Provides that a purchasing agent may only make a purchase without soliciting bids or proposals if the purchase qualifies for a special purchase. Requires a contract between a state elected official's office and a contractor to include language disclosing if, in the 12 months preceding the execution of the contract, the contractor or an officer or director of the contractor made a contribution to the state elected official's campaign. Requires a state elected official's office to execute an addendum to a contract if the contractor or an officer or director of the contractor makes a contribution to the state elected official's campaign after the contract is executed and before the end of the contract's term. HOUSE BILL No. 1288 A BILL FOR AN ACT to amend the Indiana Code concerning state and local administration. Be it enacted by the General Assembly of the State of Indiana: 1 SECTION 1. IC 5-22-6-1 IS REPEALED [EFFECTIVE JULY 1, 2 2025]. Sec. 1. The purchasing agency of a governmental body may 3 purchase services using any procedure the governmental body or the 4 purchasing agency of the governmental body considers appropriate. 5 SECTION 2. IC 5-22-6-1.5 IS ADDED TO THE INDIANA CODE 6 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 7 1, 2025]: Sec. 1.5. Unless the purchase is otherwise excluded by law, 8 the purchasing agency of a governmental body must purchase 9 services using one (1) of the procedures under this article. 10 SECTION 3. IC 5-22-10-1 IS AMENDED TO READ AS 11 FOLLOWS [EFFECTIVE JULY 1, 2025]: Sec. 1. Notwithstanding any 12 other provision of this article, A purchasing agent may make a 13 purchase under this chapter without soliciting bids or proposals only 14 if the purchase qualifies for a special purchase under sections 4 15 through 20 of this chapter. 16 SECTION 4. IC 5-22-17-15 IS ADDED TO THE INDIANA CODE 17 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 2025 IN 1288—LS 7208/DI 137 2 1 1, 2025]: Sec. 15. (a) This section applies to a contract between a 2 state elected official's office and a contractor that is entered into, 3 renewed, or amended after June 30, 2025. 4 (b) A state elected official's office must include language in a 5 contract disclosing if, in the twelve (12) months preceding the 6 execution of the contract, the contractor or an officer or director 7 of the contractor made a contribution to the state elected official's 8 campaign. 9 (c) A state elected official's office must prepare and execute an 10 addendum to a contract if the contractor or an officer or director 11 of the contractor makes a contribution to the state elected official's 12 campaign after the contract is executed and before the end of the 13 contract's term. 2025 IN 1288—LS 7208/DI 137
