4535 A BILL FOR AN ACT to amend the Indiana Code concerning
4636 public safety.
4737 Be it enacted by the General Assembly of the State of Indiana:
4838 1 SECTION 1. IC 10-11-2-35.5 IS ADDED TO THE INDIANA
4939 2 CODE AS A NEW SECTION TO READ AS FOLLOWS
5040 3 [EFFECTIVE JULY 1, 2025]: Sec. 35.5. (a) The rape kit backlog
5141 4 fund is established for the purpose of providing funds for assisting
5242 5 law enforcement agencies and testing labs in eliminating the
5343 6 backlog of untested rape kits.
5444 7 (b) Funds disbursed under this section may be used to:
5545 8 (1) purchase equipment used to process rape kits;
5646 9 (2) process rape kits;
5747 10 (3) hire staff;
5848 11 (4) provide competitive wages for employees; and
5949 12 (5) pay costs associated with streamlining the processing of
6050 13 rape kits.
6151 14 (c) The fund shall be administered by the state police
6252 15 department.
6353 16 (d) The fund consists of:
6454 17 (1) money deposited in the fund under subsection (f);

6656 1 (2) grants; and
6757 2 (3) donations.
6858 3 (e) The expenses of administering the fund shall be paid from
6959 4 money in the fund.
7060 5 (f) The treasurer of state shall invest money in the fund not
7161 6 currently needed to meet the obligations of the fund in the same
7262 7 manner as other public money may be invested. Interest that
7363 8 accrues from these investments shall be deposited in the fund.
7464 9 (g) Money in the fund at the end of a state fiscal year does not
7565 10 revert to the state general fund.
7666 11 (h) The state police department shall make grants to law
7767 12 enforcement agencies and testing labs, including the crime lab
7868 13 within the state police department, to eliminate the backlog of
7969 14 untested rape kits as provided in subsection (b).
8070 15 (i) Before November 1 of each year, the state police department
8171 16 shall report to the general assembly:
8272 17 (1) the status of the backlog of untested rape kits in Indiana;
8373 18 and
8474 19 (2) how funds under this section were directed to eliminate the
8575 20 backlog of untested rape kits for the prior calendar year.
8676 21 The report to the general assembly must be in an electronic format
8777 22 under IC 5-14-6.
8878 23 (j) Before January 1, 2027, every law enforcement agency and
8979 24 testing lab shall process each rape kit that is:
9080 25 (1) in its possession;
9181 26 (2) not completely processed; and
9282 27 (3) the subject of a police report that has been filed;
9383 28 as of July 1, 2025. The state police department shall notify each law
9484 29 enforcement agency of this requirement by September 1, 2025.
