46+A BILL FOR AN ACT to amend the Indiana Code concerning state
47+offices and administration.
1448 Be it enacted by the General Assembly of the State of Indiana:
15-SECTION 1. IC 4-3-28.5 IS ADDED TO THE INDIANA CODE
16-AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE
17-UPON PASSAGE]:
18-Chapter 28.5. Indiana-Ireland Trade Commission
19-Sec. 1. As used in this chapter, "commission" refers to the
20-Indiana-Ireland trade commission established by section 2 of this
21-chapter.
22-Sec. 2. The Indiana-Ireland trade commission is established as
23-a temporary commission under the executive branch of state
24-government to:
25-(1) advance bilateral trade and investment between Indiana
26-and Ireland;
27-(2) initiate joint action on policy issues of mutual interest to
28-Indiana and Ireland;
29-(3) promote business and academic exchanges between
30-Indiana and Ireland;
31-(4) encourage mutual economic support between Indiana and
32-Ireland;
33-(5) encourage mutual investment in the infrastructure of
34-Indiana and Ireland; and
35-(6) address such other issues as determined by the
36-HEA 1489 — Concur 2
37-commission.
38-Sec. 3. The governor's office shall provide staff support to the
39-commission.
40-Sec. 4. (a) The commission consists of the following thirteen (13)
41-members:
42-(1) Nine (9) members, all of whom are voting members,
43-appointed by the governor and subject to the following
44-requirements:
45-(A) At least one (1) member must be a member of the
46-Indiana chamber of commerce.
47-(B) At least one (1) member must be a representative of an
48-institution of higher education located in Indiana.
49-(C) At least two (2) members must be members of the
50-public who represent Irish American communities or
51-interests.
52-(D) At least two (2) members must have civic experience in
53-either public service or leading an organization
54-representing Irish Americans.
55-Not more than two (2) members appointed under clauses (C)
56-and (D) may be members of the same political party as the
57-governor. A member appointed under this subdivision may
58-not be a member of the general assembly.
59-(2) Four (4) legislative members, all of whom are nonvoting
60-advisory members, appointed as follows:
61-(A) One (1) member of the senate appointed by the
62-president pro tempore of the senate.
63-(B) One (1) member of the house of representatives
64-appointed by the speaker of the house of representatives.
65-(C) One (1) member of the senate appointed by the
66-minority leader of the senate.
67-(D) One (1) member of the house of representatives
68-appointed by the minority leader of the house of
69-representatives.
70-Each legislative member appointed under this subdivision
71-must have knowledge of or current or past involvement in
72-organizations that promote Irish affairs or must have interest
73-in the well-being of trade relations between Indiana and
74-Ireland.
75-(b) A member of the commission serves for a four (4) year term
76-that ends on June 30 of an odd-numbered year. A member serves
77-at the will of the appointing authority. However, if a legislative
78-member of the commission ceases being a member of the body

80-from which the member was appointed, the member's position on
81-the commission is vacant and shall be filled in accordance with
82-subsection (c).
83-(c) If a vacancy exists on the commission, the appointing
84-authority who appointed the member whose position has become
85-vacant shall appoint an individual to fill the vacancy. An individual
86-appointed to fill a vacancy serves on the commission for the
87-remainder of the unexpired term of the individual's predecessor.
88-Sec. 5. (a) The governor shall call the first meeting of the
89-commission before July 1, 2025. At the first meeting, the voting
90-members appointed to the commission shall select a voting member
91-to serve as chairperson of the commission. The chairperson serves
92-a two (2) year term ending on June 30 of an odd-numbered year.
93-The chairperson is eligible for reappointment.
94-(b) After selecting the chairperson at the first meeting held
95-under subsection (a), the commission shall meet at the call of the
96-chairperson and must meet at least three (3) times in each calendar
97-year.
98-(c) The chairperson may create subcommittees composed of the
99-members of the commission.
100-Sec. 6. (a) A majority of all members appointed to the
101-commission constitutes a quorum.
102-(b) The affirmative votes of a majority of the voting members
103-appointed to the commission are required for the commission to
104-take action on any measure.
105-Sec. 7. A member's service on the commission is voluntary, and
106-a member of the commission is not entitled to:
107-(1) the minimum salary per diem provided by
108-IC 4-10-11-2.1(b); or
109-(2) reimbursement for mileage, traveling expenses under
110-IC 4-13-1-4, and other expenses actually incurred in
111-connection with the member's duties as provided in the state
112-policies and procedures established by the Indiana
113-department of administration and approved by the budget
114-agency.
115-Sec. 8. All meetings of the commission are open to the public in
116-accordance with and subject to IC 5-14-1.5. All records of the
117-commission are subject to the requirements of IC 5-14-3.
118-Sec. 9. The commission may accept gifts, grants, and bequests

156+4 Sec. 10. (a) The commission may:
157+5 (1) expend money received under section 9 of this chapter to
158+6 defray the commission's expenses; and
159+7 (2) perform any action necessary to carry out its purposes
160+8 under this chapter.
161+9 (b) Expenditures under this section must be approved by the
162+10 affirmative vote of a majority of the voting members of the
163+11 commission.
164+12 (c) The commission shall:
165+13 (1) keep accurate accounts of all commission income and
166+14 expenditures in the manner prescribed by the state board of
167+15 accounts; and
168+16 (2) submit an accounting of the income and expenditures for
169+17 the previous state fiscal year to the department of local
170+18 government finance before September 1 of each year.
171+19 Sec. 11. The department of local government finance shall
172+20 ensure that each accounting received under section 10 of this
173+21 chapter is accessible through the computer gateway administered
174+22 by the office of technology.
175+23 Sec. 12. Before January 1, 2026, and before January 1 of each
176+24 year thereafter, the commission shall annually report its activities
177+25 to the governor and to the general assembly. The report must
178+26 include any recommendations necessary to carry out the
179+27 commission's purposes under this chapter. The report to the
180+28 general assembly must be in an electronic format under IC 5-14-6.
181+29 Sec. 13. This chapter expires June 30, 2029.
182+30 SECTION 2. An emergency is declared for this act.
