90+22 Chapter 7.5. Pediatric Cancer Research and Treatment Grant
91+23 Program
92+24 Sec. 1. The pediatric cancer research and treatment grant
93+25 program may be established. The state department shall
94+26 administer the program.
95+27 Sec. 2. (a) The pediatric cancer research and treatment fund is
96+28 established for the purpose of providing matching funds for
97+29 medical research and treatment grants that focus on pediatric
98+30 cancer research.
99+31 (b) The fund consists of:
100+32 (1) money received from state or federal grants or programs;
101+33 and
102+34 (2) gifts, money, and donations received from any other
103+35 source.
104+36 (c) The state department shall administer the fund. The
105+37 expenses of administering the fund shall be paid from money in the
106+38 fund.
107+39 (d) The treasurer of state shall invest the money in the fund not
108+40 currently needed to meet the obligations of the fund in the same
109+41 manner as other public money may be invested.
110+42 (e) Money in the fund at the end of a state fiscal year does not

112+1 revert to the state general fund.
113+2 (f) Money in the fund is continuously appropriated for the
114+3 purposes of the fund.
115+4 Sec. 3. (a) The state department may do the following:
116+5 (1) Develop the application and the criteria and standards of
117+6 eligibility for entities described in subsection (b) that apply for
118+7 a grant under this chapter.
119+8 (2) Establish criteria for determining the grant amount to be
120+9 awarded to an approved applicant and the terms of an
121+10 awarded grant, including placing a priority on providing
122+11 grants for the following:
123+12 (A) Innovative research and treatments with the potential
124+13 of resulting in novel therapies for pediatric cancer.
125+14 (B) Research and treatment identified by the state
126+15 department as part of the state department's needs
127+16 assessment under subdivision (6)(B) to address the state's
128+17 highest needs concerning pediatric cancer in Indiana
129+18 children.
130+19 (3) Determine policies for the expiration and renewal of a
131+20 grant.
132+21 (4) Require that all grant funds be used for the purpose of
133+22 research and treatment with the purpose of combating
134+23 childhood cancer.
135+24 (5) Develop procedures in ensuring that funds provided
136+25 through a grant are expended for the stated purpose.
137+26 (6) Develop a written plan to assist in making determinations
138+27 concerning grants under this chapter that does the following:
139+28 (A) Identifies existing pediatric cancer research, treatment,
140+29 and funding programs for pediatric cancer in Indiana and
141+30 those that provide assistance to children in Indiana
142+31 diagnosed with cancer.
143+32 (B) Includes a needs assessment for pediatric cancer
144+33 patients of Indiana identifying additional research funding
145+34 needs by cancer type and geographic area, with
146+35 documentation of any determination that support is
147+36 needed.
148+37 (C) Includes a prioritized list of programs and research
149+38 projects eligible for assistance under this chapter.
150+39 (7) Adopt administrative rules under IC 4-22-2 necessary for
151+40 the administration of this chapter.
152+41 (b) The state department may only award a grant under this
153+42 chapter to any of the following entities that specialize in

155+1 performing research and treatment in Indiana concerning
156+2 pediatric cancer for Indiana children:
157+3 (1) An Indiana institution of higher education.
158+4 (2) An Indiana academic medical center or medical research
159+5 hospital.
160+6 (3) An Indiana nonprofit entity.
161+7 (4) An Indiana governmental entity.
162+8 Sec. 4. (a) Before February 1 of each year, the state department
163+9 shall submit a written report to the governor and to the legislative
164+10 council in an electronic format under IC 5-14-6 that includes the
165+11 following:
166+12 (1) The plan developed under section 3(a)(6) of this chapter.
167+13 (2) The state department's determination about any
168+14 expenditure of funds under this chapter for the previous
169+15 calendar year and the impact of the use of the funds.
170+16 (3) The state department's plans for expenditures of funds
171+17 under this chapter in the current and subsequent calendar
172+18 year.
173+19 (4) Any recommendations for future initiatives or actions to
174+20 address pediatric cancer in Indiana.
175+21 (b) The state department shall publish the written report
176+22 required by subsection (a) on the state department's website.
177+23 SECTION 5. IC 16-46-7.6 IS ADDED TO THE INDIANA CODE
178+24 AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE
179+25 JULY 1, 2025]:
180+26 Chapter 7.6. Breast Cancer Research Grant Program
181+27 Sec. 1. As used in this chapter, "cancer center" means one (1) of
182+28 the following:
183+29 (1) An institution that has been designated by the National
184+30 Cancer Institute as a:
185+31 (A) comprehensive cancer center;
186+32 (B) clinical cancer center; or
187+33 (C) basic laboratory cancer center.
188+34 (2) A cancer research facility that is formally part of an
189+35 approved postsecondary educational institution (as defined in
190+36 IC 21-7-13-6(b)).
191+37 Sec. 2. As used in this chapter, "fund" refers to the breast
192+38 cancer research fund established by section 7 of this chapter.
193+39 Sec. 3. As used in this chapter, "program" refers to the grant
194+40 program established by the state department under this chapter.
195+41 Sec. 4. The state department may establish a program for the
196+42 purpose of providing grants to cancer centers in Indiana to

198+1 increase:
199+2 (1) breast cancer research projects; or
200+3 (2) breast cancer clinical trials.
201+4 Sec. 5. The state department may do the following:
202+5 (1) Develop the application criteria and standards for

205+8 (2) Make available grants to cancer centers that meet the
206+9 eligibility standards developed under subdivision (1).
207+10 However, the state department shall prioritize grants to

209+12 (A) A cancer center described in section 1(1) of this
210+13 chapter.
211+14 (B) A cancer center described in section 1(2) of this
212+15 chapter.
213+16 (3) Determine the maximum amount available for each grant.
214+17 (4) Determine policies for the expiration and renewal of
215+18 grants.
216+19 (5) Require that each grant be used for the purpose of breast
217+20 cancer research.
218+21 (6) Adopt rules under IC 4-22-2 necessary to implement this
219+22 chapter.
220+23 Sec. 6. The state department may administer the program.
221+24 Sec. 7. (a) The breast cancer research fund is established for the
222+25 purpose of carrying out this chapter. The state department shall
223+26 administer the fund.
224+27 (b) The fund consists of the following:
225+28 (1) Amounts, if any, distributed to the fund from the Indiana
226+29 tobacco master settlement agreement fund.
227+30 (2) Gifts, bequests, and other sources of funding.
228+31 (c) The expenses of administering the fund shall be paid from
229+32 money in the fund.
230+33 (d) The treasurer of state shall invest the money in the fund not
231+34 currently needed to meet the obligations of the fund in the same
232+35 manner as other public money may be invested.
233+36 (e) Money in the fund at the end of a state fiscal year does not
234+37 revert to the state general fund.
235+38 (f) Money in the fund is continuously appropriated for the
236+39 purposes of the fund.
