3232 A BILL FOR AN ACT to amend the Indiana Code concerning

3434 Be it enacted by the General Assembly of the State of Indiana:
3535 1 SECTION 1. IC 16-18-2-68.8 IS ADDED TO THE INDIANA
3636 2 CODE AS A NEW SECTION TO READ AS FOLLOWS

4141 7 [EFFECTIVE JULY 1, 2025]: Sec. 160.5. (a) "Health care entity",
4242 8 for purposes of IC 16-18-5, has the meaning set forth in
4343 9 IC 16-18-5-2.
4444 10 (b) "Health care entity", for purposes of IC 16-41-42.1, has the
4545 11 meaning set forth in IC 16-41-42.1-1.
4646 12 SECTION 3. IC 16-18-2-163, AS AMENDED BY
4747 13 P.L.179-2022(ss), SECTION 4, IS AMENDED TO READ AS
4848 14 FOLLOWS [EFFECTIVE JULY 1, 2025]: Sec. 163. (a) Except as
4949 15 provided in subsection (c), "health care provider", for purposes of
5050 16 IC 16-21 and IC 16-41, means any of the following:
5151 17 (1) An individual, a partnership, a corporation, a professional

5353 1 corporation, a facility, or an institution licensed or legally
5454 2 authorized by this state to provide health care or professional
5555 3 services as a licensed physician, a psychiatric hospital, a hospital,
5656 4 a health facility, an emergency ambulance service (IC 16-31-3),
5757 5 a dentist, a registered or licensed practical nurse, a midwife, an
5858 6 optometrist, a pharmacist, a podiatrist, a chiropractor, a physical
5959 7 therapist, a respiratory care practitioner, an occupational therapist,
6060 8 a psychologist, a paramedic, an emergency medical technician, an
6161 9 advanced emergency medical technician, an athletic trainer, or a
6262 10 person who is an officer, employee, or agent of the individual,
6363 11 partnership, corporation, professional corporation, facility, or
6464 12 institution acting in the course and scope of the person's
6565 13 employment.
6666 14 (2) A college, university, or junior college that provides health
6767 15 care to a student, a faculty member, or an employee, and the
6868 16 governing board or a person who is an officer, employee, or agent
6969 17 of the college, university, or junior college acting in the course
7070 18 and scope of the person's employment.
7171 19 (3) A blood bank, community mental health center, community
7272 20 intellectual disability center, community health center, or migrant
7373 21 health center.
7474 22 (4) A home health agency (as defined in IC 16-27-1-2).
7575 23 (5) A health maintenance organization (as defined in
7676 24 IC 27-13-1-19).
7777 25 (6) A health care organization whose members, shareholders, or
7878 26 partners are health care providers under subdivision (1).
7979 27 (7) A corporation, partnership, or professional corporation not
8080 28 otherwise qualified under this subsection that:
8181 29 (A) provides health care as one (1) of the corporation's,
8282 30 partnership's, or professional corporation's functions;
8383 31 (B) is organized or registered under state law; and
8484 32 (C) is determined to be eligible for coverage as a health care
8585 33 provider under IC 34-18 for the corporation's, partnership's, or
8686 34 professional corporation's health care function.
8787 35 Coverage for a health care provider qualified under this subdivision is
8888 36 limited to the health care provider's health care functions and does not
8989 37 extend to other causes of action.
9090 38 (b) "Health care provider", for purposes of IC 16-35, has the
9191 39 meaning set forth in subsection (a). However, for purposes of IC 16-35,
9292 40 the term also includes a health facility (as defined in section 167 of this
9393 41 chapter).
9494 42 (c) "Health care provider", for purposes of IC 16-32-5, IC 16-36-5,

9696 1 IC 16-36-6, and IC 16-41-10 means an individual licensed or
9797 2 authorized by this state to provide health care or professional services
9898 3 as:
9999 4 (1) a licensed physician;
100100 5 (2) a registered nurse;
101101 6 (3) a licensed practical nurse;
102102 7 (4) an advanced practice registered nurse;
103103 8 (5) a certified nurse midwife;
104104 9 (6) a paramedic;
105105 10 (7) an emergency medical technician;
106106 11 (8) an advanced emergency medical technician;
107107 12 (9) an emergency medical responder, as defined by section 109.8
108108 13 of this chapter;
109109 14 (10) a licensed dentist;
110110 15 (11) a home health aide, as defined by section 174 of this chapter;
111111 16 or
112112 17 (12) a licensed physician assistant.
113113 18 The term includes an individual who is an employee or agent of a
114114 19 health care provider acting in the course and scope of the individual's
115115 20 employment.
116116 21 (d) "Health care provider", for purposes of IC 16-36-7, has the
117117 22 meaning set forth in IC 16-36-7-12.
118118 23 (e) "Health care provider", for purposes of IC 16-40-4, means any
119119 24 of the following:
120120 25 (1) An individual, a partnership, a corporation, a professional
121121 26 corporation, a facility, or an institution licensed or authorized by
122122 27 the state to provide health care or professional services as a
123123 28 licensed physician, a psychiatric hospital, a hospital, a health
124124 29 facility, an emergency ambulance service (IC 16-31-3), an
125125 30 ambulatory outpatient surgical center, a dentist, an optometrist, a
126126 31 pharmacist, a podiatrist, a chiropractor, a psychologist, or a
127127 32 person who is an officer, employee, or agent of the individual,
128128 33 partnership, corporation, professional corporation, facility, or
129129 34 institution acting in the course and scope of the person's
130130 35 employment.
131131 36 (2) A blood bank, laboratory, community mental health center,
132132 37 community intellectual disability center, community health
133133 38 center, or migrant health center.
134134 39 (3) A home health agency (as defined in IC 16-27-1-2).
135135 40 (4) A health maintenance organization (as defined in
136136 41 IC 27-13-1-19).
137137 42 (5) A health care organization whose members, shareholders, or

139139 1 partners are health care providers under subdivision (1).
140140 2 (6) A corporation, partnership, or professional corporation not
141141 3 otherwise specified in this subsection that:
142142 4 (A) provides health care as one (1) of the corporation's,
143143 5 partnership's, or professional corporation's functions;
144144 6 (B) is organized or registered under state law; and
145145 7 (C) is determined to be eligible for coverage as a health care
146146 8 provider under IC 34-18 for the corporation's, partnership's, or
147147 9 professional corporation's health care function.
148148 10 (7) A person that is designated to maintain the records of a person
149149 11 described in subdivisions (1) through (6).
150150 12 (f) "Health care provider", for purposes of IC 16-45-4, has the
151151 13 meaning set forth in 47 CFR 54.601(a).
152152 14 (g) "Health care provider", for purposes of IC 16-18-5, has the
153153 15 meaning set forth in IC 16-18-5-3.

162162 24 Sec. 1. As used in this chapter, "conscience" means religious,
163163 25 moral, or ethical beliefs or principles.
164164 26 Sec. 2. As used in this chapter, "health care entity" means an
165165 27 entity, a partnership, a corporation, a professional corporation, a
166166 28 facility, or an institution licensed or legally authorized by this state
167167 29 to provide a health care service.
168168 30 Sec. 3. (a) As used in this chapter, "health care provider" means
169169 31 an individual licensed or authorized by this state to provide health
170170 32 care services.
171171 33 (b) The term includes an individual who is an employee or agent
172172 34 of a health care provider acting in the course and scope of the
173173 35 individual's employment.
174174 36 Sec. 4. As used in this chapter, "health care service" means any
175175 37 health care related service, treatment, or procedure to maintain,
176176 38 diagnose, or treat an individual's physical or mental condition.
177177 39 Sec. 5. (a) A health care provider may not be required to:
178178 40 (1) perform;
179179 41 (2) provide;
180180 42 (3) participate in; or

182182 1 (4) refer an individual for;
183183 2 a health care service that violates the health care provider's
184184 3 conscience.
185185 4 (b) A health care provider may not be subject to any of the
186186 5 following for declining to perform, provide, participate in, or refer
187187 6 an individual for a health care service described in subsection (a):
188188 7 (1) Discrimination, including denial of, revocation of, or
189189 8 disqualification for:
190190 9 (A) licensure, staff privileges, board certification, or career
191191 10 specialty;
192192 11 (B) a grant, contract, or other program; or
193193 12 (C) a residency or other training opportunity.
194194 13 (2) Adverse employment action, including termination of
195195 14 employment, transfer, demotion, reassignment to a different
196196 15 shift, or loss or reduction of wages or benefits.
197197 16 (3) Adverse administrative action.
198198 17 (4) Disciplinary or retaliatory action.
199199 18 (5) Criminal, administrative, or civil liability.
200200 19 Sec. 6. (a) A health care entity may not be required to perform,
201201 20 provide, participate in, or refer an individual for a health care
202202 21 service that violates the health care entity's conscience, as
203203 22 determined by the entity's existing or proposed:
204204 23 (1) guidelines;
205205 24 (2) mission statement;
206206 25 (3) constitution;
207207 26 (4) bylaws;
208208 27 (5) articles of incorporation;
209209 28 (6) regulations; or
210210 29 (7) other documents.
211211 30 (b) A health care entity that:
212212 31 (1) declines to perform, provide, participate in, or refer an
213213 32 individual for a health care service described in subsection
214214 33 (a);
215215 34 (2) discloses to the patient, in writing, that the health care
216216 35 entity reserves the right to decline to perform, provide,
217217 36 participate in, or refer the patient for a health care service
218218 37 that violates the health care entity's conscience; and
219219 38 (3) obtains written consent from the patient before the patient
220220 39 is admitted to the health care entity's facility;
221221 40 may not be criminally prosecuted or held administratively or
222222 41 civilly liable for refusing to perform, provide, participate in, or
223223 42 refer the patient for the health care service.

225225 1 (c) A health care entity or a prospective health care entity may
226226 2 not be subject to any of the following for declining to perform,
227227 3 provide, participate in, or refer an individual for a health care
228228 4 service described in subsection (a):
229229 5 (1) Discrimination.
230230 6 (2) Denial of, revocation of, or disqualification for:
231231 7 (A) licensure;
232232 8 (B) staff privileges;
233233 9 (C) a grant; or
234234 10 (D) any form of aid, assistance, benefit, or privilege.
235235 11 (3) Denial of authorization to establish, expand, improve,
236236 12 acquire, affiliate, or merge with the health care entity.
237237 13 Sec. 7. (a) A person injured by a violation of this chapter may
238238 14 bring an action against the person that violated this chapter.
239239 15 (b) It is not a defense in an action under this chapter that a
240240 16 violation was necessary to prevent additional burden or expense on
241241 17 a health care provider, a health care entity, an individual, or a
242242 18 patient.
243243 19 (c) A person whose rights have been violated by a violation of
244244 20 this chapter may assert the violation or impending violation as a
245245 21 claim or defense in a judicial, administrative, or other proceeding.
246246 22 Sec. 8. A prevailing plaintiff in an action brought under section
247247 23 7 of this chapter is entitled to the following:
248248 24 (1) Injunctive relief.
249249 25 (2) The greater of:
250250 26 (A) an amount not to exceed three (3) times the actual
251251 27 damages sustained; or
252252 28 (B) liquidated damages of five thousand dollars ($5,000).
253253 29 (3) Court costs and reasonable attorney's fees.
254254 30 (4) Any other appropriate relief determined by the court.
255255 31 SECTION 6. IC 27-2-30 IS ADDED TO THE INDIANA CODE AS
256256 32 A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY

259259 35 Sec. 1. This chapter applies to a policy or a contract issued,
260260 36 entered into, delivered, amended, or renewed by a health carrier
261261 37 after June 30, 2025.
262262 38 Sec. 2. As used in this chapter, "conscience" means religious,
263263 39 moral, or ethical beliefs or principles.
264264 40 Sec. 3. As used in this chapter, "health care service" means any
265265 41 health care related service, treatment, or procedure to maintain,
266266 42 diagnose, or treat an individual's physical or mental condition. The

268268 1 term includes a patient referral for a health care service.
269269 2 Sec. 4. (a) As used in this chapter, "health carrier" means an
270270 3 entity:
271271 4 (1) that is subject to this title and the administrative rules
272272 5 adopted under this title; and
273273 6 (2) that enters into a contract to:
274274 7 (A) provide health care services;
275275 8 (B) deliver health care services;
276276 9 (C) arrange for health care services; or
277277 10 (D) pay for or reimburse any of the costs of health care
278278 11 services.
279279 12 (b) The term includes the following:
280280 13 (1) An insurer, as defined in IC 27-1-2-3(x), that issues a
281281 14 policy of accident and sickness insurance, as defined in
282282 15 IC 27-8-5-1(a).
283283 16 (2) A health maintenance organization, as defined in
284284 17 IC 27-13-1-19.
285285 18 (3) An administrator (as defined in IC 27-1-25-1(a)) that is
286286 19 licensed under IC 27-1-25.
287287 20 (4) A state employee health plan offered under IC 5-10-8.
288288 21 (5) A short term insurance plan (as defined in IC 27-8-5.9-3).
289289 22 (6) Any other entity that provides a plan of health insurance,
290290 23 health benefits, or health care services.
291291 24 (c) The term does not include:
292292 25 (1) an insurer that issues a policy of accident and sickness
293293 26 insurance;
294294 27 (2) a limited service health maintenance organization (as
295295 28 defined in IC 27-13-34-4); or
296296 29 (3) an administrator;
297297 30 that only provides coverage for, or processes claims for, dental or
298298 31 vision care services.
299299 32 Sec. 5. (a) Except as required by federal law, but
300300 33 notwithstanding any other provision of this title, a health carrier
301301 34 may not be required to provide, deliver, arrange for, pay for,
302302 35 reimburse any of the costs of, or refer an individual for a health
303303 36 care service that violates the health carrier's conscience, as
304304 37 determined by the health carrier's existing or proposed:
305305 38 (1) guidelines;
306306 39 (2) mission statement;
307307 40 (3) constitution;
308308 41 (4) bylaws;
309309 42 (5) articles of incorporation;

311311 1 (6) regulations; or
312312 2 (7) other documents.
313313 3 (b) A health carrier that declines to provide, deliver, arrange
314314 4 for, pay for, reimburse any of the costs of, or refer an individual
315315 5 for a health care service described in subsection (a) may not be
316316 6 held civilly or criminally liable for declining to provide, deliver,
317317 7 arrange for, pay for, or reimburse any of the costs of a health care
318318 8 service.
319319 9 Sec. 6. A health carrier or prospective health carrier may not be
320320 10 subject to any of the following for declining to provide, deliver,
321321 11 arrange for, pay for, reimburse any of the costs of, or refer an
322322 12 individual for a health care service that violates the conscience of
323323 13 the health carrier or prospective health carrier:
324324 14 (1) Discrimination.
325325 15 (2) Denial of, revocation of, or disqualification for:
326326 16 (A) licensure;
327327 17 (B) a grant; or
328328 18 (C) any form of aid, assistance, benefit, or privilege.
329329 19 (3) Denial of authorization to establish, expand, improve,
330330 20 acquire, affiliate, or merge with the health carrier.
331331 21 (4) Criminal or civil liability.
332332 22 Sec. 7. (a) A person injured by a violation of this chapter may
