2828 A BILL FOR AN ACT to amend the Indiana Code concerning
2929 criminal law and procedure.
3030 Be it enacted by the General Assembly of the State of Indiana:
3131 1 SECTION 1. IC 10-11-2-33, AS ADDED BY P.L.161-2014,
3232 2 SECTION 1, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
3333 3 JULY 1, 2025]: Sec. 33. (a) As used in this section, "law
3434 4 enforcement agency" has the meaning set forth in IC 35-47-15-2.
3535 5 (b) The superintendent shall adopt guidelines to accomplish the
3636 6 following:
3737 7 (1) Establish a standard medical forensic examination kit for
3838 8 victims of a sex crime.
3939 9 (2) Create and distribute a reporting form in print or
4040 10 electronic format, or both, for law enforcement agencies to
4141 11 provide the superintendent with the following information
4242 12 concerning medical forensic examination kits:
4343 13 (A) The total number of kits collected by the law
4444 14 enforcement agency.
4545 15 (B) The total number of kits:
4646 16 (i) in the law enforcement agency's possession; and
4747 17 (ii) awaiting testing by a crime lab.

4949 1 (C) The average number of days between a law
5050 2 enforcement agency's submission of a kit to a crime lab for
5151 3 testing and the production of the kit's test results.
5252 4 (c) The information described in subsection (b)(2) shall be
5353 5 provided to the superintendent:
5454 6 (1) in the manner prescribed by the guidelines adopted under
5555 7 this section; and
5656 8 (2) not later than July 1 of each year.
5757 9 (b) (d) The superintendent shall distribute the standard medical
5858 10 forensic examination kits to hospitals and other health care providers
5959 11 who may provide forensic medical examinations to the victims of a sex
6060 12 crime. The superintendent may adopt guidelines to carry out this
6161 13 subsection.
6262 14 (e) The superintendent shall provide a summary of the
6363 15 information described in subsection (b)(2) in an electronic format
6464 16 under IC 5-14-6 to the legislative council before September 1 of
6565 17 each year for the preceding state fiscal year.
