77 Synopsis: Artificial intelligence inventory and policies. Requires the
88 department of education (department) to establish the following: (1)
99 Guidelines and a model policy regarding school artificial intelligence
1010 policies. (2) An inventory of artificial intelligence platforms that
1111 includes certain information. (3) A process and review by which
1212 teachers and school administrators may submit an artificial intelligence
1313 platform for inclusion on the inventory. Requires the department to: (1)
1414 conduct a survey of teachers and students regarding artificial
1515 intelligence platforms; and (2) submit a report regarding the results of
1616 the survey to the governor, legislative council, and members of the
1717 artificial intelligence task force. Requires school corporations and
1818 charter schools to adopt, post, and communicate to students a school
1919 policy regarding artificial intelligence. Prohibits school corporations,
2020 charter schools, and employees of a school corporation or charter
2121 school from penalizing a student based solely on evidence provided by
2222 an artificial intelligence detector.

3838 A BILL FOR AN ACT to amend the Indiana Code concerning
3939 education.
4040 Be it enacted by the General Assembly of the State of Indiana:
4141 1 SECTION 1. IC 20-19-3-36 IS ADDED TO THE INDIANA CODE
4242 2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
4343 3 1, 2025]: Sec. 36. (a) The department shall establish the following:
4444 4 (1) Guidelines for creating a school corporation or charter
4545 5 school artificial intelligence policy.
4646 6 (2) A model school artificial intelligence policy.
4747 7 (3) An inventory of artificial intelligence platforms that:
4848 8 (A) is representative of available artificial intelligence
4949 9 platforms and includes at least twenty (20) platforms;
5050 10 (B) includes a classification by the department as to
5151 11 whether the platforms are supported or discouraged for
5252 12 use in a school;
5353 13 (C) is updated annually; and
5454 14 (D) is entitled "Indiana Department of Education AI
5555 15 Technology Resource Inventory".
5656 16 (b) The department shall establish a process and review by
5757 17 which teachers and school administrators may submit an artificial

5959 1 intelligence platform for inclusion in the inventory established
6060 2 under subsection (a)(3).
6161 3 (c) The guidelines established by the department under
6262 4 subsection (a)(1) must include the following:
6363 5 (1) Information regarding the growing role of artificial
6464 6 intelligence platforms in the world, including in education.
6565 7 (2) The factors the department used in determining the
6666 8 classifications of artificial intelligence platforms in the
6767 9 inventory described in subsection (a)(3).
6868 10 (3) An inventory, including a description, of artificial
6969 11 intelligence platform resources available to students and
7070 12 teachers.
7171 13 (4) Disclosure requirements for students concerning the use
7272 14 of artificial intelligence platforms on school assignments.
7373 15 (5) Recommendations on restricting or prohibiting the use of
7474 16 artificial intelligence platforms by students.
7575 17 (6) For artificial intelligence platforms included in the
7676 18 inventory established by the department under subsection
7777 19 (a)(3), the:
7878 20 (A) proper and improper use by students and teachers of
7979 21 the artificial intelligence platforms, including examples of
8080 22 proper and improper use; and
8181 23 (B) privacy policies regarding the artificial intelligence
8282 24 platforms.
8383 25 (d) The department shall do the following:
8484 26 (1) Conduct a survey of teachers and students from urban,
8585 27 suburban, and rural school corporations and charter schools
8686 28 regarding the following:
8787 29 (A) Use and usefulness of specific artificial intelligence
8888 30 platforms.
8989 31 (B) Teacher and student experiences using specific
9090 32 artificial intelligence platforms.
9191 33 (C) Whether the training to use specific artificial
9292 34 intelligence platforms was effective.
9393 35 (D) The impact of artificial intelligence platforms on
9494 36 student learning and teaching practices and instruction.
9595 37 (2) Prepare a report each year that summarizes the
9696 38 information from the survey conducted under subdivision (1).
9797 39 (3) Not later than November 1 of each year, submit the report
9898 40 prepared under subdivision (2) to the following:
9999 41 (A) The governor.
100100 42 (B) The legislative council in an electronic format under

102102 1 IC 5-14-6.
103103 2 (C) The members of the artificial intelligence task force
104104 3 established by IC 2-5-53.7-4 in an electronic format under
105105 4 IC 5-14-6. This clause expires December 31, 2027.
106106 5 (e) The department shall publish artificial intelligence
107107 6 educational materials for students and parents of students on the
108108 7 department's website.
109109 8 SECTION 2. IC 20-26-5-45 IS ADDED TO THE INDIANA CODE
110110 9 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
111111 10 1, 2025]: Sec. 45. (a) Each school corporation and charter school
112112 11 shall adopt a policy regarding artificial intelligence that includes
113113 12 the following:
114114 13 (1) Any restrictions or prohibitions by the school corporation
115115 14 or charter school on the use of artificial intelligence platforms
116116 15 by students.
117117 16 (2) An inventory of artificial intelligence platforms approved
118118 17 for student use by the school corporation or charter school.
119119 18 (3) A method and process for allowing teachers to report the
120120 19 use of artificial intelligence platforms in:
121121 20 (A) violation of the policy adopted under this section; or
122122 21 (B) a manner that was not permitted by the teacher:
123123 22 (i) for the applicable assignment; or
124124 23 (ii) in the teacher's classroom.
125125 24 (4) For a high school of a school corporation or a charter high
126126 25 school, a formal review process for reports received under
127127 26 subdivision (3).
128128 27 (5) Disclosure requirements for students concerning the use
129129 28 of artificial intelligence platforms on school assignments.
130130 29 (b) Each school corporation and charter school shall do the
131131 30 following:
132132 31 (1) Post the policy adopted under subsection (a) on the website
133133 32 of the school corporation or charter school.
134134 33 (2) Clearly communicate the policy to students of the school
135135 34 corporation or charter school.
136136 35 SECTION 3. IC 20-26-5-46 IS ADDED TO THE INDIANA CODE
137137 36 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
138138 37 1, 2025]: Sec. 46. A school corporation, charter school, or employee
139139 38 of a school corporation or charter school may not penalize a
140140 39 student based solely on evidence provided by an artificial
141141 40 intelligence detector.
