3232 A BILL FOR AN ACT to amend the Indiana Code concerning
3333 elections.
3434 Be it enacted by the General Assembly of the State of Indiana:
3535 1 SECTION 1. IC 2-5-55 IS ADDED TO THE INDIANA CODE AS

3838 4 Chapter 55. Presidential Electors Apportionment Task Force
3939 5 Sec. 1. The definitions set forth in IC 2-5-1.2 apply to this
4040 6 chapter.
4141 7 Sec. 2. As used in this chapter, "task force" refers to the
4242 8 presidential electors apportionment task force established by
4343 9 section 3 of this chapter.
4444 10 Sec. 3. The presidential electors apportionment task force is
4545 11 established.
4646 12 Sec. 4. Except as otherwise provided in this chapter, the task
4747 13 force is subject to IC 2-5-1.2 and the policies and rules of the
4848 14 legislative council.
4949 15 Sec. 5. The task force consists of the following ten (10) members:
5050 16 (1) Two (2) members of the senate appointed by the president
5151 17 pro tempore.

5353 1 (2) A member of the senate appointed by the minority leader
5454 2 of the senate.
5555 3 (3) Two (2) members of the house appointed by the speaker.
5656 4 (4) A member of the house appointed by the minority leader

5858 6 (5) Four (4) members representing civic organizations
5959 7 interested in elections appointed as follows:
6060 8 (A) One (1) member appointed by the president pro
6161 9 tempore.
6262 10 (B) One (1) member appointed by the minority leader of
6363 11 the senate.
6464 12 (C) One (1) member appointed by the speaker.
6565 13 (D) One (1) member appointed by the minority leader of
6666 14 the house.
6767 15 A member appointed under subdivision (5) may not be a member
6868 16 of the general assembly.
6969 17 Sec. 6. (a) The term of a member of the task force expires
7070 18 November 1, 2025.
7171 19 (b) A member of the task force serves at the pleasure of the
7272 20 appointing authority.
7373 21 Sec. 7. The appropriate appointing authority shall fill a vacancy
7474 22 on the task force in accordance with IC 2-5-1.2-9.
7575 23 Sec. 8. (a) Six (6) members of the task force constitute a quorum.
7676 24 (b) Except as provided in subsection (c), the affirmative vote of
7777 25 a majority of the members present at a task force meeting is
7878 26 necessary for the task force to take official action other than to
7979 27 meet and take testimony.
8080 28 (c) A member appointed under section 5(5) of this chapter may
8181 29 not vote on the recommendation of the task force under section
8282 30 11(2) of this chapter. The affirmative vote of a majority of the
8383 31 members appointed under section 5(1) through 5(4) of this chapter
8484 32 is necessary for the task force to make a recommendation under
8585 33 section 11(2) of this chapter.
8686 34 Sec. 9. Subject to IC 2-5-1.2, the task force shall meet at the call
8787 35 of the chair.
8888 36 Sec. 10. (a) A lay or legislative member of the task force is
8989 37 entitled to receive the same per diem, mileage, and travel
9090 38 allowances paid to legislative members of interim study committees
9191 39 established by the legislative council.
9292 40 (b) A member of the task force who is:
9393 41 (1) a state employee; and
9494 42 (2) not a member of the general assembly;

9696 1 is not entitled to a per diem. However, the member is entitled to
9797 2 reimbursement for traveling expenses as provided under
9898 3 IC 4-13-1-4 and other expenses actually incurred in connection
9999 4 with the member's duties as provided in the state policies and
100100 5 procedures established by the Indiana department of
101101 6 administration and approved by the budget agency.
102102 7 (c) Amounts paid under this section shall be paid from
103103 8 appropriations made to the legislative council or the legislative
104104 9 services agency.
105105 10 Sec. 11. The task force shall do the following:
106106 11 (1) Study and assess the state of Nebraska law that requires
107107 12 electoral votes for President of the United States to be
108108 13 apportioned between:
109109 14 (A) congressional district presidential electors whose
110110 15 electoral vote is cast for the candidate who received the
111111 16 greatest number of votes in a congressional district; and
112112 17 (B) at-large presidential electors whose electoral vote is
113113 18 cast for the candidate who received the greatest number of
114114 19 votes in the state.
115115 20 (2) Make a recommendation as to whether Indiana should
116116 21 pass legislation to adopt the state of Nebraska model
117117 22 described in subdivision (1).
118118 23 Sec. 12. The task force shall report its findings and
119119 24 recommendations to the legislative council in an electronic format
120120 25 under IC 5-14-6 before November 1, 2025.
121121 26 Sec. 13. This chapter expires December 31, 2025.
122122 27 SECTION 2. An emergency is declared for this act.
