3434 A BILL FOR AN ACT to amend the Indiana Code concerning
3535 health and to make an appropriation.
3636 Be it enacted by the General Assembly of the State of Indiana:
3737 1 SECTION 1. IC 16-46-7.5 IS ADDED TO THE INDIANA CODE
3838 2 AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE

4040 4 Chapter 7.5. Pediatric Cancer Research and Treatment Grant
4141 5 Program
4242 6 Sec. 1. As used in this chapter, "council" means the rare disease
4343 7 advisory council established by IC 16-46-17-2.
4444 8 Sec. 2. The pediatric cancer research and treatment grant
4545 9 program is established. The council shall administer the program.
4646 10 Sec. 3. (a) The pediatric cancer research and treatment fund is
4747 11 established for the purpose of providing matching funds for
4848 12 medical research and treatment grants that focus on pediatric
4949 13 cancer research.
5050 14 (b) The fund consists of:
5151 15 (1) money appropriated for the grant or to the fund by the
5252 16 general assembly;
5353 17 (2) money received from state or federal grants or programs;

5656 2 (3) gifts, money, and donations received from any other
5757 3 source, including transfers from other funds or accounts.
5858 4 (c) The council shall administer the fund. The expenses of
5959 5 administering the fund shall be paid from money in the fund.
6060 6 (d) The treasurer of state shall invest the money in the fund not
6161 7 currently needed to meet the obligations of the fund in the same
6262 8 manner as other public money may be invested. Interest that
6363 9 accrues from these investments shall be deposited in the fund.
6464 10 (e) Money in the fund at the end of a state fiscal year does not
6565 11 revert to the state general fund. Money in the fund is continuously
6666 12 appropriated.
6767 13 Sec. 4. (a) The council shall do the following:
6868 14 (1) Develop the application and the criteria and standards of
6969 15 eligibility for entities described in subsection (b) that apply for
7070 16 a grant under this chapter.
7171 17 (2) Establish criteria for determining the grant amount to be
7272 18 awarded to an approved applicant and the terms of an
7373 19 awarded grant, including placing a priority on providing
7474 20 grants for the following:
7575 21 (A) Innovative research and treatments with the potential
7676 22 of resulting in novel therapies for pediatric cancer.
7777 23 (B) Research and treatment identified by the council as
7878 24 part of the council's needs assessment under subdivision
7979 25 (6)(B) to address the state's highest needs concerning
8080 26 pediatric cancer in Indiana children.
8181 27 (3) Determine policies for the expiration and renewal of a
8282 28 grant.
8383 29 (4) Require that all grant funds be used for the purpose of
8484 30 research and treatment with the purpose of combating
8585 31 childhood cancer.
8686 32 (5) Develop procedures in ensuring that funds provided
8787 33 through a grant are expended for the stated purpose.
8888 34 (6) Develop a written plan to assist in making determinations
8989 35 concerning grants under this chapter that does the following:
9090 36 (A) Identifies existing pediatric cancer research, treatment,
9191 37 and funding programs for pediatric cancer in Indiana and
9292 38 those that provide assistance to children in Indiana
9393 39 diagnosed with cancer.
9494 40 (B) Includes a needs assessment for pediatric cancer
9595 41 patients of Indiana identifying additional research funding
9696 42 needs by cancer type and geographic area, with

9898 1 documentation of any determination that support is
9999 2 needed.
100100 3 (C) Includes a prioritized list of programs and research
101101 4 projects eligible for assistance under this chapter.
102102 5 (7) Adopt administrative rules under IC 4-22-2 necessary for
103103 6 the administration of this chapter.
104104 7 (b) The council may only award a grant under this chapter to
105105 8 any of the following entities that specialize in performing research
106106 9 and treatment in Indiana concerning pediatric cancer for Indiana
107107 10 children:
108108 11 (1) An Indiana institution of higher education.
109109 12 (2) An Indiana academic medical center or medical research
110110 13 hospital.
111111 14 (3) An Indiana nonprofit entity.
112112 15 (4) An Indiana governmental entity.
113113 16 Sec. 5. (a) Before February 1 of each year, the council shall
114114 17 submit a written report to the governor and to the legislative
115115 18 council in an electronic format under IC 5-14-6 that includes the
116116 19 following:
117117 20 (1) The plan developed under section 4(a)(6) of this chapter.
118118 21 (2) The council's determination about the expenditure of
119119 22 funds under this chapter for the previous calendar year and
120120 23 the impact of the use of the funds.
121121 24 (3) The council's plans for expenditures of funds under this
122122 25 chapter in the current and subsequent calendar year.
123123 26 (4) Any recommendations for future initiatives or actions to
124124 27 address pediatric cancer in Indiana.
125125 28 (b) The council shall publish the written report required by
126126 29 subsection (a) on the state department's website.
