50	43		A BILL FOR AN ACT to amend the Indiana Code concerning
51	44		agriculture and animals.
52	45		Be it enacted by the General Assembly of the State of Indiana:
53	46		1 SECTION 1. IC 15-17-2-22.5 IS ADDED TO THE INDIANA
54	47		2 CODE AS A NEW SECTION TO READ AS FOLLOWS
55	48		3 [EFFECTIVE JULY 1, 2025]: Sec. 22.5. "Cultivated meat product"
56	49		4 means animal protein grown in a facility from extracted animal
57	50		5 stem cells and arranged in a similar structure as animal tissues to
58	51		6 replicate the sensory and nutritional profiles of meat products.
59	52		7 SECTION 2. IC 15-17-2-54, AS ADDED BY P.L.2-2008,
60	53		8 SECTION 8, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
61	54		9 JULY 1, 2025]: Sec. 54. (a) "Meat food product" and "meat product"
62	55		10 means a product capable of use as human food that is made wholly or
63	56		11 in part from meat or other part of the carcass of:
64	57		12 (1) cattle;
65	58		13 (2) sheep;
66	59		14 (3) swine;
67	60		15 (4) equines;
68	61		16 (5) bison;
69	62		17 (6) farm raised cervidae;

71	64		1 (7) ratitae; or
72	65		2 (8) goats.
73	66		3 (b) The term does not include products that:
74	67		4 (1) contain meat or other parts of such carcasses only in a
75	68		5 relatively small proportion; or
76	69		6 (2) historically have not been considered by consumers as
77	70		7 products of the meat food industry and that are exempted from
78	71		8 definition as a meat food product by the state veterinarian under
79	72		9 conditions the state veterinarian prescribes to ensure that the meat
80	73		10 or other parts of the carcass contained in the product are not
81	74		11 adulterated and that the products are not represented as meat food
82	75		12 products.
83	76		13 (c) The term does not include an alternative meat product.
84	77		14 SECTION 3. IC 15-17-2-83, AS ADDED BY P.L.2-2008,
85	78		15 SECTION 8, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
86	79		16 JULY 1, 2025]: Sec. 83. (a) "Person" means any individual, trustee,
87	80		17 receiver, corporation, limited liability company, partnership, and any
88	81		18 other firm, organization, association, cooperative, or group of
89	82		19 individuals or persons.
90		-	20 (b) "Person", for purposes of IC 15-17-5-6.~~1 and IC 15-17-5-6.~~5,
91		-	21 ~~means any~~ individual, trustee, receiver, corporation, limited
92		-	22 ~~liability company,~~ partnership, official establishment (as defined
93		-	23 ~~in section 72 of this chapter),~~ and any other firm, organization,
94		-	24 ~~association, cooperative, or~~ group of individuals or persons.

97		-	27 ~~[EFFECTIVE JULY~~ 1, ~~2026~~]: Sec. ~~103~~. ~~"Wholesaler", for purposes~~
98		-	28 ~~of IC 15-17-5-6.5, means any person that sells or distributes~~ meat
99		-	29 ~~products or~~ cultivated meat ~~products to another person for~~ the
100		-	30 ~~purpose of resale.~~
101		-	31 ~~SECTION 5. IC 15-17-5-6.1 IS ADDED TO THE INDIANA CODE~~
102		-	32 ~~AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY~~
103		-	33 ~~1, 2025]: Sec. 6.1.~~ (a) ~~A person shall not:~~
104		-	34 ~~(1) sell;~~
105		-	35 ~~(2) offer for sale;~~ or
106		-	36 ~~(3) manufacture;~~
107		-	37 a ~~cultivated meat product in Indiana during the period beginning~~
108		-	38 ~~July 1,~~ ~~2025, and ending June 30, 2026.~~
109		-	39 (b) ~~The board may:~~
110		-	40 ~~(1) take any enforcement action authorized under this chapter~~
111		-	41 ~~for violations of~~ this ~~section; or~~
112		-	42 ~~(2) impose~~ a ~~civil penalty of not more than ten thousand~~

	91	+	28 misbrand a cultivated meat product.
	92	+	29 (b) A cultivated meat product is misbranded if the cultivated
	93	+	30 meat product is:
	94	+	31 (1) advertised;
	95	+	32 (2) labeled; or
	96	+	33 (3) offered for sale or sold;
	97	+	34 in a manner that does not clearly indicate that it is a cultivated
	98	+	35 meat product or not in accordance with rules adopted by the
	99	+	36 board.
	100	+	37 (c) The board shall investigate complaints that a person:
	101	+	38 (1) offered for sale; or
	102	+	39 (2) sold;
	103	+	40 a misbranded cultivated meat product.
	104	+	41 (d) A person shall include the phrase "THIS IS AN
	105	+	42 IMITATION MEAT PRODUCT" on the package containing a

114		-	1 dollars ($10,000) on a person that violates this section.
115		-	2 Civil penalties collected under this section shall be deposited in the
116		-	3 state general fund.
117		-	4 (c) Each day a violation continues constitutes a separate offense.
118		-	5 (d) After notice and hearing in compliance with IC 4-21.5, the
119		-	6 board may seek a court order to enjoin a person from selling,
120		-	7 offering for sale, or manufacturing cultivated meat products if the
121		-	8 person repeatedly and persistently fails to comply with this section.
122		-	9 (e) This section expires July 1, 2027.
123		-	10 SECTION 6. IC 15-17-5-6.3 IS ADDED TO THE INDIANA CODE
124		-	11 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
125		-	12 1, 2025]: Sec. 6.3. (a) The:
126		-	13 (1) Indiana state department of agriculture;
127		-	14 (2) board; and
128		-	15 (3) Indiana department of health;
129		-	16 shall jointly conduct a study that determines the safety of
130		-	17 cultivated meat products for human consumption.
131		-	18 (b) The:
132		-	19 (1) Indiana state department of agriculture;
133		-	20 (2) board; and
134		-	21 (3) Indiana department of health;
135		-	22 shall issue a report to the legislative council containing the findings
136		-	23 and recommendations from the study under subsection (a),
137		-	24 including any recommended legislation, in an electronic format
138		-	25 under IC 5-14-6 not later than December 1, 2025.
139		-	26 (c) The:
140		-	27 (1) Indiana state department of agriculture;
141		-	28 (2) board; and
142		-	29 (3) Indiana department of health;
143		-	30 may not contract with an entity or organization to conduct the
144		-	31 study described in subsection (a). The costs to conduct the study
145		-	32 described in subsection (a) are payable solely from appropriations
146		-	33 available to each entity listed in subdivisions (1) through (3).
147		-	34 (d) This section expires December 1, 2026.
