gifts, and money received from any other
9494 3 source, including transfers from other funds or accounts.
9595 4 (c) The treasurer of state shall invest the money in the fund not
9696 5 currently needed to meet the obligations of the fund in the same
9797 6 manner as other public funds may be invested.
9898 7 (d) Money in the fund at the end of a state fiscal year does not
9999 8 revert to the state general fund but remains in the fund to be used
100100 9 exclusively for purposes of this chapter.
101101 10 (e) Money in the fund is continuously appropriated for the
102102 11 purposes of this chapter.
103103 12 SECTION 2. [EFFECTIVE JULY 1, 2025] (a) There is
104104 13 appropriated from the state general fund five million dollars
105105 14 ($5,000,000) to the Indiana housing and community development
106106 15 authority for deposit in the lactation room grant fund established
107107 16 by IC 5-16-16-10, as added by this act, for the period beginning
108108 17 July 1, 2025, and ending June 30, 2026.
109109 18 (b) This SECTION expires January 1, 2027.
