36 | 36 | | 6 Sec. 1. This chapter applies to a public agency. |
---|
37 | 37 | | 7 Sec. 2. As used in this chapter, "authority" refers to the Indiana |
---|
38 | 38 | | 8 housing and community development authority created by |
---|
39 | 39 | | 9 IC 5-20-1-3. |

40 | 40 | | 10 Sec. 3. As used in this chapter, "fund" refers to the lactation |
---|
41 | 41 | | 11 room grant fund established by section 10 of this chapter. |

42 | 42 | | 12 Sec. 4. As used in this chapter, "grant program" refers to the |

43 | 43 | | 13 grant program for the installation of lactation rooms established |
---|
44 | 44 | | 14 by section 7 of this chapter. |

45 | 45 | | 15 Sec. 5. As used in this chapter, "lactation room" means a room |
---|
46 | 46 | | 16 designated and equipped for the purpose of allowing mothers to |
---|
47 | 47 | | 17 nurse or express milk in a clean and private setting within a public |

50 | 50 | | 2 Sec. 6. As used in this chapter, "public agency" has the meaning |
---|
51 | 51 | | 3 set forth in IC 5-30-1-11. |
---|
52 | 52 | | 4 Sec. 7. The grant program for the installation of lactation rooms |
---|
53 | 53 | | 5 is established to provide grants to public agencies to offset costs |
---|
54 | 54 | | 6 incurred in the installation of lactation rooms when constructing |
---|
55 | 55 | | 7 or renovating public buildings. |
---|
56 | 56 | | 8 Sec. 8. (a) The authority shall administer the grant program. |
---|
57 | 57 | | 9 The authority shall do the following: |
---|
58 | 58 | | 10 (1) Adopt guidelines to determine standards for awarding |
---|
59 | 59 | | 11 grants under this chapter, including standards for |
---|
60 | 60 | | 12 determining whether a lactation room complies with section |
---|
61 | 61 | | 13 9 of this chapter and any other applicable governmental or |
---|
62 | 62 | | 14 other nationally recognized standards that apply to the |
---|
63 | 63 | | 15 provision of lactation rooms in public buildings. |
---|
64 | 64 | | 16 (2) Prepare and supervise the issuance of public information |
---|
65 | 65 | | 17 concerning the grant program. |
---|
66 | 66 | | 18 (3) Prescribe the form for and regulate the submission of |
---|
67 | 67 | | 19 applications for grants under this chapter. |
---|
68 | 68 | | 20 (b) A public agency may apply in the manner prescribed by the |
---|
69 | 69 | | 21 authority for a grant under this chapter to offset costs incurred in |
---|
70 | 70 | | 22 the installation of a lactation room in a public building managed by |
---|
71 | 71 | | 23 the public agency. |
---|
72 | 72 | | 24 Sec. 9. A lactation room installed by a public agency that |
---|
73 | 73 | | 25 receives a grant under this chapter must meet the following |
---|
74 | 74 | | 26 standards: |
---|
75 | 75 | | 27 (1) The space must be shielded from view and free from |
---|
76 | 76 | | 28 intrusion of others. |
---|
77 | 77 | | 29 (2) The room must be functional, with a private space with a |
---|
78 | 78 | | 30 place to sit and a flat surface, other than the floor, to place a |
---|
79 | 79 | | 31 breast pump and other supplies. |
---|
80 | 80 | | 32 (3) The room must provide the following: |
---|
81 | 81 | | 33 (A) Access to electricity for the use of a breast pump. |
---|
82 | 82 | | 34 (B) Good lighting. |
---|
83 | 83 | | 35 (C) A comfortable temperature. |
---|
84 | 84 | | 36 (D) Proper ventilation. |
---|
85 | 85 | | 37 Sec. 10. (a) The lactation room grant fund is established to |
---|
86 | 86 | | 38 provide grants under this chapter. The authority shall administer |
---|
87 | 87 | | 39 the fund. |
---|
88 | 88 | | 40 (b) The fund consists of: |
---|
89 | 89 | | 41 (1) money appropriated to the fund by the general assembly; |
---|
90 | 90 | | 42 (2) money received from state or federal grants or programs |
---|

92 | 92 | | 1 for the purposes of this chapter; and |
---|
93 | 93 | | 2 (3) donations, gifts, and money received from any other |
---|
94 | 94 | | 3 source, including transfers from other funds or accounts. |

95 | 95 | | 4 (c) The treasurer of state shall invest the money in the fund not |
---|
96 | 96 | | 5 currently needed to meet the obligations of the fund in the same |
---|
97 | 97 | | 6 manner as other public funds may be invested. |
---|
98 | 98 | | 7 (d) Money in the fund at the end of a state fiscal year does not |
---|
99 | 99 | | 8 revert to the state general fund but remains in the fund to be used |
---|
100 | 100 | | 9 exclusively for purposes of this chapter. |

101 | 101 | | 10 (e) Money in the fund is continuously appropriated for the |
---|
102 | 102 | | 11 purposes of this chapter. |
---|
103 | 103 | | 12 SECTION 2. [EFFECTIVE JULY 1, 2025] (a) There is |

104 | 104 | | 13 appropriated from the state general fund five million dollars |
---|
105 | 105 | | 14 ($5,000,000) to the Indiana housing and community development |
---|
106 | 106 | | 15 authority for deposit in the lactation room grant fund established |
---|
107 | 107 | | 16 by IC 5-16-16-10, as added by this act, for the period beginning |

108 | 108 | | 17 July 1, 2025, and ending June 30, 2026. |
