2525 A BILL FOR AN ACT to amend the Indiana Code concerning
2626 general provisions.
2727 Be it enacted by the General Assembly of the State of Indiana:
2828 1 SECTION 1. IC 1-1-9-1 IS AMENDED TO READ AS FOLLOWS
2929 2 [EFFECTIVE UPON PASSAGE]: Sec. 1. (a) The following are legal
3030 3 holidays within the state of Indiana for all purposes:
3131 4 New Year's Day, January 1.
3232 5 Martin Luther King, Jr.'s Birthday, the third Monday in January.
3333 6 Abraham Lincoln's Birthday, February 12.
3434 7 George Washington's Birthday, the third Monday in February.
3535 8 Good Friday, a movable feast day.
3636 9 Memorial Day, the last Monday in May.
3737 10 Juneteenth, June 19.
3838 11 Independence Day, July 4.
3939 12 Labor Day, the first Monday in September.
4040 13 Columbus Day, the second Monday in October.
4141 14 Election Day, the day of any general, municipal, or primary
4242 15 election.
4343 16 Veterans Day, November 11.
4444 17 Thanksgiving Day, the fourth Thursday in November.

4848 3 (b) When any of these holidays, other than Sunday, comes on

5252 7 (c) This section does not affect any action taken by the state, the
5353 8 general assembly while in session, or a political subdivision (as defined
5454 9 in IC 36-1-2-13). Any action taken by the state, the general assembly,
5555 10 or a political subdivision on any such holiday shall be valid for all

5959 14 UPON PASSAGE]: Sec. 12. (a) Except as provided in subsection (b),
6060 15 the board is not required to furnish meat or poultry inspection under
6161 16 this chapter:
6262 17 (1) for more than eight (8) hours in one (1) day;
6363 18 (2) for more than forty (40) hours in one (1) calendar week; or
6464 19 (3) on Saturdays, Sundays, or the following legal holidays:
6565 20 (A) New Year's Day.
6666 21 (B) Washington's Birthday.
6767 22 (C) Memorial Day.
6868 23 (D) Martin Luther King, Jr. Day.
6969 24 (E) Juneteenth.

7676 31 (b) If the operator of an establishment under inspection pays to the
7777 32 board an hourly fee for each hour of state meat or poultry inspection
7878 33 furnished:
7979 34 (1) more than eight (8) hours in one (1) day;
8080 35 (2) more than forty (40) hours in one (1) calendar week; or
8181 36 (3) on Saturdays, Sundays, and legal holidays;
8282 37 the board shall furnish the inspection service.
8383 38 (c) Subject to the approval of the budget agency, the board shall
8484 39 establish an hourly rate for overtime at an amount sufficient to defray
8585 40 the cost of the inspection service. The establishment shall reimburse
8686 41 the board not later than thirty (30) days after assessment for overtime
8787 42 or legal overtime fees collected under this chapter. The fees must be

8989 1 deposited with the treasurer of state. All overtime fees deposited with
9090 2 the treasurer of state under this subsection are appropriated to the
9191 3 budget agency for allotment to the board for the administration and
9292 4 enforcement of this chapter.
9393 5 (d) The board may assign inspection personnel to more than one (1)
9494 6 establishment in order to efficiently use board personnel and resources.
9595 7 SECTION 3. An emergency is declared for this act.
