2929 A BILL FOR AN ACT to amend the Indiana Code concerning
3030 motor vehicles.
3131 Be it enacted by the General Assembly of the State of Indiana:
3232 1 SECTION 1. IC 9-24-10-4, AS AMENDED BY P.L.111-2021,
3333 2 SECTION 59, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
3434 3 JULY 1, 2025]: Sec. 4. (a) Except as provided in subsection (c), an
3535 4 examination for a learner's permit or driver's license must include the
3636 5 following:
3737 6 (1) A test of the following of the applicant:
3838 7 (A) Eyesight.
3939 8 (B) Ability to read and understand highway signs regulating,
4040 9 warning, and directing traffic.
4141 10 (C) Knowledge of Indiana traffic laws, including
4242 11 IC 9-26-1-1.5, IC 9-21-8-35, and IC 9-21-12-1.
4343 12 (2) An actual demonstration of the applicant's skill in exercising
4444 13 ordinary and reasonable control in the operation of a motor
4545 14 vehicle under the type of permit or driver's license applied for.
4646 15 (b) The examination may include further physical and mental
4747 16 examination that the bureau finds necessary to determine the
4848 17 applicant's fitness to operate a motor vehicle safely upon a highway.

5050 1 The applicant must provide the motor vehicle used in the examination.
5151 2 An autocycle may not be used as the motor vehicle provided for the
5252 3 examination.
5353 4 (c) The bureau may waive:
5454 5 (1) the testing required under subsection (a)(1)(A) if the applicant
5555 6 provides evidence from a licensed ophthalmologist or licensed
5656 7 optometrist that the applicant's vision is fit to operate a motor
5757 8 vehicle in a manner that does not jeopardize the safety of
5858 9 individuals or property;
5959 10 (2) the actual demonstration required under subsection (a)(2) for
6060 11 an individual who has passed:
6161 12 (A) a driver's education class and a skills test given by a driver
6262 13 training school;
6363 14 (B) a driver education program given by an entity licensed
6464 15 under IC 9-27; or
6565 16 (C) a skills assessment conducted by a third party approved by
6666 17 the bureau;
6767 18 (3) the testing, other than eyesight testing under subsection
6868 19 (a)(1)(A), of an applicant who has passed:
6969 20 (A) an examination concerning:
7070 21 (i) subsection (a)(1)(B); and
7171 22 (ii) subsection (a)(1)(C); and
7272 23 (B) a skills test;
7373 24 given by a driver training school or an entity licensed under
7474 25 IC 9-27; and
7575 26 (4) the testing, other than the eyesight testing described in
7676 27 subsection (a)(1)(A), of an applicant who:
7777 28 (A) is at least eighteen (18) years of age;
7878 29 (B) was previously a nonresident but now qualifies as an
7979 30 Indiana resident at the time of application; and
8080 31 (C) holds a valid driver's license, excluding a learner's permit
8181 32 or its equivalent, from the applicant's state of prior residence.
8282 33 (d) The following are not civilly or criminally liable for a report
8383 34 made in good faith to the bureau, commission, or driver licensing
8484 35 medical advisory board concerning the fitness of the applicant to
8585 36 operate a motor vehicle in a manner that does not jeopardize the safety
8686 37 of individuals or property:
8787 38 (1) An instructor having a license under IC 9-27-6-8.
8888 39 (2) A licensed ophthalmologist or licensed optometrist.
8989 40 (e) The testing required under subsection (a)(1)(C) must include
9090 41 a question regarding the requirements of IC 9-21-8-35. If an
9191 42 applicant provides an incorrect answer to the question, the

9393 1 applicant automatically fails the testing required under subsection
9494 2 (a)(1)(C).
