34	34	A BILL FOR AN ACT to amend the Indiana Code concerning
35	35	health and to make an appropriation.
36	36	Be it enacted by the General Assembly of the State of Indiana:
37	37	1 SECTION 1. IC 16-46-7.5 IS ADDED TO THE INDIANA CODE
38	38	2 AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE
39	39	3 JULY 1, 2025]:
40	40	4 Chapter 7.5. Pediatric Cancer Research and Treatment Grant
41	41	5 Program
42	42	6 Sec. 1. As used in this chapter, "council" means the rare disease
43	43	7 advisory council established by IC 16-46-17-2.
44	44	8 Sec. 2. The pediatric cancer research and treatment grant
45	45	9 program is established. The council shall administer the program.
46	46	10 Sec. 3. (a) The pediatric cancer research and treatment fund is
47	47	11 established for the purpose of providing matching funds for
48	48	12 medical research and treatment grants that focus on pediatric
49	49	13 cancer research.
50	50	14 (b) The fund consists of:
51	51	15 (1) money appropriated for the grant or to the fund by the
52	52	16 general assembly;
53	53	17 (2) money received from state or federal grants or programs;

56	56	2 (3) gifts, money, and donations received from any other
57	57	3 source, including transfers from other funds or accounts.
58	58	4 (c) The council shall administer the fund. The expenses of
59	59	5 administering the fund shall be paid from money in the fund.
60	60	6 (d) The treasurer of state shall invest the money in the fund not
61	61	7 currently needed to meet the obligations of the fund in the same
62	62	8 manner as other public money may be invested. Interest that
63	63	9 accrues from these investments shall be deposited in the fund.
64	64	10 (e) Money in the fund at the end of a state fiscal year does not
65	65	11 revert to the state general fund. Money in the fund is continuously
66	66	12 appropriated.
67	67	13 Sec. 4. (a) The council shall do the following:
68	68	14 (1) Develop the application and the criteria and standards of
69	69	15 eligibility for entities described in subsection (b) that apply for
70	70	16 a grant under this chapter.
71	71	17 (2) Establish criteria for determining the grant amount to be
72	72	18 awarded to an approved applicant and the terms of an
73	73	19 awarded grant, including placing a priority on providing
74	74	20 grants for the following:
75	75	21 (A) Innovative research and treatments with the potential
76	76	22 of resulting in novel therapies for pediatric cancer.
77	77	23 (B) Research and treatment identified by the council as
78	78	24 part of the council's needs assessment under subdivision
79	79	25 (6)(B) to address the state's highest needs concerning
80	80	26 pediatric cancer in Indiana children.
81	81	27 (3) Determine policies for the expiration and renewal of a
82	82	28 grant.
83	83	29 (4) Require that all grant funds be used for the purpose of
84	84	30 research and treatment with the purpose of combating
85	85	31 childhood cancer.
86	86	32 (5) Develop procedures in ensuring that funds provided
87	87	33 through a grant are expended for the stated purpose.
88	88	34 (6) Develop a written plan to assist in making determinations
89	89	35 concerning grants under this chapter that does the following:
90	90	36 (A) Identifies existing pediatric cancer research, treatment,
91	91	37 and funding programs for pediatric cancer in Indiana and
92	92	38 those that provide assistance to children in Indiana
93	93	39 diagnosed with cancer.
94	94	40 (B) Includes a needs assessment for pediatric cancer
95	95	41 patients of Indiana identifying additional research funding
96	96	42 needs by cancer type and geographic area, with

98	98	1 documentation of any determination that support is
99	99	2 needed.
100	100	3 (C) Includes a prioritized list of programs and research
101	101	4 projects eligible for assistance under this chapter.
102	102	5 (7) Adopt administrative rules under IC 4-22-2 necessary for
103	103	6 the administration of this chapter.
104	104	7 (b) The council may only award a grant under this chapter to
105	105	8 any of the following entities that specialize in performing research
106	106	9 and treatment in Indiana concerning pediatric cancer for Indiana
107	107	10 children:
108	108	11 (1) An Indiana institution of higher education.
109	109	12 (2) An Indiana academic medical center or medical research
110	110	13 hospital.
111	111	14 (3) An Indiana nonprofit entity.
112	112	15 (4) An Indiana governmental entity.
113	113	16 Sec. 5. (a) Before February 1 of each year, the council shall
114	114	17 submit a written report to the governor and to the legislative
115	115	18 council in an electronic format under IC 5-14-6 that includes the
116	116	19 following:
117	117	20 (1) The plan developed under section 4(a)(6) of this chapter.
118	118	21 (2) The council's determination about the expenditure of
119	119	22 funds under this chapter for the previous calendar year and
120	120	23 the impact of the use of the funds.
121	121	24 (3) The council's plans for expenditures of funds under this
122	122	25 chapter in the current and subsequent calendar year.
123	123	26 (4) Any recommendations for future initiatives or actions to
124	124	27 address pediatric cancer in Indiana.
125	125	28 (b) The council shall publish the written report required by
126	126	29 subsection (a) on the state department's website.
