38+A BILL FOR AN ACT to amend the Indiana Code concerning labor
39+and safety.
1340 Be it enacted by the General Assembly of the State of Indiana:
14-SECTION 1. IC 22-4.1-1-3.5 IS ADDED TO THE INDIANA
15-CODE AS A NEW SECTION TO READ AS FOLLOWS
16-[EFFECTIVE JULY 1, 2025]: Sec. 3.5. "Employment social
17-enterprise" means a nonprofit or for-profit organization that:
18-(1) provides:
19-(A) transitional employment; and
20-(B) social support, including on-the-job and life skills
21-training;
22-to individuals with a barrier to employment, as defined in
23-Section 3(24) of WIOA (29 U.S.C. 3102(24));
24-(2) uses evidence based practices and data driven policies to
25-inform decision making, implement procedures, and measure
26-outcomes; and
27-(3) does one (1) or more of the following:
28-(A) Provides services.
29-(B) Produces goods.
30-(C) Assembles goods.
31-SECTION 2. IC 22-4.1-1-7, AS AMENDED BY P.L.106-2024,
32-SECTION 8, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
33-JULY 1, 2025]: Sec. 7. (a) Except as provided in subsection (b),
34-"workforce related program" means:
35-(1) a program operated, delivered, or enabled, in whole or in part,

37-by a state provider using public funds to offer incentives, funding,
38-support, or guidance for any of the following purposes:
39-(1) (A) Job training.
40-(2) (B) The attainment of an industry recognized certification
41-or credential.
42-(3) (C) The attainment of a postsecondary degree, certificate,
43-or credential.
44-(4) (D) The provision of other types of employment assistance.
45-(5) (E) The promotion of Indiana to workers or the provision
46-of assistance to a worker relocating to Indiana for employment.
47-(6) (F) Any other program that:
48-(A) (i) has, at least in part, the goal of securing employment
49-or better employment for an individual; and
50-(B) (ii) receives funding through WIOA or a state
51-appropriation; or
52-(2) a work based learning program or transitional jobs
53-program that is:
54-(A) through an employment social enterprise; and
55-(B) operated, delivered, or enabled, in whole or in part, by
56-a state provider using public funds.
57-(b) For purposes of IC 22-4.1-24-3, "workforce related program"
58-means a program offering incentives, funding, support, or guidance for
59-any of the following purposes:
60-(1) Job training.
61-(2) The attainment of an industry recognized certification or
62-credential.
63-(3) The attainment of a postsecondary degree, certificate, or
64-credential.
65-(4) The provision of other types of employment assistance.
66-(5) The promotion of Indiana to workers or the provision of
67-assistance to a worker relocating to Indiana for employment.
68-(6) Any other program that has, at least in part, the goal of
69-securing employment or better employment for an individual.
70-The term does not include an apprenticeship program for which
71-funding is received under IC 22-4-25-1(c).
