2525 A BILL FOR AN ACT to amend the Indiana Code concerning
2626 human services.
2727 Be it enacted by the General Assembly of the State of Indiana:
2828 1 SECTION 1. IC 12-10-11.3 IS ADDED TO THE INDIANA CODE
2929 2 AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE
3030 3 JULY 1, 2025]:
3131 4 Chapter 11.3. Hoosier Scam Prevention Board
3232 5 Sec. 1. As used in this chapter, "board" refers to the Hoosier
3333 6 scam prevention board established under this chapter.
3434 7 Sec. 2. (a) The Hoosier scam prevention board is established
3535 8 under the executive branch of state government as a continuing
3636 9 board.
3737 10 (b) The purpose of the board is to:
3838 11 (1) collect information on the existence, use, and success of
3939 12 educational materials and programs for consumers, retailers,
4040 13 financial services companies, and wire transfer companies,
4141 14 which:
4242 15 (A) may be used as a guide to educate seniors, consumers,
4343 16 employers, and employees on how to identify and prevent
4444 17 scams that affect citizens of Indiana; and

4646 1 (B) include:
4747 2 (i) useful information for seniors, consumers, retailers,
4848 3 financial services companies, and wire transfer
4949 4 companies for the purpose described in clause (A);
5050 5 (ii) training for seniors, consumers, employers, and
5151 6 employees on ways to identify and prevent scams;
5252 7 (iii) best practices for keeping seniors, consumers,
5353 8 employers, and employees up to date on current scams;
5454 9 (iv) the most effective signage and placement in retail
5555 10 locations to warn citizens of Indiana about scammers'
5656 11 use of gift cards, prepaid cards, and wire transfer
5757 12 services to carry out a scam;
5858 13 (v) suggestions on effective collaborative community
5959 14 education campaigns;
6060 15 (vi) available technology to assist in identifying possible
6161 16 scams at the point of sale; and
6262 17 (vii) other information that would be helpful to seniors,
6363 18 consumers, employers, employees, and retailers, wire
6464 19 transfer companies, financial services companies, and
6565 20 their employees as they work to prevent fraud;
6666 21 (2) identify inadequacies, omissions, or deficiencies in those
6767 22 educational materials and programs described in subdivision
6868 23 (1) and their execution in reaching seniors, consumers,
6969 24 employers, and employees to protect citizens of Indiana; and
7070 25 (3) create:
7171 26 (A) model materials;
7272 27 (B) best practices guidance; or
7373 28 (C) recommendations;
7474 29 to address the inadequacies, omissions, or deficiencies
7575 30 described in subdivision (2) that may be used by industries
7676 31 and others to help protect citizens of Indiana from scams.
7777 32 (c) Any:
7878 33 (1) materials created by the board; or
7979 34 (2) findings made by the board;
8080 35 under subsection (b) shall be posted on the attorney general's
8181 36 website.
8282 37 Sec. 3. (a) The board consists of the following fifteen (15) voting
8383 38 members:
8484 39 (1) The attorney general, or the attorney general's designee.
8585 40 (2) One (1) representative from each of the following:
8686 41 (A) AARP, formerly known as the American Association
8787 42 of Retired Persons.

8989 1 (B) The Indiana Association of Area Agencies on Aging.
9090 2 (C) The department of insurance.
9191 3 (D) The state Medicaid fraud control unit.
9292 4 (E) The state police.
9393 5 (F) The adult protective services unit.
9494 6 (G) The Indiana minority health coalition.
9595 7 (H) CICOA Aging and In-Home Solutions.
9696 8 (I) The department of financial institutions.
9797 9 (J) The long term care ombudsman.
9898 10 (K) The consumer protection division of the office of the
9999 11 attorney general.
100100 12 (L) The division.
101101 13 (3) Two (2) representatives from consumer advocacy groups
102102 14 or charitable organizations.
103103 15 (b) The members of the board designated under subsection
104104 16 (a)(2) and (a)(3) shall be appointed by the governor for terms of
105105 17 two (2) years ending on June 30 of an odd-numbered year.
106106 18 Sec. 4. (a) The governor shall appoint a chairperson of the board
107107 19 from among its membership.
108108 20 (b) The chairperson's term shall last two (2) years.
109109 21 (c) The chairperson serves at the will of the governor and may
110110 22 be reappointed to additional terms.
111111 23 Sec. 5. A vacancy on the board shall be filled by the appointing
112112 24 authority to meet the same qualifications as the vacating member
113113 25 and to fill the remainder of the vacating member's term.
114114 26 Sec. 6. The board shall meet at the call of the chairperson at
115115 27 least one (1) time annually.
116116 28 Sec. 7. Eight (8) members of the board constitute a quorum.
117117 29 Sec. 8. The division shall provide staff services for the board.
118118 30 Sec. 9. The expenses of the board shall be paid from the state
119119 31 general fund.
120120 32 Sec. 10. Each member of the board who is not a state employee
121121 33 is not entitled to the minimum salary per diem provided by
122122 34 IC 4-10-11-2.1(b). The member is, however, entitled to
123123 35 reimbursement for mileage and traveling expenses as provided
124124 36 under IC 4-13-1-4 and other expenses actually incurred in
125125 37 connection with the member's duties as provided in the state
126126 38 policies and procedures established by the Indiana department of
127127 39 administration and approved by the budget agency.
128128 40 Sec. 11. Each member of the board who is a state employee is
129129 41 entitled to reimbursement for mileage and traveling expenses as
130130 42 provided under IC 4-13-1-4 and other expenses actually incurred

132132 1 in connection with the member's duties as provided in the state
133133 2 policies and procedures established by the Indiana department of
134134 3 administration and approved by the budget agency.
135135 4 Sec. 12. The affirmative votes of a majority of the voting
136136 5 members appointed to the board are required for the board to take
137137 6 action on any measure, including reports prepared at the request
138138 7 of the attorney general or the division.
