8	8	Provides that the Indiana economic development corporation, the state,
9	9	any instrumentality of the state, or any other public authority, or any
10	10	party negotiating on behalf of any of those entities, may not, after June
11	11	30, 2025, enter into an economic development agreement or contract
12	12	that contains any provision, clause, or language that provides that the
13	13	agreement or contract, or any of its terms, is confidential, or that the
14	14	parties to the agreement or contract are prohibited from disclosing,
15	15	discussing, describing, or commenting upon the terms of the agreement
16	16	or contract.

33	33	A BILL FOR AN ACT to amend the Indiana Code concerning state
34	34	and local administration.
35	35	Be it enacted by the General Assembly of the State of Indiana:
36	36	1 SECTION 1. IC 5-28-5-17 IS ADDED TO THE INDIANA CODE
37	37	2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
38	38	3 1, 2025]: Sec. 17. (a) This section applies to agreements or contracts
39	39	4 for economic development entered into after June 30, 2025, that
40	40	5 contain economic development provisions, including:
41	41	6 (1) tax incentives;
42	42	7 (2) payments in lieu of taxes;
43	43	8 (3) tax abatements;
44	44	9 (4) bonds;
45	45	10 (5) notes;
46	46	11 (6) loans;
47	47	12 (7) grants;
48	48	13 (8) rebates; or
49	49	14 (9) any other economic development incentive.
50	50	15 (b) Notwithstanding any other law, the corporation, the state,
51	51	16 any instrumentality of the state, or any other public authority, or
52	52	17 any party negotiating on behalf of the corporation, the state, any

54	54	1 instrumentality of the state, or any other public authority, may not
55	55	2 enter into an agreement, or contract for economic development
56	56	3 described in subsection (a) that contains any provision, clause, or
57	57	4 language that provides that the agreement or contract, or any of its
58	58	5 terms, is confidential, or that the parties to the agreement or
59	59	6 contract are prohibited from disclosing, discussing, describing, or
60	60	7 commenting upon the terms of the agreement or contract.
