3333 A BILL FOR AN ACT to amend the Indiana Code concerning state
3434 and local administration.
3535 Be it enacted by the General Assembly of the State of Indiana:
3636 1 SECTION 1. IC 5-28-5-17 IS ADDED TO THE INDIANA CODE
3737 2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
3838 3 1, 2025]: Sec. 17. (a) This section applies to agreements or contracts
3939 4 for economic development entered into after June 30, 2025, that
4040 5 contain economic development provisions, including:
4141 6 (1) tax incentives;
4242 7 (2) payments in lieu of taxes;
4343 8 (3) tax abatements;
4444 9 (4) bonds;
4545 10 (5) notes;
4646 11 (6) loans;
4747 12 (7) grants;
4848 13 (8) rebates; or
4949 14 (9) any other economic development incentive.
5050 15 (b) Notwithstanding any other law, the corporation, the state,
5151 16 any instrumentality of the state, or any other public authority, or
5252 17 any party negotiating on behalf of the corporation, the state, any

5454 1 instrumentality of the state, or any other public authority, may not
5555 2 enter into an agreement, or contract for economic development
5656 3 described in subsection (a) that contains any provision, clause, or
5757 4 language that provides that the agreement or contract, or any of its

5959 6 contract are prohibited from disclosing, discussing, describing, or
6060 7 commenting upon the terms of the agreement or contract.
