25	25	A BILL FOR AN ACT to amend the Indiana Code concerning
26	26	general provisions.
27	27	Be it enacted by the General Assembly of the State of Indiana:
28	28	1 SECTION 1. IC 1-1-9-1 IS AMENDED TO READ AS FOLLOWS
29	29	2 [EFFECTIVE UPON PASSAGE]: Sec. 1. (a) The following are legal
30	30	3 holidays within the state of Indiana for all purposes:
31	31	4 New Year's Day, January 1.
32	32	5 Martin Luther King, Jr.'s Birthday, the third Monday in January.
33	33	6 Abraham Lincoln's Birthday, February 12.
34	34	7 George Washington's Birthday, the third Monday in February.
35	35	8 Good Friday, a movable feast day.
36	36	9 Memorial Day, the last Monday in May.
37	37	10 Juneteenth, June 19.
38	38	11 Independence Day, July 4.
39	39	12 Labor Day, the first Monday in September.
40	40	13 Columbus Day, the second Monday in October.
41	41	14 Election Day, the day of any general, municipal, or primary
42	42	15 election.
43	43	16 Veterans Day, November 11.
44	44	17 Thanksgiving Day, the fourth Thursday in November.

48	48	3 (b) When any of these holidays, other than Sunday, comes on
49	49	4 Sunday, the following Monday shall be the legal holiday. When any of
50	50	5 these holidays comes on Saturday, the preceding Friday shall be the
51	51	6 legal holiday.
52	52	7 (c) This section does not affect any action taken by the state, the
53	53	8 general assembly while in session, or a political subdivision (as defined
54	54	9 in IC 36-1-2-13). Any action taken by the state, the general assembly,
55	55	10 or a political subdivision on any such holiday shall be valid for all
56	56	11 purposes.
57	57	12 SECTION 2. IC 15-17-5-12, AS ADDED BY P.L.2-2008,
58	58	13 SECTION 8, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
59	59	14 UPON PASSAGE]: Sec. 12. (a) Except as provided in subsection (b),
60	60	15 the board is not required to furnish meat or poultry inspection under
61	61	16 this chapter:
62	62	17 (1) for more than eight (8) hours in one (1) day;
63	63	18 (2) for more than forty (40) hours in one (1) calendar week; or
64	64	19 (3) on Saturdays, Sundays, or the following legal holidays:
65	65	20 (A) New Year's Day.
66	66	21 (B) Washington's Birthday.
67	67	22 (C) Memorial Day.
68	68	23 (D) Martin Luther King, Jr. Day.
69	69	24 (E) Juneteenth.
70	70	25 (E) (F) Columbus Day.
71	71	26 (F) (G) Independence Day.

76	76	31 (b) If the operator of an establishment under inspection pays to the
77	77	32 board an hourly fee for each hour of state meat or poultry inspection
78	78	33 furnished:
79	79	34 (1) more than eight (8) hours in one (1) day;
80	80	35 (2) more than forty (40) hours in one (1) calendar week; or
81	81	36 (3) on Saturdays, Sundays, and legal holidays;
82	82	37 the board shall furnish the inspection service.
83	83	38 (c) Subject to the approval of the budget agency, the board shall
84	84	39 establish an hourly rate for overtime at an amount sufficient to defray
85	85	40 the cost of the inspection service. The establishment shall reimburse
86	86	41 the board not later than thirty (30) days after assessment for overtime
87	87	42 or legal overtime fees collected under this chapter. The fees must be

89	89	1 deposited with the treasurer of state. All overtime fees deposited with
90	90	2 the treasurer of state under this subsection are appropriated to the
91	91	3 budget agency for allotment to the board for the administration and
92	92	4 enforcement of this chapter.
93	93	5 (d) The board may assign inspection personnel to more than one (1)
94	94	6 establishment in order to efficiently use board personnel and resources.
95	95	7 SECTION 3. An emergency is declared for this act.
