45	35		A BILL FOR AN ACT to amend the Indiana Code concerning
46	36		public safety.
47	37		Be it enacted by the General Assembly of the State of Indiana:
48	38		1 SECTION 1. IC 10-11-2-35.5 IS ADDED TO THE INDIANA
49	39		2 CODE AS A NEW SECTION TO READ AS FOLLOWS
50	40		3 [EFFECTIVE JULY 1, 2025]: Sec. 35.5. (a) The rape kit backlog
51	41		4 fund is established for the purpose of providing funds for assisting
52	42		5 law enforcement agencies and testing labs in eliminating the
53	43		6 backlog of untested rape kits.
54	44		7 (b) Funds disbursed under this section may be used to:
55	45		8 (1) purchase equipment used to process rape kits;
56	46		9 (2) process rape kits;
57	47		10 (3) hire staff;
58	48		11 (4) provide competitive wages for employees; and
59	49		12 (5) pay costs associated with streamlining the processing of
60	50		13 rape kits.
61	51		14 (c) The fund shall be administered by the state police
62	52		15 department.
63	53		16 (d) The fund consists of:
64	54		17 (1) money deposited in the fund under subsection (f);

66	56		1 (2) grants; and
67	57		2 (3) donations.
68	58		3 (e) The expenses of administering the fund shall be paid from
69	59		4 money in the fund.
70	60		5 (f) The treasurer of state shall invest money in the fund not
71	61		6 currently needed to meet the obligations of the fund in the same
72	62		7 manner as other public money may be invested. Interest that
73	63		8 accrues from these investments shall be deposited in the fund.
74	64		9 (g) Money in the fund at the end of a state fiscal year does not
75	65		10 revert to the state general fund.
76	66		11 (h) The state police department shall make grants to law
77	67		12 enforcement agencies and testing labs, including the crime lab
78	68		13 within the state police department, to eliminate the backlog of
79	69		14 untested rape kits as provided in subsection (b).
80	70		15 (i) Before November 1 of each year, the state police department
81	71		16 shall report to the general assembly:
82	72		17 (1) the status of the backlog of untested rape kits in Indiana;
83	73		18 and
84	74		19 (2) how funds under this section were directed to eliminate the
85	75		20 backlog of untested rape kits for the prior calendar year.
86	76		21 The report to the general assembly must be in an electronic format
87	77		22 under IC 5-14-6.
88	78		23 (j) Before January 1, 2027, every law enforcement agency and
89	79		24 testing lab shall process each rape kit that is:
90	80		25 (1) in its possession;
91	81		26 (2) not completely processed; and
92	82		27 (3) the subject of a police report that has been filed;
93	83		28 as of July 1, 2025. The state police department shall notify each law
94	84		29 enforcement agency of this requirement by September 1, 2025.
