2726 A BILL FOR AN ACT to amend the Indiana Code concerning
2827 agriculture and animals.
2928 Be it enacted by the General Assembly of the State of Indiana:
3029 1 SECTION 1. IC 15-20-5 IS ADDED TO THE INDIANA CODE AS
3130 2 A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY

3332 4 Chapter 5. Retired Animal Adoption
3433 5 Sec. 1. As used in this chapter, "animal care facility" has the
3534 6 meaning set forth in IC 6-9-39-1.
3635 7 Sec. 2. (a) As used in this chapter, "research facility" means a
3736 8 privately or government owned, leased, or operated:
3837 9 (1) partnership;
3938 10 (2) corporation;
4039 11 (3) association;
4140 12 (4) school;
4241 13 (5) institution; or
4342 14 (6) organization;
4443 15 located in Indiana that uses animals for experimentation or
4544 16 research or that tests chemical substances, ingredients, drugs,
4645 17 medical devices, vaccines, products, or product formulations on

4847 1 animals.
4948 2 (b) The term includes a facility that carries out biomedical
5049 3 research or educational research.
5150 4 (c) The term does not include:
5251 5 (1) a partnership;
5352 6 (2) a corporation;
5453 7 (3) an association;
5554 8 (4) a school;
5655 9 (5) an institution; or
5756 10 (6) an organization;
5857 11 that primarily provides veterinary services to an animal.
5958 12 Sec. 3. As used in this chapter, "retired animal" means a dog or
6059 13 cat that:
6160 14 (1) is confined at a research facility;
6261 15 (2) has previously been used for research; and
6362 16 (3) is no longer required for research purposes.
6463 17 Sec. 4. A research facility shall establish an adoption program
6564 18 for retired animals confined at the research facility.
6665 19 Sec. 5. A research facility shall offer a retired animal for
6766 20 adoption to an animal care facility, unless euthanizing the dog or
6867 21 cat is required for health or safety reasons.
6968 22 Sec. 6. A research facility may enter into a collaborative
7069 23 agreement with one (1) or more animal care facilities for the
7170 24 purpose of carrying out the provisions of section 5 of this chapter.
7271 25 Sec. 7. Once a retired animal is eligible for adoption, the
7372 26 research facility shall do one (1) of the following:
7473 27 (1) Offer to transfer ownership and custody of the retired
7574 28 animal to an animal care facility to facilitate the transfer of
7675 29 ownership and custody of the retired animal to a person for
7776 30 placement into the person's permanent home.
7877 31 (2) Offer to transfer ownership and custody of the retired
7978 32 animal to a person for private placement in the person's
8079 33 permanent home according to an arrangement agreed to by
8180 34 the research facility and the person adopting the retired
8281 35 animal.
