3131 A BILL FOR AN ACT to amend the Indiana Code concerning
3232 health.
3333 Be it enacted by the General Assembly of the State of Indiana:
3434 1 SECTION 1. IC 16-19-3-34.5 IS ADDED TO THE INDIANA
3535 2 CODE AS A NEW SECTION TO READ AS FOLLOWS
3636 3 [EFFECTIVE JULY 1, 2025]: Sec. 34.5. (a) As used in this section,
3737 4 "practitioner" means the following:
3838 5 (1) A physician licensed under IC 25-22.5.
3939 6 (2) A nurse licensed under IC 25-23.
4040 7 (3) A physician assistant licensed under IC 25-27.5.
4141 8 (4) A certified nurse midwife (as defined in IC 34-18-2-6.5).
4242 9 (5) A certified direct entry midwife certified under IC 25-23.4.
4343 10 (6) Any other health care practitioner who provides emergent
4444 11 or nonemergent gynecological or obstetric care, including the
4545 12 following:
4646 13 (A) Maternal fetal medicine.
4747 14 (B) Emergency medicine.
4848 15 (C) Family medicine.
4949 16 (D) Labor and delivery.
5050 17 (b) The state department shall create a video for practitioners

5252 1 that explains and describes the:
5353 2 (1) state's abortion laws; and
5454 3 (2) standard of care for practitioners when treating pregnant
5555 4 women diagnosed with life threatening conditions or serious
5656 5 health risks (as defined in IC 16-18-2-327.9).
5757 6 (c) The video described in subsection (b) must provide
5858 7 information on the following:
5959 8 (1) The state's abortion laws, including:
6060 9 (A) the definition of abortion;
6161 10 (B) requirements to be met by a practitioner before and
6262 11 after an abortion; and
6363 12 (C) enforcement of the state's abortion laws.
6464 13 (2) Medical treatment options for pregnant women and their
6565 14 unborn children for the most common conditions that
6666 15 threaten a woman's or unborn child's life or health.
6767 16 (3) Reporting requirements for abortion, including:
6868 17 (A) abortion complication reports under IC 16-34-2-4.7;
6969 18 (B) terminated pregnancy reports under IC 16-34-2-5; and
7070 19 (C) reporting of adverse events to state or federal agencies.
7171 20 The information described in subdivision (2) must be explained
7272 21 using the standard of care based on a practitioner's reasonable
7373 22 medical judgment.
7474 23 (d) The state department shall publish the video created under
7575 24 this section and any supplemental materials on the state
7676 25 department's website.
7777 26 SECTION 2. IC 16-21-2-12.7 IS ADDED TO THE INDIANA
7878 27 CODE AS A NEW SECTION TO READ AS FOLLOWS
7979 28 [EFFECTIVE JULY 1, 2025]: Sec. 12.7. (a) As used in this section,
8080 29 "abortion education video" refers to the video created by the state
8181 30 department under IC 16-19-3-34.5.
8282 31 (b) Each hospital and ambulatory outpatient surgical center
8383 32 shall do the following:
8484 33 (1) Review the hospital's or ambulatory outpatient surgical
8585 34 center's protocol for abortions to ensure compliance with
8686 35 IC 16-34.
8787 36 (2) Provide the protocols described in subdivision (1) to each
8888 37 practitioner (as defined in IC 16-19-3-34.5) who:
8989 38 (A) is an employee, staff member, or independent
9090 39 contractor of; or
9191 40 (B) has admitting privileges at;
9292 41 the hospital or ambulatory outpatient surgical center.
9393 42 (3) Require each practitioner described in subdivision (2) to

9595 1 watch the abortion education video.
9696 2 (4) Provide a signed certification to the state department, in
9797 3 a manner prescribed by the state department, that the
9898 4 hospital or ambulatory outpatient surgical center is in
9999 5 compliance with the requirements of this section.
100100 6 (c) The state department shall:
101101 7 (1) maintain a certification form submitted by a hospital or
102102 8 ambulatory outpatient surgical center under this section; and
103103 9 (2) upon request, make a certification form described in
104104 10 subdivision (1) public under IC 5-14-3.
